PLANNING AND COMMUNITY DEVELOPMENT

That the request to vacate a portion of a street generally located
on the northeast corner of Ford Street and Reservoir Road be approved

Planning Commission minutes dated November 8, 1983. On motion of
Councilman DeMirjyn, seconded by Councilman Martinez, Resolution
No. 3929, a resolution of the City Council declaring its intention j

A11 requirements as outlined in Council minutes dated September 7,
1982, having been complied with, it is the recommendation of the
Planning Department that final approval be given Tentative Tract Map
�i y{ter No. 11937. On motion of Councilman DeMirjyn, seconded by Councilman 1
�'srss+ Martinez, this recommendation of the Planning Department was unanimously

CITY ATTORNEY

City Attorney Holmes conveyed two requests from the League of California
CitiesCities to join other cities in Friends of the Court briefs at no cost-
Friends . to the City. The first brief being prepared concerns the Los Angeles
of the County case where the County is appealing the ruling that found the
Court anti-strike initiative provisions unconstitutional. Councilman DEMirjyn
Briefs moved to join the Friends of the Court brief for this pending case.

Motion seconded by Councilman Gorman and carried unanimously. The �..®
other brief being prepared regards the Chula Vista case which called
into question the City of Chula Vista's entering into exclusive, trash
collection franchise without competitive. bidding. Councilman Martinez
moved to join this Friends of the Court brief. Motion seconded by
Councilman Gorman and carried unanimously.
Council recessed at 3:07 P.M. to a Redevelopment Agency meeting and
reconvened at 3:20 P.M. to a closed session for the purpose of discussing
items covered under the attorney/client privilege. Council reconvened r
at 7:00 P.M.
BIDS
Paving The City Clerk was unanimously authorized to advertise for bids for
materials for 1-984 on motion of Councilman Martinez "

PUBLIC 1#EARING
Public hearing was advertised for this gime and place on Resolution
No. 3926, a resolution of the City Council establishing the Fountain y
Resolution Avenue Sewer Assessment District for the construction of an 8-inch A
No. 3926 diameter sewer main including sewer laterals to the street curb lines
of parcels within Fountain Avenue, south of Elizabeth Street. Public
Fountain Works Director Donnelly stated that all posting as required by law
Avenue had been done, all property owners were notified of this public hearing,
Sewer and that no written protests have been received. Mayor Roth declared
Assessment the meeting open as a public hearing for any quesions or comments
District concerning the establishment of the Fountain Avenue Sewer Assessment
District. None being forthcoming, the public hearing was declared
closed. On motion of Councilman Gorman, seconded by Councilman Martinez,
Resolution No. 3926 was unanimously continued to December 6, 1983, °
as recommended by the City Attorney.
APPLICATIONS AND PETITIONS
At its September 27, 1983, meeting, the Planning Commission deniedr,"',
Variance No. 282 which requested approval of two sign code variances „t
for Pep Boys' new store on Redlands Boulevard and Texas Street,. An "
Appeal appeal to this decision was filed by Superior Electrical Advertising
and a hearing was set for this time and place. Community Development ,
Pep Boys Administrator Schindler reported he had received a phone call this
Signs morning from Pep Boys indicating they would comply with all City �
ordinances, and they wished to withdraw the appeal. On motion of
Councilman Johnson, seconded by Councilman Gorman, the appeal was �€
denied unanimously. ,
COMMUNICATIONS
— Councilman Johnson reported the Senate Local Government Committee will
hold a hearing on November 22 in San Bernardino to discuss the need
for long-term financing for cities. With Council's permission, r `
Councilman Johnson will attend this hearing and will strongly support
this concept on behalf of the Council.
NEW BUSINESS t
Engineering On motion of Councilman DeMirjyn, seconded by Councilman Martinez,
Services the Department of Public Works was unanimously authorized to engage
John Carollo Engineers at a cost not to exceed $17,940.00 to provide
Wastewater technical services relative to the Wastewater Treatment and Disposal ,
Treatment Facilities' 1983 Nut.rification Basin Upgrade. Construction.
Plant
City Treasurer Reynolds provided copies of Articles 413 and 415 of
the Redlands Ordinance Code regarding solicitation for discussion.
j Solicitation Mr. Reynolds explained that Article 41.3 is a general regulation of �.
Ordinances solicitation providing procedures for police registration; Article -.
41.5 pertains to the distribution of advertising materials and limits
peddling and soliciting in the residential areas. Councilman Johnson

explained that there were legitimate retail businesses in town who

to discuss these current ordinances. Citing Section 41502(b) which
states that door-to-door commercial solicitation of unwilling recipients

Ordinances in this City to enjoy the privacy of their homes and serious public
offenses have been committed by purported solicitors, Mayor Roth stated
�'vst+vt{ he supported this ordinance fully. Councilman DeMirjyn echoed the
Mayor's feelings. Mr. Bob Harr, owner of Kirby Vacuum Cleaner, felt
4tvted ,v{{�� that many fine products were sold in the convenience of the home; that
this ordinance was discriminatory; and that if the residents did not
{ldU, Is; want solicitors at their door, they could post their homes.
