Minutes of a regular meeting of the City Council, City of Redlands, hold in the Council Chambers,
21.2 Brookside Avenue, on March 18, 1986, at 3:00 P.M.

The meeting was opened by Mayor Beswick with the pledge of allegiance followed by an
invocation by Councilmember DeMirjyn.
Minutes of the regular meeting of March 4, 1986, were approved as submitted,
Bills and salaries were ordered paid as approved by the Finance Committee.
PLANNING AND COMMUNITY DEVELOPMENT
Residential Development Allocation, Phase I -- 1986
Councilmember Wormser moved to grant 35 allocations to Residential Development Allocation
(RDA) No. 86-1A, Gregory C. D. Rierizo/Medici Investments. Motion secondod by
Councilmember Johnson and carried unanimously. Councilmember Wormser moved to
grant an additional 25 allocations to RDA No. 86-IA. Motion seconded by Councilmember
Larsen and carried unanimously. It was noted the remaining 60 residential development
allocations will be carried over to the fourth cycle.
Historic Ordinance Schedule
Preservation Officer Cozen reported that staff and the City's historic consultants, AEGIS,
have completed questions and answers about the proposed historic and Scenic; Preservation
Ordinance and have provided a copy of their report for Councilmembers' information.
These wall help the public understand the purpose and regulation,,,, in the ordinance
without their having to read the entire ordinance. 'They will be available from the
Community Development Department and will be distributed at community meetings.
Councilmember Larsen moved to approve the proposed schedule as follows for consideration
of the draft historic ordinance:

Subdivision No 12899 John R. Jamison Final A� rovai
All requirements as contained in Council minutes dated May 7, 1985, having been
complied with, it is the recommendation of the Planning Division that final approval
be granted Subdivision No. 12899. On motion of Councilmember Larsen, seconded by
Councilmember DeMirjyn, this recommendation of the Planning Division was unanimoulsy
approved.
REPORTS
Landfill Mr. Hugh Walker, Mandeville and Associates, briefed Council regarding the South
Master Ccast Air Quality Managment Board's criteria set for active and inactive landfills and
Plan the work being done at the City's landfill.
Detention Public: Works Director Donnelly reported to Council that the $10,000 joint study with
Basins the County of San Bernardino regarding detention basins east of Redlands is almost
complete. The report will show that detention basins are feasible but that the cost
is high. The next step will be to conduct an economic study to determine how to fund
and how to acquire property. Mr. Donnelly will report after the report has been
received,
Council recessed at 3:38 P.M. to a Redevelopment Agency meeting and reconvened at
5:05 P.M. to a closed session for the purpose of discussing pending litigation with the
Redlands Unified. School District. In accordance with State law, the City Attorney
prepared a confidential memo to Council providing justification for the closed session.
Council reconvened at 7:25 P.M.
PUBLIC HEARINGS
Variance An appeal to the Planning Commission's decision to deny the request for Variance
No. 340 No. 340 to permit 13 to 18 feet of landscaping adjacent to the freeway rather than the
required 25 feet for property located on the south side of the 1-10 Freeway between
Denied California Street and Bryn Mawr Avenue, was filed in the Office of the City Clerk in
a timely manner in accordance with Zoning Ordinance No. 1000. This being the time
and place: set for public hearing on this matter, Mayor Beswick declared the meeting
open as a public hearing.
Mr. Bev Perry urged Council to grant this variance as this was a hardship parcel and
relief was not available from adjoining parcels. Mr. Donald Edward Reese, representing
the applicant Mohler Corporation, also urged approval of this request for a variance.
There being no further comments, the public hearing was declared closed.
Cauncilmember DeMirjyn moved to allow the variance; motion seconded by Councilmeraber
Johnson and failed by the following vote:
AYES: Councilmembers DeMirjyn, Johnson
NOES: Councilmembers Larsen, Wormser; Mayor Beswick
Councilmember Larsen moved to deny the appeal based on the, following findings:
1.. That such variance is not necessary for the preservation and enjoyment of a
:substantial property right possessed by other properties in the same vicinity and
zone district, but which is denied to the property in question. The landscaping
requirement next to the freeway will not prevent the development of the site for
the proposed use.
2. That the granting of such variance will be detrimental to the public welfare or
injurious to the property or improvements of others in the vicinity. This site is
highly visible from the freeway, and the full landscaping strip Is needed to promote
the intended purpose of the code to screen buildings and provide: aesthetics along
the freeway. The proposed variance would also damage the public welfare by
causing existing healthy citrus trees in the setback area to be (a) hedged in an
unsightly way, (b) transplanted in a way that is speculative at best, and (c)
difficult to maintain because of lack of access.

