Martinez , Councilman The meeting opened with the pledge of allegiance, followed by the in- vocation by Reverend Robert B. Perry of the University Methodist Church. The minutes of the January 18, 1966 Council meeting were approved as submitted. This being the date advertised for the opening of bids on Gas Tax Project Nos . 158 and 180, street improvements at Terracina and Fern Avenue , the following proposals were opened and publicly declared in Tax the office of the City Clerk at 10:00 A.M. , this date and referred to act 58 and the Department of Public Works for study and recommendation. City Manager Merritt gave the Council a brief report on the pr of the Neighborhood Youth Council program. Grant Deed from W. C. PLANNING COMMISSION RECOMMENDATIONS As considered by the City Council at a regular meeting thereof. February 1 , 1966, at 3 :00 P.M. Present : Councilmen Martinez , Wagner, Hartzell , Cummings , Mayi Burroughs ; Attorney Davis 1 . Conditional Use Permit No. 120 - Leo ,Thayer That the request of Leo Thayer for a Conditional Use Permit in an M-1 zone to construct a pancake house on property located of the southwesterly side of Industrial Park Avenue approximately 400 feet west of Alabama Street , be approved subject to the recommendations of all departments as contained in Planning Coi mission minutes dated January 25 , 1966, and excepting therefroi that portion of engineering requirement No. 3 referring to the railroad tracks . On motion of Councilman Wagner, seconded by Councilman Cummings , the recommendation of the Planning Commis• sion was adopted by the City Council. 2. Conditional Use Permit No. 121 - Olie ' s Coffee Shop That the request of Olie' s Coffee Shop for a Conditional Use P1 mit in an R-2 zone to construct a coffee shop on property knows as 34 The Terrace, be approved, subject to the recommendations of all departments as contained in Planning Commission minutes dated January 25, 1966, and subject to the requirement that a complete new site plan be brought in for commission review and approval. On motion of Councilman Hartzell , seconded by Coun- cilman Wagner, the recommendation of the Planning Commission wi adopted by the City Council . 3. Variance No . 127 - Olie ' s Coffee Shop That the request of Olie ' s Coffee Shop for a variance to permi construction of a freeway oriented sign containing 150 square feet instead of 100 square feet - the maximum permitted - R-2 zone , be denied for the reason that it does not meet the cri- teria in the ordinance for the granting of a variance . On mo- tion of Councilman Wagner, seconded by Councilman Martinez , the recommendation of the Planning Commission was adopted by the City Council. 4. Variance No. 128 - Bert Marcum That the request of Bert Marcum for a variance from the front yard provisions of the R-A (Residential Estate) District to ( 1 ) permit a front setback of seventeen ( 17 ) feet for the house rather than the required minimum of twenty-five (25 ) feet , and (2) permit a garage to be set back (5 ) feet from the front property line when attached to the main residence rather than detached, for property located 600 feet west of Rossmont Drive, be approved, subject to the Planning Depart- ment recommendations as the conditions set forth in the or- dinance for the granting of a variance have been met . Following Council discussion and presentation by Mr. Ben Rabe of what he considers a flaw in the Zoning Ordinance, on mo- tion of Councilman Cummings , seconded by Councilman Martinez , this matter was tabled for two weeks , with a request that the Planning Commission review the section of the Zoning Ordin- ance which applies in this matter. Motion carried unanimously 5. They wish to locate the trailer adjacent to the Range . Manager Merritt also presented a proposed addition to the ordin- ance code to provide for the above request . This will be dis- cussed at the next meeting. HED BUSINESS Ordinance No. 1309, an ordinance approving Annexation District No. 29 nance to the City of Redlands , was given second reading of the title and 1309 adopted on motion of Councilman Hartzell and seconded by Councilman ation Wagner by the following roll call vote : 29 AYES : Councilmen Wagner, Hartzell, Cummings, Mayor Burroughs NOES : None ABSENT: Councilman Martinez INESS Resolution No . 2501 , a resolution of the City Council of the City of ution Redlands, calling and giving notice of the holding of a General Muni- 2501 eipal Election on April 12, 1966, was adopted on motion of Councilman tion Cummings, seconded by Councilman Hartzell. Section 10012. 5 of the Election Code provides that each candidate for office may submit a statement of qualifications to be mailed to reg- istered voters with the sample ballot . Regarding this service , Coun- cilman Hartzell made the following motion: "That the City Clerk be hereby instructed to notify each candidate that if he files a state- ment of qualifications .pursuant to Section 10012 . 5 of the Election Code, he shall bear his pro rata share of the cost of printing and handling such statement ; and further that he shall at the time of filing, post a deposit of $100.00 to be applied to such costs . " Mo- tion was seconded by Councilman Cummings and carried. NAGER City Manager Merritt presented Resolution No. 2502, which permits the ution construction of a spur track in the right-of-way of Citrus Avenue to 2.502 serve the La-Z-Boy Chair Company. Manager Merritt presented an application for alcoholic beverage li- cense for the information of the Council. The request of J. A. Blash Amusements to operate a carnival at the ival University Plaza Shopping Center on February 16 through February 20, rsity 1966, was approved, subject to the requirements of all departments za and to the requirement that the amusements be located on the Lugonia side of the development between the Shell Station and the Wheel House on motion of Councilman Cummings, seconded by Councilman Hartzell. To qualify for the State of California Airport Assistance Funds, it tion is neaessary that matching funds be available in the City' s Special nd Aviation Fund.
