Public hearing was set for this time and place on the intention of
the City to vacate an easement on a portion of property adjoining
West Avenue which the City has recently vacated. Mayor DeMirjyn 3
announced the meeting open as a public hearing for any questions or
.ution comments concerning this easement vacation. None being forthcomingfl,

the public hearing was declared closed. On motion of Councilman I
lion ent Miller, seconded by Councilman Elliott, the City Council. approved
Avenue Resolution No. 3359, a resolution of the City Council finding that
a certain public service easementis unnecessary and ordering the
vacation of said easement. This resolution was adopted by AYE votes k
of all present.
The public hearing on Resolution No . 3349, which was begun at th
Council meeting of May 17, 1977, was tabled to this time. On mo
of Councilman Elliott, seconded by Councilman Miller, the Counci
moved to remove this matter from the table at this time and cont
the public hearing. Mayor DeMirjyn announced the meeting open a
Resolution continuation of the public hearing on Resolution No. 3349, a res
No . 3349 of the city of Redlands declaring intention to establish the She
Sherril Lane Lane Assessment District, and called for any questions or commen

District concerning this Assessment District. No comments were forthcomi
Attorney Taylor asked if any protests had been filed by any of t
property owners prior to this meeting. The City Clerk replied t
none had been filed in her office . Mr. Taylor further explained
this resolution requires that if there are any protests, they mu
filed prior to the bearing on the resolution and must be made by
owners of property within the district and must be in writing; b
added that the Council, of course, could hear any spoken comment
this time, Mr. Taylor noted that the property owners had been
notified by mail, by the posting of the property, and by a meeti
held with owners of the property and members of the Public Works
ment .
Councilman Elliott stated that public hearing had been held, tha
of the property within the district had been fully notified, and
objections had been received written or orally; and therefore, g
for confirmation of Resolution No. 3349 which declared intention
establish the Sherril Lane Assessment District, and adoption of
Assessment Diagram and Notice of Assessment for delivery to the
Recorder. This motion was seconded by Councilman Knudsen, and
adopted by AYE votes of all present.
Councilman Knudsen explained to the audience that the staff had
out a method of funding this sewer installation by a loan from t
City Sewer Plan Replacement Fund, which he believes will obtain
bid price and a great savings to the owners. He added that the
Fund will be reimbursed by the 1911 Act.
ORAL PETITIONS FROM THE FLOOR
Mr. Anthony R. Martinez addressed Council about a letter he had
from Mayor DeMirjyn concerning the Senior Citizen Organization c
Senior California of which Mr. Martinez is a member. Mr. Martinez requ
Citizen the opportunity to solicit funds to aid needy senior citizens an

the United Fund.
Mayor DeMirjyn stated that the City could not approach the Unite

Chamber of Commerce, addressed council in place of Chamber president
Burt Miller who is recuperating in the hospital . Mr. Limburg read a
prepared statement relating to the 1977-78 City budget and reported
a proposed tax-rate increase. Mr. Limburg' s report points to additiona
revenues to the city resulting from increased assessed valuation and ,
requested a delay in the adoption of the City budget. He also referred
to ten other cities in the county which were either lowering or holding
the same tax rate - not raising it.
Following this report, which is on file in the office of the City
Clerk, Council discussed the matter at length with the large audience
of Chamber of Commerce members and interested citizens present in the
Council Chambers . After extensive discussion, Mr. Archbold, Finance
Director, explained that the motion this evening would be giving appro-
val only -to the non-tax-supported funds, and that further action this
evening would be giving tentative approval to the tax-supported funds,
subject to final information from the Assessor' s office . Mr. Archbold
added that this is the procedure used annually. After further discus-
sion, councilman Knudsen moved to adopt the "enterprise" (Non-tax-
supported) portion of the general fund budget as presented, but speci -
fically not setting the tax rate, and await information from the
Assessor ' s Office as to the total assessment; secondly, to give tenta-
tive approval of the tax-supported fund which will be finalized when
the Council has full information from the County Assessor. Motion
seconded by Councilman Elliott and adopted by the following roll call

and revised map for Tract No. 9801, as contained in Planning Commis-
sion minutes dated Mav 24, 1977 . On motion of Councilman Knudsen,

That tentative map for Tract No. 8742, located on the south side
Pioneer Avenue, 660 feet east of Church Street, 45 lots, R-1 Zon
approved, subject to the recommendations of all departments as c

Recommendation No. 2 to read: Lots Nos . 9, 10, 27, 28 and 45 be inc
by four feet to a width of 74 feet with a corresponding reductio

