PRESENT Swen Larson, Mayor Pat Gilbreath, Mayor Pro Tem William E. Cunningham, Councilmember Gilberto Gil, Councilmember Geni A. S. Banda, Councilmember Gary M. Luebbers, City Manager Daniel J. McHugh, City Attorney Lorrie Poyzer, City Clerk Marjie Pettus, Administrative Services Director Jeffrey L. Shaw, Community Development Director Steven M. Chapman, Finance Director John Habant, Fire Division Chief Gary G. Phelps, Municipal Utilities Director Michael L. Huffstutler, Assistant Utilities Director Lewis W. Nelson, Police Chief Ronald C. Mutter, Public Works Director John Andrews, Redlands Daily Facts Sulipsa Luque, The Sun ABSENT None Citrus Plaza Regional Mall - Development Impact Fees - City Manager Luebbers reported to the City Council that the development agreement negotiations with representatives of Majestic Realty for the Citrus Plaza Regional Mall have been going well except for the discussions regarding development impact fees. The temporary reduction of these fees approved by the City Council in September 1994 will expire prior to issuance of their building permits and the applicant wants the reduced rates extended for their project. Public Works Director Mutter, Municipal Utilities Director Phelps, and Assistant Utilities Director Huffstutler reviewed the fiscal impacts of the development impact fees at the full rates and the reduced rates. David Wheeler, Vice President/Partner of Majestic Realty, requested a two week continuance so that they could analyze the information presented at this meeting. He pledged that their project would be annexed to the City before "one single cent of sales tax" was received; that they will develop the project with the highest standards in the industry; and that they will pay their fair Adjourned regular meeting January 16, 1996 Page 1 share of any development fees and not ask anyone to subsidize their project. Harry Newman, Newman Properties, indicated he would address the City Council at the continuance. A resident, Gary Negin, urged the City Council to require Majestic to pay their full share and annex to the City. On behalf of The Redlands Association, Tex Moore pointed out this property is within the boundaries of the NDA and that a portion of the tax receipts will go to the IVDA. Councilmember Gil moved to continue this discussion to February 6, 1996, at 9:00 A.M. Motion seconded by Councilmember Gilbreath and carried with Councilmembers Cunningham and Banda voting NO The City Council meeting briefly recessed at 9:58 A.M. and reconvened at 10:02 A.M. to hold a joint meeting with the Board of Directors of the Redevelopment Agency. Certificates of Participation Refunding - Finance Director Chapman reported he has been actively involved with Miller & Schroeder Financial since October, 1995,. when the bond market's long-term fixed rates began moving downward, in pursuing a bond refunding strategy. A Comprehensive Financing Plan dated November 15, 1995, has been distributed to Councilmembers and provided an analysis of present value and cash flow savings for each variable rated bond issues. Mr. Chapman reviewed the advantages and disadvantages of refunding the bonds and recommended use of the fixed rate. Councilmembers discussed whether or not to continue using Miller & Schroeder Financial as the City's financial advisor and underwriter. Councilmember Gilbreath moved to approve Miller & Shroeder Financial, Inc. as the financial advisor and underwriter for the City's Water and Sewer Certificates of Participation. Motion seconded by Councilmember Larson and following discussion, the motion failed by the following vote: AYES: Councilmember Gilbreath NOES: Councilmembers Cunningham, Gil, Banda; Mayor Larson Staff will solicit bond refunding proposals from at least two other public finance firms and report back to the City Council. ADJOURNMENT There being no further business, the City Council meeting adjourned at 10:50 A.M. The next regular meeting will be held on January 16, 1996, at 3:00 P.M.
