Mayor Roth declared the meeting open as a public hearing for any questions or comment concerning this change of zone. This assistance was denied on motion of Councilman Martinez, seconded by Councilman DeMirjyn, by unanimous vote. Council discussed street light requirements with Dr. Larry Poland briefly ?, but took no further action. Planning Commission recommendations as considered by the City Council at a regular meeting thereof held on May 4, 1982, at 3:00 P.M. No. 564, a resolution of the Planning Commission for adoption of Zone Change No. 242, a change of zone from R-1 (Single Family Residen Irl tial) District to R-2 (Multiple Family Residential) District for approxi- mately pproxi mately 12.4 acres of property located on the southwest corner of Pennsyl- vania ennsyl vania Avenue and Church Street, be approved, and that City Council withhold( second reading of the ordinance until an amendment to Specific Plan No. 16 1 is approved. On motion of Councilman Martinez, seconded by Councilman ;fid 03,1, Johnson, this recommendation of the Planning Commission was approved, and Ordinance No. 1789 was given first reading of the title with unanimous �1 waiver of reading of the ordinance in full. Jennings �``�( At its April 27, 1982, meeting, the Planning Commission unanimously denied Al an application for a variance from the provisions of Ordinance No. 1000 �h Section 12.20(c) to allow more than one residential dwelling unit (mobile- home) mobile home) on a lot containing less than 2-1/2 acres located at 3051 Mill Creel.�,? 2 i Road, Mentone, A-1 Zone. An appeal to this decision has been filed in the 1��\ City Clerk's Office by the applicant. On motion of Councilman Martinez It seconded by Councilman Johnson, Council unanimously set May 18, 1982, at 3:00 P,M, to consider this appeal. OTHER PLANNING ITEMS FOR COUNCIL CONSIDERATION 7i Arrowhead Christian Academy Request The Arrowhead Christian Academy, through Dr. Larry Poland, had requested city assistance of a loan with interest from the Sewer Improvement Fund ( � to help pay sewer installation fees until four other developers including John Moore and Jim Coffin could develop and assume their share of the costs. Following very detailed discussion, Councilman Martinez moved for an attorney/client meeting this afternoon following the meeting with a decision to be given at 7:00 P.M. tonight. Motion seconded by Councilman Gorman and unanimously approved. Vice Mayor DeMirjyn stated that having the Academy would be a great asset to the City and that he believes these people will do what they say they will do, and he hopes it will be worked out. He added this particular sewer has been a problem for years. W' 1�1 { 1 r 6 !-tet {i r) x OTHER PLANNING ITEM.. FOR COUNCIL CONSIDERATION (Continued) ` 2. Tract No. 9607 - Deed to Lot "A" - king/Gemmell �} When the applicant purchased Lot 7 of this tract, he was told by the ria developer that: "Parcel 'A' was a portion of his Lot 7 which was then in negotiation with the city. It was reported to be his property so it was fenced by the developer. Following $30,000 of landscaping, sprinkling g � system, and a spa, he found this to be untrue. Council and Attorneys+, Holmes discussed options at great length. Street Supertintendent .Ron Mutter stressed the city need for a twenty-five foot right-of-way at the street curve for street purposes. I� Councilman Gorman recommended a lot line adjustment attaching Parcel "A" i� to Lot 7 upon receipt of adequate right-of-way for future public street irr purposes. On motion of Councilman Martinez, seconded by Councilman � ! DeMirjyn, this matter was delayed by consensus to the next meeting for 1A preparation of the necessary paper work. , 3. San BernardinoCounty Communication �i A communication from San Bernardino County was received April 28, 1982, requiring an answer no later than May 7, 1982_ Council discussed this ti project which is across from the Footlighters Theater. It was made clear that sewer service cannot be by gravity flow. Council authorized a commu } nieation by Planning Director Schindler that this area is designated as Urban Reserve and in accordance with Resolution No. 2601 the City will not be supplying sewer or water. This motion received the following vote:! i AYES: Councilmembers DeMirjyn, Martinez, Gorman; Mayor Roth; ABSTAIN: ` �) Councilman Johnson. City Manager Christiansen mentioned that more time will be given in the future by County Planning Director Ken Topping. 