PUBLIC COMMENT: Fight Water Board Action — Eric Fraser offered several points of argument to be used to appeal any punitive action implied by the State Water Resources Control Board with regards to the City of Redlands failure to meet water conservation goals. State Water Resources Control Board letter possibly imposing civil fines The meeting reconvened at 6:04 P.M. with an invocation by Councilmember James followed by the pledge of allegiance to the American flag. CLOSED SESSION REPORT: City Attorney McHugh announced that, by unanimous vote, the City Council approved initiating a proceeding before the California Water Resources Control Board. PRESENTATIONS: Redlands Animal Shelter — Animal Control Volunteer Sentil Chinnachamy introduced "Cherry". She is a five year old Chihuahua mix already spayed and ready to go home right away. She has been in the shelter since September 18th, when she arrived with two cherry eyes. She is super sweet and can see very well now, after having her eyes worked on thanks to the Friends of the Redlands Animal Shelter, and has a microchip thanks to the Redlands Elks Lodge. Mr. Chinnachamy announced that thirteen dogs and fifteen cats were adopted since the last City Council meeting and the current population at the shelter is forty- four dogs and seventy-five cats. PUBLIC COMMENTS: General Plan Proceedings Critique — Carolyn Hays, Greg Brittain and Sam Wong offered suggestions to improve the public concerns representation at meetings of the Steering Committee for the City of Redlands General Plan Update. November 3,2015 Page 2 Olio — Mario Saucedo offered remarks on three subjects. He thanked Troy Clark for the General Plan Update session at the Redlands Community Center and suggested more administrative support would have provided better capture of residents' inputs during the session. He thanked staff and the Police Department for the rapid response to safety concerns expressed at the last City Council meeting and suggested an equal effort is needed in other neighborhoods within the city. He repeated his requests for repair of street lights on Orange Street between Colton and Lugonia Avenues and for functional software on the computers in the Redlands Community Center. Hearing Request— Steve Willer, of the Redlands Airport Association, requested a public hearing after the consultants, hired by the city to examine the land use issues at the Redlands Municipal Airport, have finished their work. Water Efficiency Consulting — Sean McFarland, of Water Management Group, offered the use of his organization's patented technology assistance to help Redlands meet water efficiency standards goals. CONSENT CALENDAR: Minutes — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the minutes of the regular meeting of October 20, 2015. Settlement Agreement— This item was pulled from consideration on this meeting agenda to be addressed at a later date. Ordinance No. 2825 — Camping and Storage on Public PropertX — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the adoption of Ordinance No. 2825 adding Chapter 12.46 to the Redlands Municipal Code (RMC), and amending Chapters 12.44 of the RMC, relating to unlawful camping and storage of personal property in public places. Ordinance No. 2826 — Obstruction of Sidewalks — As public comments Andy Hoder took issues with the geographic area defined in the proposed ordinance. He said the boundaries of the area are incongruous and do not include significant business areas within the City. Greg Brittain cautioned the City Council to insure this ordinance does not infringe on constitutional rights. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the adoption of Ordinance No. 2826 adding Chapter 12.47 to the Redlands Municipal Code (RMC) relating to sitting or lying down on sidewalks in the City's downtown commercial area, and amending Chapters 12.44 of the RMC, relating to prohibited conduct in public parks. November 3,2015 Page 3 Resolution No. 7583 — Traffic Re ulg ation — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolution No. 7583 approving the engineering and traffic surveys report and determining that the project is exempt from review in accordance with Section 15061 of the California Environmental Quality Act guidelines. Resolution No. 7584 — Traffic Re ulg ation — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolution No. 7584 establishing a loading and unloading zone at 22 East Vine Street, and determining that the project is exempt from review in accordance with Section 15061 of the California Environmental Quality Act guidelines. Resolution No. 7585 — Traffic Re ulg ation — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolution No. 7585 establishing time limit parking restrictions at 1 East Olive Avenue, and determining that the project is exempt from review in accordance with Section 15061 of the California Environmental Quality Act guidelines. Resolution No. 7586 — Traffic Re ulg ation — On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolution No. 7586 establishing reserved parking spaces for Redlands Meals on Wheels at the Joslyn Senior Center, and determining that the project is exempt from review in accordance with Section 15061 of the California Environmental Quality Act guidelines. COMMUNICATIONS: Redlands Passenger Rail — Carrie Schindler and Justin Fornelli, of San Bernardino Associated Governments (SANBAG), provided an update on progress on the project to