3. That the granting of such variance will adversely affect the General Plan of the
City of Redlands. All master plan efforts of the CSA 110 Study now in progress
show that this is a very important area for open space preservation.
Motion seconded by Councilmember Wormser and carried by the following vote:
AYES: Councilmembers Larsen, Wormser; Mayor Beswick

Demolition Public hearing was advertised for this time and place to consider the Historic and Scenic
Permit Preservation Commission's recommendation to approve a delay of 70 working days for
Delay a building demolition permit for the structure located at 244 Terracina Boulevard in
accordance with Ordinance No. 1828. Preservation Officer Cozen reported that the
applicant has indicated he has no problem with this delay. Mayor Beswick declared
the meeting open as a public hearing for any questions or comments regarding this
matter. None being forthcoming, the public hearing was declared closed. Councilmember
Johnson moved to approve the findings of the Historic and Scenic Preservation Commission
regarding the structure located at 244 Terracina Boulevard as contained in minutes
of their meetings of February 6 and February 20, 1986, and to delay issuance of a
demolition permit for 70 working days. Motion seconded by Councilmember DeMirjyn
and carried unanimously.
Ordinance Public hearing was advertised for this time and place; for Ordinance No. 1019, an
No. 1919 ordinance of the City of Redlands adding Article 925 to Chapter 92 of Division 9 of the
City of Redlands Ordinance Code relating to vesting tentative maps. Mayor Beswick
Vesting } declared the meeting open as a public hearing for any questions or comments concerning
Tentative this ordinance. No comments were forthcoming. Councilmember Johnson moved to continue
Maps this public hearing to April 1, 1986, at 7:00 P.M. at the request of the City Attorney.
Motion seconded by Councilmember DeMirjyn and carried unanimously.
Conditional. At its February 25, 1986, meeting, the Planning Commission recommended approval.
Use Permit of Conditional Use Permit No. 453 for a church and related activities on approximately
No. 453; 8.5 acres of land located on the northwest corner of Fifth Avenue and Wabash Avenue,
A-1 Zone (Church of Jesus Christ of Latter-Day Saints). A petition was received in
the Office of the City Clerk on March 4, 1986, requesting this application be held over
for a public hearing, and Council set this time and place for that purpose. Notices
of this public hearing were mailed to 77 residences (including applicant and signers
of the petition); eight were returned by the Post Office. Community Planner Atencio
presented plans and cross-sections showing how fencing, setbacks and block walls will
provide a buffer. Mayor Beswick declared the meeting aper as a public hcarui
Speaking in favor of Conditional Use Permit No. 453 on behalf of the large number
of church members present and expressing their desire to work in good faith with t:he
neighbors were: Dean Green, Bob West who introduced young members of the church
present, Frances Mower who presented a list of church members who live near the
proposed facility which is on file in the Office of the City Clerk, Virginia Boyd,
Lawrence Lee, and Boyd Bauer. Gary Miller was present representing the architect
for the project.
Mr. Ken Jolly expressed his concerns about more drainage onto his property and was
referred to Building and Safetv Director Dale for assistance with his existing problems.
Speaking on behalf of the neighbors Petitioning for additional conditions which they
felt were necessary to preserve, in part, the existing neighborhood, was Karen
Bergman. 'Their comments were presented in written form prior to the meeting and
are on file in the Office of the City Clerk. Harry Smith, representing 'Lifetime Homes,
a neighboring development, expressed his concerns. Opposed to the; whole; project
was Mrs. William Lane.
There being no further comments, the public hearing was declared closed at 8:50 P.M.
Following discussion, Councilmember Johnson moved to approve the Environmental
Review Committee's Negative Declaration for Conditional Use Permit No. 453 and
directed staff to file and post a "Notice of Determination" in accordance with the City's
guidelines. Motion seconded by Councilmember DeMirjyn and carried unanimously.
Councilmember Larsen moved to approve Conditional Use Permit No. 453 based on the
findings of the Planning Commission and subject to the recommendations of all departments
as contained in the Planning Commission minutes dated February 25, 1986, and to include
revisions as follows:

licensed landscape architect, approved by the Planning Commission., cleared

Additional Planning and Community Development requirements as follows:

Council briefly recessed at 9:05 Y.M. and reconvened at 9:12 P.M.
ORAL. PETITIONS FROM THE FLOOR
FOOD FOR ALL Mr. Richard Blakely reported about the FOOD FOR ALL program, a non-profit public
benefit corporation, which is planning to solicit funds in Redlands through local
grocery stares. He explained the unique procedure and asked Council for a resolution
of support. Councilmember Johnson moved to give FOOD FOR ALL full faith and support
from this City Council. Motion seconded by Councilmember Larsen and carried
unanimously.
BIDS
Bid Award The following bids were opened and publicly declared at 10:00 A.M. on March 17, 1986,
in the Office of the City Clerk for the drilling of two airport. wells:

At this time, it is the recommendation of the Department of Public Works that award
be made to Beylik Drilling, Inc. as theirs was the lowest, responsible bid. On motion
of Councilmember Larsen, seconded by Councilmember DeMirjyn, unanimous Council
approval was given to the award of the drilling of two airport wells to Beylik Drilling,
Inc. of La Habra.
Rid Award Public Works Director Donnelly reported that informal bids were solicited from two local
electrical contractors for electrical work at the Citrus Avenue parking structure as
Parking follows:

At this time, the Department of Public Works recommended award be made to TBM
El(-,ftric of Redlands, the lowest qualified bidder. On motion of Councilmember
Larsen, seconded by Councilmember DeMirjyn, Council unanimously authorized the
appropriation of the necessary monies from the Parking District Fund and awarded the
contract for the electrical work at the Citrus Avenue parking structure to TBM Electric
of Redlands in the amount of $15,450.00.
COMMUNICATIONS
Mayor Beswick announced the Simmonds Parkway was dedicated earlier today and
thanked everyone for their participation.
Councilmember Johnson announced that SCAG's annual meeting will be held on April 4,
1986, in Ontario. He briefly reported on this meeting last week in Washington, D.C.
Agreement Public Works Director Donnelly reported on the South Coast Air Quality Management
District's requirements regarding equipment emissions and what the City is doing to
Pacific: Waste comply with these requirements. The Public Works Commission reviewed an agreement
Management between Pacific Waste Management and the City and highly recommended its approval.
Having attended that meeting, Councilmember DeMirjyn also urged its approval and
moved to approve the agreement in concept with details to follow, Motion seconded
by Councilmomber Wormser and carried unanimously.
Dial-A-Bet Councilmember Johnson moved to direct letters to our State representatives indiating
Council's opposition to AB 2666 regarding Dial-A-Bet. Motion seconded by Councilmember
Larsen and carried unanimously. Councilmember Johnson also directed attention to
the article in The Sun, dated March 1.7, 1986, regarding Gamblers Anonymous.

Councilmember DeMirjyn reported ire will be attending a meeting March 26-28, 1986,
in Asilomar regarding airport noise and will make a report when he returns.
Mayor Beswick reminded everyone that our Annual Bicycle; Classic will be held overi"f
the Memorial Day weekend.

Ordinance Ordinance No. 1907, an ordinance amending Ordinance No. 1000 of the City of Redlands
No. 1907 by adopting an additional land use district map as part of the Official Land Use Zoning
Map and effecting Zone Change No. 297, a change of zone from A-1 (Agricultural)
Zone Change District to R-1 (Single Family Residential) District for approximately 20 acres of
No. 297property located on the south side of San Bernardino Avenue, 330 feet east of Texas
Street, was given its second reading of the title by City Clerk Poyzer, and on motion
of Councilmember Johnson, seconded by Councilmember Larsen, further reading of
the ordinance text was unanimously waived. Ordinance No. 1907 was adopted on motion
of Councilmember Larsen, seconded by Councilmember Wormser, by the following vote:

Ordinance Ordinance No. 1908, an ordinance amending Ordinance No. 1000 of the City of Redlands
No. 1908 by adopting Amendment No. 180 relating to the new zone classification R-R (Rural
Residential) District, was given its second reading of the title by City Clerk Poyzer,
Rural- and on motion of Councilmember DeMirjyn, seconded by Councilmember Larsen, further

