PRESENT Swen Larson, Mayor Jim Foster, Mayor Pro Tem William E. Cunningham, Councilmember Gilberto Gil, Councilmember Pat Gilbreath, Councilmember Gary Luebbers, City Manager Daniel J. McHugh, City Attorney Jeffrey L. Shaw, Community Development Director Lorrie Poyzer, City Clerk Ted Thomaidis, Redlands Daily Facts ABSENT None General Plan - Community Development Director Shaw reported the General Plan Committee completed its preparation of the Draft General Plan and its recommendations in March, 1992. Study sessions with the Planning Commission and City Council continued for over a year considering the various policy issues. A revised draft incorporating the various land use and policy changes was published in September, 1993. The Environmental Review Committee reviewed and considered the Master Environmental Assessment and Environmental Impact Report on February 28, 1994. The Planning Commission has held a number of study sessions and one public hearing on the documents and has scheduled another hearing for April 26, 1994. Staff anticipates receiving comments back from the State Department of Housing and Community Development relative to the Housing Element by the end of April. Necessary revisions will be incorporated, such as incorporating 1990 census data, into the Housing Element and the Planning Commission will consider the General Plan and Housing Element at a public hearing to be held on May 24, 1994. City Council hearings are anticipated to start in June. Mr. Shaw said some of the key issues that staff anticipates will be of concern and discussed during the hearings will be (1) the Noise Element and the proposed Community Noise Equivalent Levels (CNEL); (2) Section 4.91 of the Land Use Element pertaining to the Redlands Unified School District and funding for school development in the future; (3) the Housing Element; and (4) non-conforming properties that are the result of adoption of the Land Use April 5, 1994 Page 1 Element. Mr. Shaw suggested the City Council's direction and action on these matters should wait until the Planning Commission completes its public hearings and makes a recommendation to the City Council. Given the importance of these issues, he felt it was appropriate to begin some initial workshops to familiarize the City Council and determine if additional information is needed. He then reviewed each concern. Pat Meyer and Bob Roberts expressed concerns about establishing the lower Community Noise Equivalent Levels. Mr. Shaw indicated he would contact the City of Riverside to see how they implement their lower noise level requirements. CLOSED SESSION City Attorney McHugh reported he had received a letter from Stephen Selinger on Monday, April 4, 1994, and spoke with Mr. Selinger's attorney late in the afternoon regarding the status of the project proceedings and possible courses of action for the public hearing. In his opinion, this information could possibly affect the Council's past directions to the City Attorney regarding the City's legal position. Therefore, he recommended the City Council meet in closed session to discuss pending litigation regarding the Selinger Project pursuant to Section 54956.9(b)(1)(B) of the California Government Code. Noting that the need to take action was immediate, Councilmember Cunningham moved to add this item to the agenda which arose subsequent to the agenda being posted. Motion seconded by Councilmember Foster and carried unanimously. ADJOURNMENT The study session recessed at 10:00 A.M. to the closed session.
