CLOSED SESSION REPORT: May 5,2015 Page 1 City Attorney McHugh announced that the personnel item on the closed agenda was continued to the May 19, 2015 regular City Council meeting and no reportable action was taken by the City Council during the closed session. PRESENTATIONS: Redlands Animal Shelter — Animal Control Officer Bill Miller, introduced "Tanner", a five month old, male Chihuahua, who is available for adoption along with twenty-four other dogs and forty-nine cats at the Redlands Animal Shelter. Officer Miller informed the Council thirty-five dogs and nine cats have been adopted since the last City Council meeting. Youth Football Champions — Mayor Foster presented a certificate of commendation and congratulated the Redlands Pride Freshman Football Team; consisting of Athletic Directors Monique Palafox and Vanessa Aguilera, Head Coach Michael Counce, Assistant Coaches Marcelo Coba, Patrick Palafox, and Miguel Coba, and players Synere Alberti, Andrew Arriola, Cash Alvino, Hohnny Botello, Cirus Carrillo, Joshua Coba, Michael Counce, Manuel Garcia, Jerry Gonzalez, Garrett Guzman, Jordan Headley, Jericho Lockhart, Cody Lopez, Isaiah Manzanares, Ramon Ontiberos, Patrick Palafox, Rhyder Pagdillao, Corie Rivera, Michael Sandoval, Justin Santos, and Jacob Soto; for their perfect overall season record of 12-0 and becoming the 2014 Southern California East Youth Football League Super Bowl Champions. The team received further recognition from the offices of State Senator Mike Morrell and Assemblyman Marc Steinorth. PUBLIC COMMENT: Redlands Hunger Walk — Donna Ferracone invited each Councilmember to participate in the Redlands Hunger Walk event at the University of Redlands on Saturday, June 6, 2015, at 8:00 A.M., a fundraiser in support of efforts to replenish the food pantry at Family Service Association of Redlands. Neighborhood Action — John Montgomery and Mario Saucedo thanked the Redlands Police Department and Code Enforcement for their efforts to clean up derelict conditions at the 300 block of Colton Avenue. He said this should be an example for others to follow when trying to improve living conditions in local neighborhoods. Mr. Saucedo said trends toward better neighborhood lighting and other improvements are very encouraging. Addressing _DroughtDrought — Kathy Havert endorsed the use of grey water for irrigation during conditions of drought and approval through ordinances to legalize such practice. Airport Concerns — Isaac Tate requested more oversight of preparations for the AirFest 2015 event which is scheduled to be held on May 16, 2015 at the Redlands Municipal Airport. May 5,2015 Page 2 Flag Proposal — Ray Miller expressed his opposition to an initiative petition proposing the display of the California state flag higher and in a position of honor above the United States flag whenever both banners are displayed together. Interstate Toll Lanes — Greg Brittain expressed his opposition to a proposal to install toll lanes on Interstate Highways 10 and 15. He described regional governing bodies such as San Bernardino Associated Governments (SANBAG) and South California Associated Governments (SCAG) as threats to the civil rights of area residents. Stack and Pack Housing—Carolyn Hays expressed her opposition to any proposal to build multi-storied structures for the purpose of promoting higher density housing in the downtown Redlands area. Electricity Production — Nancy Blastos pointed out the pollution and water consumption data associated with the Mountain View Power Plant and called for a conversion to a cleaner, more sustainable form of power production. Performance Measures — Steve Rogers suggested the use of the City of Redlands Strategic Plan as a report card when measuring the performance of the City Manager. CONSENT CALENDAR: Minutes — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the minutes of the regular meeting of April 21, 2015 and the special meeting of April 28, 2015 as submitted. Proclamation — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved a proclamation congratulating the Community Action Partnership of San Bernardino County on the occasion of its 50th anniversary. Commission Appointment — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the appointment of Kurt Heidelberg and Alison Roedl to serve the remainder of unexpired terms on the Historic and Scenic Preservation Commission ending January 18, 2019. Commission Appointment — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the appointment of Earl R. Johnson to serve a term, and the reappointment of Roy Cencirulo, Don Gifford, Tina Sray Price and Cathyleen Nece to serve second terms, on the Parks and Recreation Advisory Commission, all these terms ending March 1, 2019. Settlement Agreement - On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the public disclosure of details of a settlement and release agreement between the City of May 5,2015 Page 3 Redlands and Ellen