provide passenger rail transportation between the City of Redlands and the City of San Bernardino. Prior to the presentation, five speakers offered reasons for support for and opposition against the project. Bill Miller and Mario Saucedo had questions specific to the types of equipment to use and how the Santa Fe Terminal will be utilized. Significant Development Project — Pat Meyer, representing Rossmoor Enterprises, presented an overview of a proposed significant development involving a repeal of Specific Plan No. 32, Zone Change No. 452 to rezone 41.09 acres to M-1 (Light Industrial) District, Street Vacation No. 163 to vacate approximately 825 linear feet of Riverview Drive, Tentative Parcel Map No. 19606 subdivide 41.09 acres into ten (10) industrial lots ranging in size from 1.7 acres to 10.36 acres and one lettered lot, and Commission Review and Approval No. 886 for the construction of a 749,346 square foot industrial park consisting of ten (10) industrial buildings ranging in size from 25,050 square feet to 206,178 square feet in size, bounded by the Redlands Municipal Airport to the north, November 3,2015 Page 4 Judson Street to the west, Pioneer Avenue to the south, and Sessums Drive to the east. PUBLIC HEARINGS: Deferral and Waiver of Public Improvements — Mayor Foster opened the public hearing and called upon Municipal Utilities and Engineering Director Chris Diggs to provide details on steps taken to address adjacent property owner concerns with respect to an application for the deferral of construction of public improvements, acceptance of a security for the improvements, and a waiver of construction of public improvements at 725 South Wabash Avenue. On motions of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved the deferment of the requirement to construct curb and gutter improvements across 149 linear feet of the frontage at 725 South Wabash Avenue and to accept a security for said improvements as satisfactory fulfillment of the requirement. The motions further approved a waiver of construction of storm drain improvements at 725 South Wabash Avenue based on the findings listed in the Redlands Municipal Code section 12.22.090 C4 that the improvements "impose a requirement that is not roughly proportional to the benefit to the property or to the burden resulting from use of the property." UNFINISHED BUSINESS: Prospect Park Grove — Kelsey Gormley, of the Quality of Life Department, and James Garland, the City of Redlands Internal Auditor, presented a history of decisions made to replant the Prospect Park Citrus Grove and a comparison of the financial performance of from several of the City of Redlands groves. As public comment, eleven speakers presented their support and opposition to the plan to remove approximately 1,100 from the Prospect Park Grove, modify soil conditions in the grove, replant with new trees and install a drip irrigation system in the grove. After each councilmember articulated his/her position on the plan, and on motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council voted to reaffirm approval of the replanting of the designated portion of the Prospect Park Grove. Mayor Foster and Councilmember Barich voted No on the motion. NEW BUSINESS: Communications Center Donation—Police Chief Mark Garcia announced a major donation to the City of Redlands. On motion of Councilmember Gilbreath, seconded by Councilmember Barich, the City Council unanimously approved the acceptance of a charitable donation from the San Manuel Band of Mission Indians, in the amount of $100,000.00 for the purpose of purchasing a mobile communications center in the form of a 35-foot fifth wheel trailer and authorized an additional appropriation of the same amount to the Redlands Police Department. Traffic Enforcement Grant — Police Chief Mark Garcia provided a summary of the Selective Traffic Enforcement Program. On motion of Councilmember November 3,2015 Page 5 Gilbreath, seconded by Councilmember James, the City Council unanimously approved the acceptance of an Office of Traffic Safety Selective Traffic Enforcement Program PT 16136 Grant for local law enforcement agencies, in the amount of $153,604.00, and authorized an additional appropriation of the same amount to the Redlands Police Department. General Plan Review— Development Services Director Oscar Orci summarized a request from the Historic and Scenic Preservation Commission (HSPC). On motion of Councilmember James, seconded by Councilmember Barich, the City Council unanimously agreed to direct the HSPC to review and provide recommendations to the design and preservation element of the Redlands General Plan. Alcohol Consumption Permit—Quality of Life Director Chris Boatman outlined a plan to sell alcohol at the Veterans Day Picnic event. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved a request for the consumption of alcohol at Jennie Davis Park for the 2015 City of Redlands Veterans Day Parade and Picnic event to be held on November 11, 2015. Waterin,a Citations Suspension — Quality of Life Director Chris Boatman summarized events leading to a proposal to temporarily suspend code enforcement citations related to lawn irrigation. On motion of Councilmember Gilbreath, seconded by Councilmember Barich, the City Council unanimously agreed to direct staff to temporarily suspend any code enforcement citations related to the failure to water a lawn or having a brown lawn in response to state emergency drought legislation. Traffic Signal — Quality of Life Director Chris Boatman presented details on necessary repairs to the traffic signal at University Street and Citrus Avenue. On motions of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously agreed that approval of a contract to replace a traffic signal cabinet is exempt from review under Section 15301 of the California Environmental Quality Act guidelines and approved a contract between the City of Redlands and Macadee Electrical Construction, Inc., in the amount of $66,969.00, for the traffic signal cabinet at the intersection of University Street and Citrus Avenue. Tree Trimming — Erik Reeves, of the Quality of Life Department, Presented a new tree trimming contract. On motions of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved an agreement between the City of Redlands and West Coast Arborists, Inc. to provide tree trimming, removing, planting and consulting services for the City trees, and the issuance of a purchase order to West Coast Arborists, in an amount not to exceed $300,000.00 annually for the term of the agreement. Representing the contractor, Ernesto Macias thanked the City Council for the opportunity to continue to work with the City of Redlands urban forest. November 3,2015 Page 6 Software Maintenance — Chief Innovation Officer Danielle Garcia reviewed the City of Redlands utility database and customer management software technical support requirements. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved a purchase order with Systems and Software, in an amount not-to-exceed $137,879.00, for annual software maintenance and support. Insurance Binder — Human Resources/Risk Management Director Amy Martin summarized the City of Redlands commercial property and difference in conditions (DIC) and commercial vehicle physical damage insurance coverage. On motion of Councilmember James, seconded by Mayor Pro Tem Harrison, the City Council unanimously approved binding coverage, with a total annual premium of $389,176.00, for the City's Commercial Property & DIC Coverage and Commercial Vehicle Physical Damage Insurance with Lexington Insurance Company. Reservoir Recoating and Improvements — Greg Brooks, of the Municipal Utilities and Engineering Department provided an overview of rehabilitation required at the Crafton Hills Reservoir. On motions of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously agreed that approval of an agreement and construction of the Crafton Hills Reservoir Recoating and Improvements Project, Project No. 71261 is exempt from review under Section 15301 of the California Environmental Quality Act guidelines, rejected the first and second low bids received for the Project, approved the Project plans and specifications, and awarded a construction contract between the City of Redlands and Paso Robles Tank, Inc., in the amount of$574,135.00, for the work. Resolution No. 7587 — Irrigation Water Restrictions — Municipal Utilities and Engineering Director Chris Diggs reviewed steps taken and their effect with respect to addressing water supply conditions caused by the ongoing drought. As public comment, Bill Cunningham suggested the City should appeal State Water Resources Control Board standards. He pointed out the urban agricultural areas within the city, involving micro grove citrus operations, which adversely affect the total water consumption rates of the city. On motion of Councilmember Gilbreath, seconded by Councilmember James, the City Council unanimously approved Resolution No. 7587 implementing a water conservation irrigation schedule. Irrigation water use is reduced to two days per week allowing even- numbered addresses to irrigate on Mondays and Thursdays and odd-numbered addresses to irrigate on Tuesdays and Fridays, during the prescribed hours cited in the Redlands Municipal Code (prohibited between the hours of noon and 8:00 P.M.) November 3,2015 Page 7 COUNCILMEMBER ANNOUNCEMENTS AND ACTIVITIES: Councilmember Barich — Along with Councilmember Gilbreath, attended the Redlands Art Walk on October 25, 2015. He expressed his disappointment with the State Water Resources Control Board action to fine the City of Redlands $61,000.00 for failure to meet water conservation goals. Councilmember Gilbreath — Along with Councilmember James, she attended the Civics Day sponsored by the Redlands Optimists on October 27, 2015. She attended a Healthy Cities Quarterly meeting in Yucaipa and provided a tour of City Hall to a local Girl Scout Troop for their Government Merit Badges. Along with Mayor Foster she attended the annual Employee Recognition Luncheon. Councilmember James — Along with Mayor Pro Tem Harrison, he attended General Plan Update Steering Committee meetings and State Senator Mike Morrell's Women of Distinction Ceremony and Dinner at the University of Redlands Orton Center on October 16, 2015. Mayor Pro Tem Harrison — Attended an Open House celebrating the completion of Grid Alternatives roof top solar system installation. He highlighted the opportunity available to low income households to greatly decrease their energy costs by participating in this program. Mayor Foster — Attended a Red Cross work project which resulted in the installation of over 100 smoke detectors in senior citizen and low income homes in the community, the Redlands Airport Association toy drive for Toys for Tots, and a Chamber of Commerce Coffee with the Mayor.
