On motion of Councilman Johnson, seconded by Councilman DeMirjyn, the 1S City Council for the City of Redlands hereby certified that the final �ir,r�t) its I Environmental Impact Report for paragraph "H” of General Plan Amendment Final No. 27 has been completed in compliance with the California Environmental3 FIR Quality Act and State guidelines and that this decision-making body 4 having final approval authority over the project has reviewed and consid-i �`''+li i ered all information contained in the Environmental Impact Report prior to the approval of the project. Mayor Roth declared the meeting open as a public hear- ing for any questions or comments concerning Specific Plan No, 29. TPat Meyer, representing Commerce Environments, urged Council approval of Ordinance „ . No. 1794 this specific plan pointing out that as a procedural step the repeal of the j 4 Specific underlying zoning could be done later. There being no further comments, Plan the public hearing was declared closed. 10 No. 29 On motion of Councilman Martinez, seconded by Councilman DeMirjyn, Ordinance No, 1794, an ordinance of the. City of Redlands adopting Specific Plan No. 29, was adapted, with wiaver of the reading of the ordinance in full, by the following roll call vote: r AYES: Councilmembers DeMirjyn, Martinez, Johnson; Mayor Roth OE'S: Councilmember Gorman ABSENT: None ORAL PETITIONS FROM TIME FLOOR Mr. 'Perry Mead, 324 West Olive Avenue, addressed Council regarding approval; granted earlier today for Conditional Use Permit No. 373 for the Redlands Restoration and Historical Association, Stating that 40 neighbors had Q C.0 373,P. opposed this application at last week's Planning Commission meeting and that the Planning Commission had recommended denial, Mr. Mead asked for an a explanation from councilmembers who voted for this approval. Councilman .Johnson said the approval was only granted for six months in order for reconsideration of all conditions. A. Nassairian and M. Dehdashti That the application for a conditional use permit for a 35-unit Planned Residential Development on 3.1 acres of property located on the southwest corner of University Street and Lugonia Avenue, R-2 zone be approved sub- ject to the recommendations of all departments as contained. in Planning Commission minutes dated July 13, 1982, and finding that the application is in accordance with the necessary findings and conditions as specified in Section 52.00(C) of Ordinance 1000 and amending the site plan to permit t ='s southerly driveways to be 26 feet and with the understanding that the grading plan will come back for further review. On motion of Councilman DeMirjyn, seconded by Councilman Martinez, Conditional Use Permit No. 366 was unanimously approved by Council as recommended by the Planning Commission. ax 2. Tentative Tract No. 12174 - Commerce Environments That Tentative Tract No. 12174 for the subdivision of 16.48 acres of prop- erty located at the southeast corner of Lugonia Avenue and California CK Street into five lots, C-M Zone, be approved subject to the recommendations! Stating that Council finds that Tentative Tract No. 12174 is consistent with the General Plan, Government Code Section 66474, and waste discharge requirements, Councilman �r� DeMirjyn moved to approve this recommendation of the Planning Commission. Conditional Use Permit No. 373 - Redlands Restoration and Historical ' Association, Inc./William Crook The Planning Commission, by majority vote, recommended denial of Conditional i' - 1 Use Permit No. 373, an application for the establishment of a meeting place! for a non-profit civic group or community organization at 405 West Olive i , Avenue, R-3 Zone. This recommendation of the Planning Commission was based] on the reason that the application did not meet all of the necessary find- �)�a ings as contained in Section 52(C) of Zoning ordinance No. 1000. 1r i ii�tljt,# i Following a discussion between Attorney Holmes and Council, Councilman Johnson moved to reject the report and findings of the Planning Commission on Conditional use Permit No. 373; to find that all five findings in Section 52.00 of ordinance No. 1000 can be made and are made in behalf of ''t� % Conditional Use Permit No. 373; to find that this is a permitted use under Section 52(A) (2) (p) of Zoning Ordinance No. 1000;*and to add the �trrt condition to such approval that the conditional use permit be reviewed at the first meeting in February, 1983, by the City Council at a public hear- ing for any violation of any condition or unanticipated adverse impact on �il'rF the neighborhood from the use in operation. Motion seconded by Councilman Martinez. Mayor Roth expressed concern regarding the non-profit status. Attorney Holmes stated this was a legitimate question; that Council must satisfy I themselves that under the Zoning Ordinance this entity must either be a non-profit civic group or a community organization other than a social or r l', fraternal club, and that if this organization is one of these two things, then it fits within the conditional use permit section and can meet and have related functions at the location of the conditional use permit. The applicant, Mr. William Crook, 405 West Olive Avenue, reviewed what had occurred at the Planning Commission meeting and asked for fair and equal `t; `a treatment under the law by granting approval so that the citizens of<<( � Redlands would have equal opportunity to visit either Kimberly-Crest or the] Holt House. He informed Council that he had applied several weeks ago to change from a mutual benefit organization to a public benefit organization. There was no one else