I{ Smiley Public Library Expansion Project. At the Council meet ng held ran ?},r ,ij Project November 1., 1988, staff recommended that the low bid received from GRACO Construction be rejected on the basis that their bid was non-responsive and that. GRACO way not a ta: responsible bidder. In accordance with.State law, the public hearing was Scheduled p to allow the bidder to respond to these determinations. At this time, City Engineer Mutter explained that their investigation determined that GRACO had not been a tra t contractor for at least five years with historical buiIdtng experience which was required in the bid specifications. A background cheek also revealed that the bidder 3 f was not responsible and this information was provided in wrritten report form to CRACO ; Construction and Councilmembers in advance of this meeting. Mayor Beswick declared the meeting open as a public hearing. John Gray, Vice President of C RAC'O, .addressed "MR: Council advising them his company would not protest awarding this contract; to the j. next lowest bidder because his firm was less than five years old. He briefly explained tj some of the problems his firm is experiencing stating he felt they were qualified except C that they were less than five years old. Because of this, he stated they would not t j•, contest this matter. There bele; no further comments, the public hearing was declared rj closed. til t a Bid Rejection Councilmember Johnson moved to reject ec.t the GRACO Construction bid for the A. K. Smiley> �k'a^ I�ublic Library Expansion Project as it was non-responsive. Motion seconded by t ,; Ism Councilmember Wormser and carried by AYE votes of all present. „x a,t i Bid Award Councilmember Johnson moved to award the contract for the expansion of the A. K. Smiley t Public Library to Donald, McKee and Hari., Inc, in the amount of $3,529,020.00. Motion seconded by Councilmember Worreser and carried by AYE votes of all present, a City Engineer Mutter thanked Dr. Henry Dittmar and the expansion committee for all int. r,a their efforts on this project. t% ORAL PETITION FROM THE FLOOR t�� �` ff —..__ ATra-X tv On be of two homeowners' associations representing approximately 150 reslclen[s, :. �j gg c:gate Helen Farnum addressed. Council about the application for Tri City Aggregate and rtr: i its impact on the City. Mayor Beswick advised Mrs. Farnum the City has submitted all Wi=t i Zt a•"ies zl�ii i 01'7 �c Or ��'�,t f. iIS letters to the County expressing our concerns, that the City of Redlands is represented at the County meetings, and noted the City of Highland is vigorously opposing our desires. Councilmember Cunningham felt the City needed to vigorously resist these ;, moves and that it was most desirable to have more City Council representation at these �t�J 'F meetings. Council asked staff to provide them copies of the correspondence from the c City and also receive copies of what the City of Highland has submitted. Mayor Beswick and Councilmember Cunningham will attend the meeting on Tuesday, November 15, 1988, along with staff members. ;' Council recessed at 2:18 P.M. to a closed session for the purpose of discussing, pending litigation. In acrordance with State law, the City Attorney prepared a confidential memo to Council providing justification for the closed session. Following the closed session, Council adjourned to an adjourned regular meeting to be held on Tuesday, November 15, 1988, at 1:00 P,M. in the Council Chambers.