Eastwood. Under the terms of the agreement, the City will pay the sum of$2,500.00 to Ellen Eastwood and each party releases, remises and forever discharges each other party from any and all claims, demands and cause or causes of action associated with a lawsuit filed in the San Bernardino County Superior Court as Case No. CIVDS 1402813. Gymnasium Use — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved a facility use agreement between the City of Redlands and the Boys and Girls Club of Redlands for use of the gymnasium at the Community Center. Landscape Services — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved an agreement between the City of Redlands and TLC Landscape Services, Inc., in the amount of $30,260.00, for landscape services for Community Facilities District 2004-1. Bid Rejection — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the rejection of all bids received for the Gateway Project, Project No. 41055. Resolution No. 7514 — Traffic Re ulg ation — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolution No. 7514 establishing a no parking zone in front of 1721 East Colton Avenue. Resolution No. 7513 — Traffic Re ulg ation — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolution No. 7513 to install two additional stop signs to achieve a three-way stop at the intersection of Center Street and Ridge Street. Resolutions No. 7511 and 7512 — Engineering Appointments - On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolutions No. 7511 and 7512 appointing an assessment engineer and directing the preparation of the engineer's reports for Landscape Maintenance District No. 1 and Street Lighting District No. 1. Grant Application — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously authorized the application for a Department of Homeland Security, Riverside Urban Area Security Initiative Regional Grant for 2015. COMMUNICATIONS: Meetings Cancellation — Consistent with prior years' practice, Mayor Foster proposed the cancellation of the regular City Council and Successor Agency Board of Directors meetings in August. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the cancellation of the August 4 and August 18, 2015 regular City Council and Successor Agency Board of Directors meetings. May 5,2015 Page 4 Passenger Rail Update — Mitch Alderman, Director of Transit & Rail Programs, San Bernardino Associated Governments, presented an update regarding the Redlands Passenger Rail Project. He described a timetable for the Project which includes final design beginning in September 2015, construction beginning in 2017 and operation by 2019. As public comment, four individuals spoke critically about the Project citing the great expense, the question of utility due to low ridership, and negative impacts in the form of noise and obstruction to travel within the downtown Redlands business area. Water Conservation Update — Cecilia Griego, of the Municipal Utilities and Engineering Department, presented a four phased program to address water supply conditions caused by ongoing drought. The City intends to meet its required reduction of 36%, based on the 2014 summer residential gallons per capita per day use, with the four phased program. Each phase includes items that educate and enforce water use restrictions, each building upon the previous phase's elements. Staff has begun phases 1 and 2 and is moving to phase 3, due to the State restrictions. If the necessary reductions are not observed, staff will be moving to the next phase until the required reduction is met. As a public comment, Steve Rogers questioned the adequacy of planning for a non-potable water distribution system. NEW BUSINESS: General Plan Update — Troy Clark, General Plan Project Administrator, presented the proposed approach and funding necessary to accomplish the update of the City of Redlands General Plan. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved an amendment to an agreement between the City of Redlands and Dyett & Bhatia for the preparation of the comprehensive update to the City's General Plan, and the release and appropriation of $210,000.00, the general funds reserved for the update. As a public comment, Steve Rogers expressed concerns about the scope of work of the agreement. Orange Blossom Trail — Ross Wittman, of the Municipal Utilities and Engineering Interim Department, provided an overview of Phase III of the Orange Blossom Trail. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council approved an agreement between the City of Redlands and RBF Consulting, in the amount of $98,000.00, to perform professional engineering services for the design of the Orange Blossom Trail Phase III. Playground Equipment — Quality of Life Director Fred Cardenas presented a proposal to purchase and install playground equipment in various City parks. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the award of a contract between the City of Redlands and R.E. Schultz, in the amount of $83,620.00, for parks and playgrounds equipment and wood fiber surfacing fill top. May 5,2015 Page 5 PUBLIC HEARINGS: Resolution No. 7508 — Tax-Exempt Bond Financing — Mayor Foster opened the hearing and called upon Finance Director Tina Kundig for background on the issuance of bonds to benefit American Baptist Homes of the West. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolution No. 7508 approving the issuance of bonds in an aggregate principal amount not-to-exceed $70,000,000.00 by the California Statewide Communities Development Authority to benefit American Baptist Homes of the West and certain affiliates. Ordinance No. 2816 — Building Code Update — Mayor Foster opened the hearing and called upon Development Services Director Oscar Orci for a review of the requirement to update the City of Redlands Building Code. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the introduction of Ordinance No. 2816 rescinding Chapters 15.04, 15.08, 15.12 and 15.16 of the Redlands Municipal Code; and adding Chapters 15.04, 15.06, 15.08, 15.10, 15.12, 15.16, 15.18 and 15.22 to the Redlands Municipal Code relating to the adoption of the 2013 California Building Code, 2013 California Plumbing Code, 2013 California Electrical Code, 2013 California Mechanical Code, 2013 California Residential Code, 2013 California Energy Code, 2013 California Historical Building Code and 2013 California Green Building Standards Code, amending Chapter 15.24 of the Redlands Municipal Code relating to the Uniform Housing Code, and rescinding Chapter 15.52 of the Redlands Municipal Code relating to the Uniform Building Code for Building Conservation. Resolutions No. 7496, 7497, 7498, 7499, and 7509 and Ordinance No. 2815 — Newland Homes Project — Mayor Foster opened the hearing and called upon Development Services Director Oscar Orci for an overview of a Planned Residential Development consisting of eighty-two single family residential lots and seven lettered lots on approximately 30.51 acres located on the north side of Pioneer Avenue, east of Texas Street, in the A-1 (Agricultural) District. As public comment, Steve Rogers said this action should be considered in the process of the General Plan update. Bill Cunningham expressed concern about adding 82 more households to consume more water during times of drought, but he encouraged planners to continue to require non-potable water plumbing in all new developments. At the request of staff, and on motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously agreed to continue until the June 16, 2015 regular City Council Meeting, public hearing to consider the adoption of a Mitigated Negative Declaration, General Plan Amendment No. 133 and the Newland Homes Project (Resolution Nos. 7496, 7497, 7498, 7499, 7509 and Ordinance No. 2815) to allow additional time to address agency comments on the proposed environmental document. COUNCILMEMBER ANNOUNCEMENTS AND ACTIVITIES: May 5,2015 Page 6 Healthy Redlands — Councilmember Gilbreath attended a Healthy Cities Conference at Loma Linda. She announced two Health Fair events scheduled in the near future: at the Community Center on May 14, 2015 and at the Joslyn Center on May 15, 2015, both from 8:00 A.M. to 11:00 A.M. Vintage Redlands — A successful and enjoyable evening was had by all in the downtown business area on Friday, May 1, 2015. Senior Coffee — Councilmembers Gilbreath and James had an interesting exchange of ideas at the senior session of Coffee with the Council held on Wednesday, April 22, 2015, at Casa de la Vista. Community Work Day — Another successful gathering of volunteers made significant improvements to Heritage Park, Community Field and the Hillside Memorial Cemetery on Saturday, April 25, 2015. Radio Broadcast — Mayor Pro Tem Harrison participated in a radio broadcast sponsored by San Bernardino Associated Governments (SANBAG) for the purpose of informing the public on the subject of the Redlands Passenger Rail Project. Electricity Forum — Mayor Pro Tem Harrison participated in a forum sponsored by Southern California Edison to allow local government leaders the opportunity to voice service concerns and issues to insure the electric company is providing the best possible support to local communities. Arbor Day — Mayor Foster and Councilmember James helped the Street Tree Committee with a tree planting ceremony in celebration of Arbor Day. Big Hearts for Little Hearts — Councilmember James participated in the inaugural Family Fitness Fun 5k Run/Walk and Expo sponsored by the Big Hearts for Little Hearts Loma Linda Guild on May 3, 2015 at the Burrage Mansion. Volunteer of the Year — Mayor Foster awarded the first Volunteer of the Year recognition from the Family Service Association of Redlands to Ann McMahon at a gathering on April 17, 2015. Church Anniversary — Mayor Foster attended and congratulated Redlands Apostolic Church for its 65th Anniversary celebration on April 25, 2015.