9, C.U.P. No. 365 - Video Arcade Facility - Michael Burke l)r on motion of Councilman DeMirjyn, seconded by Councilman Gorman, their Council unanimously concurred with the action of the Planning Commission , F to deny Conditional Use Permit No. 365. The Council then adjourned to a brief Redevelopment Agency meeting to be tj followed by a closed Council session to discuss matters covered by the hk attorney/cl.ient privilege from which no report is expected. 0I Park Commission - On motion of Councilman Johnson, seconded by Councilman P1 Amphitheater Martinez, Council unanimously approved renewal for two years an agreement Agreement between the City and Friends of Prospect Park for management and super- { vision of the Prospect Park Amphitheater. ' Council referred a request from Redlands Community Hospital concerning i Tax Exempt Bonds to the City Attorney for clarification. its -N14 � NEW BOSINESS �i Resolution Resolution No. 3825, a resolution of the City Council determining the No. 3825 amount of property tax revenues to be exchanged between and among the Tax Exchange g County of San Bernardino and the City of Redlands resulting from Annexatioq l,t ,. Annexation No. 58, LAFC No. 2162, was unanimously approved by Council on motion of No. 58 Sw� Councilman DeMirjyn, seconded by Councilman Gorman. itir�l Resolution No. 3826, a resolution of the City Council amending the water l �3,�Y Resolution rates established in REsclution No. 3812 by establishing irrigation rates , ,. No. 3826 ?i for customers living both within and outside the city limits, was unani- mously approved by Council on motion of Councilman DeMirjyn, seconded by 4s S Irrigation �} _ Water Dates Councilman Gorman. This resolution will reduce the water rates for 58 „} customers who have at least 40 edible fruit bearing trees being maintained k 1,� on their properties. Councilman Johnson spoke concerning the procedure used in implementation �( £ of the recent water rate increase approved under Resolution No. 3812. He felt strongly this was unfair and moved for billing a full two month cycle, �� Water Rates at the old rate beginning May 7, 1982 until July 4, 1982, making the situation more equitable. Following lengthy discussion, this motion lost by the following vote: AYES: Councilmembers Martinez, Johnson; NOES: Councilmembers DeMirjyn, Gorman; Mayor Roth. { UNFINISHED BUSINESS 1a Ordinance No. 1788 was tabled from the meeting of April 20, 1982, to this �fts time in order that Council might better study the completed ordinance and �'s} i to prepare numerous copies for interested citizens and for the press. Discussion began with Councilman Johnson's criticism of the points Allo �£ } wj Gated for drainage - SECTION 2-C, Storm and Flood Drainage. Motion was }£ made by Councilman Johnson to delete C-4, and seconded by Councilman DeMirjyn. �r,t Storm ,, and Advantages and disadvantages were discussed at length, ratings of past `f },! Flood developments compared, potential flooding of downtown Redlands past i I'ti'e g r 6' i,'Irt Dra ina e � `z recommendations cited, and possibility of ruling out development were srr considered. The limited areas of County Flood Control within the City were described �} �';l and the efforts being made in the direction of ultimately g <i "d g y providing a flood �:�}; �0 channel_ Following this discussion, the vote on Councilman Johnson's motion was: AYES: Councilmembers Martinez, Johnson; NOES: Councilmembers f' DeMirjyn, Gorman; Mayor Roth. >> Councilman Johnson then discussed evaluation of five sample projects, Al none of which would have been approved under Ordinance No. 1788. Council- man ouncilman Johnson made a motion to reduce the minimum total from 80 to 70 points O � under SECTION 11 - Point Rating System, After discussion,he withdrew his }� motion. k ( Councilman Martinez instructed } Cit} Attorney Holmes to prepare timing ?' of approval under a new draft. ( f: } JO If ; a 1178 t _ UNFINISHED BUSINESS (Continued) 3 Councilman Gorman briefly explained the reason for requiring that projects; be approved tentatively before being judged in order to rule out condition$ ,, which would eliminate them from the allocation process. l'Y j', Councilmember DeMirjyn said he was wondering of the