The meeting was opened with the pledge of allegiance, followed by
of silent prayer in memory of David Goldie who was very active in
affairs.
Minutes of the regular meeting of September 4 , 1979, were approved
submitted.
BIDS
The following bids were opened and publicly declared at 10 : 00 A.M.

At this time, it is the recommendation of the Department of Public
that award be made to Environmental Landscape Contractors as this
date in the office of the City Clerk for modification of the traffic sig-
nal at the intersection of Orange and State Streets :

At this time, it is the recommendation of the Department of Public Works
that award be made to Signal Maintenance, Inc. as this is the lowest,
qualified bidder. On motion of Councilman DeMirjyn, seconded by Council-
man Knudsen, Council approval was given by AYE votes of all present to
the award of the modification of the traffic signal at the intersection of
Orange and State Streets to Signal Maintenance, Inc. of Anaheim in the
amount of $6 , 650. 00.

Theater:

Leon Armantrout, architect for this project, shared his thoughts on the
Prospect Park Theater stating although the bids were considerably higher
than the estimates, the design is highly flexible and usable, and it wouldi
be a wise investment. He stated his firm would revise the plans at no
additional cost. i
Julian Blakely, speaking for the Fri-ends of Prospect Park , told Council
his group stands ready to present $30, 000. 00 to the City to be used for
the construction of this theater. Council expressed deep gratitude to Mr.1
Blakely for this gesture. On motion of Councilman DeMirjyn, seconded by i
Councilman Riordan, Council agreed to a thirty-day continuance for furtherl,
study by staff and the Park Commission on the awarding of the bid for the
construction of the Prospect Park Theater.

Planning Commission recommendations as considered by the City Coun

1. R. P.C. No. 508 - General Plan Amendment No. 25 - City of Redlands
That R. P.C. No. 508 , a resolution of the Planning Commission recom
the adoption of Amendment No. 25 to the General Plan adopting the
Housing Element, be approved. On motion of Councilman Riordan, se
by Councilman DeMirjyn , R.P.C. No. 508 was approved by the City Co
and Resolution No. 3612 , a resolution of the City of Redlands sett
public hearing on Amendment No. 25 to the General Plan, was author
public hearing on October 2 , 1979 , at 7 : 00 P.M.
2 . County General Plan Amendments
The County Planning Commission has scheduled a hearing for Septem
1979, to consider three General Plan Amendments. The Planning Dep
and Commission do not oppose two of the amendments. The proposal
by T & S Properties, to amend the County General Plan from Residen
6 D. U./AC to Commercial, is for property located*less than one-ha
from the commercial complex located around the intersection of Lak
Avenue and Brookside Avenue. The Redlands ' General Plan designat
subject area as low density residential (4 to 6 D.U. per acre) ; th
the property could not be developed for neighborhood type commerci
in accordance with the criteria contained in Zoning- Ordinance No.
The County Environmental Review Committee granted a "Negative Decl
for this amendment in spite of the City' s request for tabling and
preparation of an Environmental Impact Report. Several residents
nearby Lewis Tract also appeared at the hearing and strongly prate
Commission and letters be directed to the Environmental Review Committee
Hearing Officer , the County Planning Director , and the Supervisor of the
district. Motion seconded by Councilman Knudsen and carried by AYE votes
of all present.
'EMS FOR COUNCIL CONSIDERATION
Minor Subdivision No. 64 - Warren 11. Putnam - Final Approval
All requirements as outlined in Council minutes dated January 16, 1979 ,
having been complied with, it is the recommendation of the Planning Depart4
ment that final approval be given minor Subdivision No. 64 . on motion of
Councilman DeMirjyn , seconded by Councilman Knudsen, this recommendation
of the Planning Department was approved by AYE votes of all present.
Minor Subdivision No. 76 - Amos Chaves - Final Approval
All requirements as outlined in Council minutes dated August 21 , 1979 , hay..L'
ing been complied with, it is the recommendation of the Planning Department
that final approval be given Minor Subdivision No. 76. On motion of Coun- I
cilman DeMirjyn, seconded by Councilman Knudsen, this recommendation of th4
Planning Department was approveed by AYE votes of all present.
Tentative Map Tract No. 9870 - Thomas Lee Miller, Jr, - Time Extension
On motion of Councilman DeMirjyn, seconded by Councilman Riordan, a time
extension of one year to September 20, 1980, was given by AYE votes of all ';
present for Tentative Map Tract No. 9870.
City of Redlands vs. Sack - Commission Review and Approval No. 369 - 1055
Calle De Las Palmas
Attorney Atkins reviewed the appeal filed by Mr. and Mrs. William Sack of
the Planning Commission ' s denial of Commission Review and Approval No. 369 ;
concerning fencing for a tennis court at 1055 Calle De Las Palmas. Litiga
tion was commenced seeking a court order requiring removal of that part ofl
the fencing which exceeded six feet in height in accordance with Council
action on January 2 , 1979. Since that time, it has been alledged that
circumstances in the neighborhood have changed to the extent that the fend
is no longer a nuisance and is not the object of significant objection by 1
those who are within view of it. Mr. Atkins asked Council if they wished
to reconsider their prior determination .
Robert H. Ziprick , attorney for Mr. and Mrs. Sack, presented a letter to
Council urging reconsideration of their action and direct the litigation i
be dismissed.
Michael Atencio,Community Planner, stated he had personally contacted each
neighbor and informed them of this afternoon ' s meeting. As there were no
comments forthcoming from the audience, Councilman DeMirjyn moved to direc�
the City Attorney ' s office to prepare a stipulation for judgement in this
court action dismissing the litigation and submit it to the court. Motion ]
seconded by Councilman Knudsen and carried by AYE votes of all present.

On motion of Councilman DeMirjyn , seconded by Councilman Knudsen, Council
authorized extension of the City' s self-insured program to include the Re—
development Agency activities by AYE votes of all present.
There being no further business, Council adjourned to an executive session]

Thursday, September 20, at 1 :45 P.M. in the City Hall Conference Room.