Resolution City Attorney Ariel Calonne presented a lengthy staff report regarding the March 4,
No. 415`7 1986, public hearing for reexamination of Resolution No. 4130, Mitigation of School
Impaction (on file in the Office of the City Clerk), and a draft resolution. He reviewed
School in detail the information contained in the staff report, options available for Council
Impaction consideration, each of the findings contained in the draft resolution, and answered
Mitigation questions from Councilmembers. It was noted that a letter was received just: prior to
the meeting from Deane Properties dated March 17, 1986, regarding the impaction fees
and is also on file in the Office of the City Clerk.
Following discussion, Councilmember Larsen moved to adopt Resolution No. 4157, a
resolution of the City of Redlands requiring mitigation of school impaction caused by
residential development, and directed the City Attorney to .return this resolution to
Council for confirmation with the following to be included therein:
SECTION SIX - Establish fees as follows: for multi-family units $2.20 per square
foot of living space with a minimum of $1,600 per unit; for single family $2.20
per square foot of living space with a minimum of $2,400 and a maximum of
$3,960 per dwelling unit.
SECTION NINE, Paragraph 14 - Note that Council feels that the fee established
is justified as necessary to build school facilities of the same architectural value
as now exists.
SECTION NINE, Paragraph 15 - Add an indemnification clause such as is included
in Resolution No. 4130 regarding„ legal fees.
Motion seconded by Councilmember Wormser and carried by the following vote:

12 as he felt it would be easier to administer.

homes, was given its second reading of the title by City Clerk Poyzer, and on motion

Capital project), was read by title only by City Clerk Poyzer, and on motion of Councilmember

Wrecked Johnson, further reading of the ordinance text was unanimously waived. Ordinance
Vehicles No. 1927 was introduced with unanimous Council approval and laid over under the rules

of Michael Dudek in the amount of $2,732.99 was found not to be a proper charge against
the City and therefore rejected by unanimous vote of the Council.
Redevelopment Councilmember Larsen moved that Council. acknowledge receipt and file the Redevelopment
Agency Agency of the City of Redlands Annual Report of Financial 'Transactions of Community
Annual Redevelopment Agency for fiscal year ended September 30, 1985, as required by Section
Report 33080,1 of the California Health and Safety Code with the State Controller. Motion
seconded by Councilmember DeMirjyn and carried unanimously.

Cemetery Community Services Administrator Rodriguez reported that Tract Map No. 1287.1,
Purchase currently under development by Dr. Clifford, shares its boundary lines with the
Hillside Memorial Park. In order to eliminate a problem with existing grave; markers,
the City and Dr. Clifford have negotiated the sale of Lot No. 8. Reynolds Appraisal 5
Services appraised the property and concurred with the historical data obtained by
staff and the current asking price of Lot No. 8. Councilmember Larsen moved to
authorize the Community Services Administrator to acquire a portion of Lot No. 8 of
Tract Map No. 12811 for Hillside Memorial Park in the amount of $7,875.00. Motion
seconded by Councilmember DeMirjyn and carried unanimously.
License Councilmember Larsen moved to authorize the Mayor and City Clerk to execute a
Agreement Revocable License Agreement with California State University, San Bernardino, in
order to allow the leasing of a 15 foot by 25 foot area northeast of the City's Grafton
Cal State Hills Reservoir for location of microwave repeater equipment. Motion seconded by
Councilmember DeMirjyn and carried unanimously.
Resolution Resolution No. 4154, a resolution of the City Council of the City of Bedlands establishing
No. 4154 speed zones for Lugonia Avenue, as recommended by the Traffic Commission at their
February 20, 1986, meeting, was unanimously adopted on motion of Councilmernber
Speed Zones Larsen, seconded by Councilmember DeMirjyn.
Resolution Resolution No. 4155, a resolution of the City Council of the City of Redlands establishing
No. 4155 speed zones for San Bernardino Avenue as recommended by the Traffic Commission
at their February 20, 1986, meeting, was unanimously adopted on motion of Councilmember
Speed Zones Larsen, seconded by Councilmember DeMirjyn.
Resolution Resolution No. 4156, a resolution of the City Council of the City of Redlands establishing
No. 4156 speed zones for Olive Avenue as recommended by the Traffic Commission at their
February 20, 1986, meeting, was unanimously adopted on motion of Councilmember
Speed Zones Larsen, seconded by Councilmember DeMirjyn.
The; requests for additional appropriations to fund the employment of a professional
planner for the Community Development Department and a plan check engineer and
vehicle for the Building and Safety Division were held over for two weeks on motion
of Councilmember DeMirjyn, seconded by Councilmember Larsen.
There being no further business, the meeting was adjourned at 10:40 P.M. to an
adjourned regular meeting to be held on Friday, March 21, 1986, at 3:30 P.M. in the
Lyon Gallery in the A. K. Smiley Public Library, 125 West Vine Street.