propriety of doing this and was wondering if they should have a committee again and have a consen- sus. Councilman Gorman stated there had been an enormous amount of input from staff, attorney, and the sub-committee. Dr. Roth said that as a mem ber of that first committee he felt public committees have a place but ins}�u `s not now. An ordinance is written and they are fine-tuning this ordi.nance, � t,)r and now we have a time constraint. i Councilman DeMirjyn stated that Page 12, 5-D, is telling people what they can do and suggested all negative points be removed and in exchange to ;ti�� require 10,000 to 15,000 square foot lots. �� 4�r;rP Councilman Gorman read from a copy of Proposition "R," "preservation ofkj "ysi�s Agricultural Land," he said much effort has gone into this and he failed �?1' to see how these deletions would preserve the agricultural land. Proposi- tion "R" was to award the� eo le who do not remove land from the Agricul- tural ricul- �;� P P 9 �• tural Preserve, and penalize the projects which required removal of such f„' �U land. In addition to minus 5, there are several plus 5's. 1iY Ordinance Dr_ Roth said in addition there is one other basic thing, if you have land ! O{j ! Council approved by the following vote: AYES: Councilmembers DeMirjyn, Martinez, Johnson; Mayor Roth; i1 NAE: Councilmember Gorman. r 0�3 i Councilman Gorman stated that the projects in the Planning Director's memo were not relevant as they were not put together under the revised Kg, ground rules, One major outcry was continual, that the ordinance was not ,2 P,' in accordance with the intent of Proposition "F.." on motion of Councilman Johnson, seconded by Councilman Martinez, the minimum points projects need to receive a building permit allocation be changed from 80 to 75. It was originally 70 ,points minimum. Council approved by the following vote: AYES: Councilmembers Martinez, Johnson, Mayor Roth; NOES: Councilmembers DeMirjyn, Gorman. Police protection was discussed and on recommendation of the Police Depart mcnt because there is no means of equitably awarding points, the five point catagory was eliminated on motion of Councilman Roth, seconded by Council- man DeMirjyn, and unanimous approval by Council. I Second reading and public hearing was authorized for May 18, 1982, at 7:00 P.M. f `r} 179 f t CITY MANAGER It Resolution No. 3827, a resolution of the City Council adopting a housing finance revenue bond program in cooperation with the County of San No.Resolution Bernardino and authori2i_ng the Mayor and City Clerk to execute for and on OR W�" behalf of the City a cooperative agreement between the County and the City hj Housing was unanimously approved on motion of Councilman DeMirjyn, seconded by Revenue Councilman Gorman. This will allow the City to participate in the tax- s Bond exempt mortgage revenue bond program which the residents of Redlands will Program i benefit from this financing. The bonds will provide below market interest xl 1, �r;},, rate financing for new and existing housing for first-time home buyers with incomes less than 120% of the State median income, Councilman Johnson j U,'% , stated that this would allow a first-time buyer making $41,640 to be eligible. �i On motion of Councilman Martinez, seconded by Councilman Johnson, Council �S} Funds lWeed unanimously approved an additional appropriation of $12,000 which is Abatement reimbursable b property owners for weed abatement costs incurred b i11e l Y P P Y Y qq �i dumping and trespassers cutting trees and dead orange groves, On, motion of Councilman DeMirjyn, seconded by Councilman Gorman, Council +�1 Funds unanimously approved an additional appropriation in the amount of $9,000 Street for a major engine overhaul and repair on the Street Division's 1-3/4 �{ #UlPii' Division cubic yard Cat 920 Loader. This equipment is valued at $45,000 and is expected to last another ten years, h� r In response to Councilman Johnson's request, Water Superintendent Dave Garcia gave a report on the cities water situation in view of the action rya by San Bernardino to put a moratorium on water spreading. Following Mr. Water Spreading Garcia's presentation and his recommendation, Council directed that a letter go to the Water Conservation District with a copy to San Bernardinos� requesting a resumption of spreading in the Mill Creek area.