That tentative map for Tract No. 9678, located on the southwest
of Pennsylvania Avenue and Church Street, 57 lots; R-1 Zone, be
approved, in accordance with the applicant' s map subject to all
departmental recommendations as contained in Planning commission
dated May 24, 1977, and Planning Department ' s revision and addin
Planning Recommendation No. 6 to require applicant' s engineer tc

Community Development Director Schindler stated that considerabl

6 . Tentative Map Tract No. 9818 - William R. Coleman
That the tentative map for Tract No. 9818, located at the southu
corner of Citrus Avenue andWabash Avenue, 20 lots, R-S Zone (pen

contained in Planning Commission minutes dated May 24, 1977, and
accordance with the study map as set forth by the Planning Depar

recommendation was approved, subject to the zone change of R-S 2
by AYE votes of all present .
7 . Tentative Map Tract No. 9835 - Lewis Homes of California
That the tentative map for Tract No. 9835, located at the northe
corner of Brockton Avenue and Judson Street, 39 lots, R-1 Zone,
approved subject to all requirements of all departments as conta
in Planning commission minutes dated May 24, 1977 . This recomme
of the Planning Commission was adopted on motion of Councilman N
seconded by Councilman Knudsen, by AYE votes of all present.
8 . Tentative Map Tract No. 9870 - Larry McDowell
That the minor subdivision proposed at the southeast corner of Kansas
Street and Orange Avenue, R-2 Zone (pending) , four lots, receive
tentative approval subject to the tentative map, with Public Works
items indicated under Section 6 of Engineering and subject to all other
departmental recommendations, as contained in Planning Commission
minutes dated May 24, 1977, and with possible relief on Engineering
Division Item 6A .
Mr. Schindler read a letter asking dedication of an 80-foot easement
to the Flood Control . Mr. John Starner, of Ludwig Engineering, replied
in behalf of Scorpion Enterprises that the developer had a meeting
schedulEd for June 15, 1977, to discuss the Flood Control request.
Public Works Director Jack Shefchik stated that the applicant ' s pro-
posal to install a 20-foot drainage easement with 8-inch berm would
be satisfactory for carrying water; however, that he had concern where
this alley crossed the internal street, and also that he questioned
whether access could be taken by this alley. The engineer replied
that a pipe will be installed as requested by the Engineering Division,
and the drainage easement also. Following this discussion, on motion
of Councilman Knudsen, seconded by Councilman Miller, the recommenda-
tion of the Planning Commission, and with the understandings above, was
approved by AYE votes of all present.
Minor Subdivision No. 33 - John and Sarah Tyler
That the request that Minor Subdivision No. 33, proposed at 650 New
York Street, C-M Zone, be approved subject to the recommendations of
all departments as contained in Planning Commission minutes dated
May 24, 1977. On motion of Councilman Miller, seconded by Councilman
Elliott, this recommendation of the Planning Commission was approved
by AYE votes of all present.
Conditional Use Permit No. 265 - William Matteson
Thatthe application for a Conditional Use Permit to allow a ten-unit
Planned Residential Development on 16 .65 acres located south of
Crescent Avenue and 445 feet east of Crown Street, R-E Zone, receive
approval of the preliminary plan, subject to the requirements of all
departments as outlined in Planning Commission minutes dated May 24,
1977, and adding Planning Department recommendation No- 5 that an
inventory of all existing tree growth be prepared and a report on the
condition of the trees removed be made part of the application . In
answer to Mr. Knudsen ' s question concerning grading, Mr. Schindler
replied that there would be grading only where the pads are located,
and added that requirements relating to the slope allowed are still
applicable . Mr. Schindler reminded Council that the Planned Residentia]
Development ordinance required a two-part application to the Planning
Commission, so this will be returning to the Commission. On motion of
Councilman Knudsen, seconded by Councilman Elliott, tentative approval
of Conditional Use Permit No . 265 was given by AYE votes of all present ,
Conditional Use Permit No. 266 - Jeff Eltinqe
That the application for a Conditional use Permit for a 44-unit Planned
Residential Development on approximately 10 acres located at the
southwest corner of Citrus Avenue and Dearborn Street, be given prelimi..
nary approval subject to the recommendations of all departments as
contained in Planning Commission minutes dated May 24, 1977, with the
revisions required by the Planning Department to be worked out with
the staff, and subsequent deletion of Planning Department requirement
No. 3 . Council discussed this property at length with Larry Gunn,
architect for the developer. Mr. Gunn stated that it was the developer ' s
intent to save as mart/ orange trees within the development as possible
and to keep the orange grove on the open space, if practical . Council