from the audience who wished to speak at this time, I Mayor Roth expressed his opinion that the Kimberly-Crest application would not have the same impact in a neighborhood and expressed his concern about ; parking. Councilman Johnson felt there was more on-site and street parking; available at the Holt House than at the Kimberly-Crest. Councilman Gorman stated he thought that when Council amended Ordinance No.1000, it seemed �tyr�t to him to be very clear that each matter would be individually assessed '�s;�t� and given equal consideration, but not necessarily equal treatment. He ort further stated he did not feel that some of the stated uses for this house met the criteria for finding that must be made in this matter. Approval of Conditional Use Permit No. 373, as stated above, was then granted by the following vote: AYES: Councilmembers DeMirjyn, Martinez, and Johnsont ';�i NOES: Councilmember Gorman; Mayor Roth 4. R.P.C. No. 577 - Ordinance Text Amendment. No. 161 - City of Redlands That R.P.C. No 577, a resolution of the Planning Commission for adoption of Amendment No 161 to Zoning Ordinance No. 1000 to require a landscaped f area, of 25 or more feet in width for projects adjacent to freeway rights- of-way, major and secondary highways, freeway frontage roads and any street # having historical or significant features, be approved. Councilman Johnson it moved to approve R.P.C. No. 577 with the deletion of the words "and any street having historical or significant features." The motion failed by the following vote: AYES: Councilmembers DeMirjyn and Johnson; NOES: s Councilmembers Martinez, Gorman; Mayor Roth. On motion of Councilman Martinez, seconded by Councilman Gorman, R.P.C. No. 577 was approved by the City Council and Ordinance No. 1796, an ordinance of the City of Redlands adopting Amendment No. 161 to Zoning Ordinance No. 1000, was given first reading of the title, introduced, and laid over under, the rules with public hearing set for August 3, 1982, at 7:00 P.M. by the following vote: AYES: Councilmembers Martinez, Gorman; Mayor Roth; NOTES: Councilmembers DeMirjyn and Johnson. OTHER PLANNING ITEMS FOR COUNCIL CONSIDERATION 1. clrnar Subdivision No. 44 - Wayne Hutchinson - Time Extension. On motion of Councilman Martinez, seconded by Councilman Johnson, a time extension of one year. to August 19, 1983, was unanimously given for Minor .Subdivision No. 94 since the applicant needs additional time to prepare at lot line adjustment and to obtain vinancing. v 2. On motion of Councilman Martinez, seconded by Council- man DeMirjyn, Resolution No. 3840, a resolution of the City Council amending the Agricultural Preserve Boundaries and approving Agricultural ; z. Preserve Removal No. 53, was unanimously approved by Council. 3. Section 202 H.U.D. Housing Project On motion of. Councilman DeMirjyn, seconded by Councilman Martinez, Council unanimously stated the City does not object to the proposal from H.U.D. for development of. Section 202 Housing to be located in Redlands and that the g� project is consistent with the City's Housing Assistance Plan. Mr. Hal Hagen informed Council that the Baptist Church was unable to obtain ..i; the financing needed but felt it was more important to secure the housing, and therefore surrendered their rights. There being no further business, Council reciessed, on motion, to a closed 3 session for the purpose of discussing matters covered under the attorney/ s client privilege. Council will reconvene at 7:00 P.M. this evening in the Council Chambers. Noting that presently a public hearing is not required at Council level "# for a conditional use permit application, Councilman Johnson moved to C.U.P. ing instruct the City Attorney and staff to prepare an amendment to Ordinance Hearing, No. 1000 that would require a duly advertised public hearing for any appeal; S on a conditional use permit application. CITY 7 §AGER �* The City Council unanimously authorized setting a public hearing for August+ Underground 3, 1982, at 7:00 P.M. to consider the establishment of Underground Utilities Utilities District No. 6 on Center Street on motion of Councilman Martinez, seconded ' District No. 6 by Councilman Johnson. Councilman Gorman requested the city pursue with Edison Company the use of City standard street lights as he felt they were much more superior. Bid Call The City Clerk was unanimously authorized to advertise for bids for the reconstruction of Lincoln Street at the Atchison, Topeka and Santa Fe Lincoln' Street Railroad using Gas Tax funds on motion of Councilman Martinez, seconded by i M Councilman DeMirjyn. a. Pipeline Sluis, and Marbrisa Villa's Developers for a ten foot wide easement located=, Easements ��. between Tennessee Street and Kansas Street, south of Orange Avenue. The Easement is required for the construction of a fifteen inch diameter trunk sewer. z The County Office of Community Development has advised us that H.U.D. has RF Community approved the award of the remaining alternatives for completion of Phase II, Center Phase lI construction for the Community Center. Joe Gonzales spoke expressing Alternatives happiness to have come to this second state and expressed gratitude on behalf of the committee for Council's support and. approval. On motion of Councilman Martinez, seconded by Councilman DeMirjyn, the following change order was unanimously approved for Phase 11 construction of Community Center in the amount of $113,140: ' Alternative A Hardwood Floors $46,758 C Racquetball Enclosure 47,060 D Lockers 8,100 E Bleachers 6,172 H Shelving 3,000 P Security System 300 Q Fane Grading 1,000 S Alarm System 150 T T.V.
