2'his special meeting of the City Council was called for the purpose of making
determinations on the 1980 Building Permit Allocations under Proposition "R'
and ordinances Nos. 1680 and 1717.
Resolution No. 3688, adopted July 1, 1980, established this date as the
Resolution final date for allocation of all building permits for the year 1980. This
No. 688 resolution was adopted for the reason that: "circumstances relating to the

gui.re:d additional time for procedural implementation and evaluation of the
first semiannual_ allocation and the second seminannual. allocation."
Before taking up the recommendations of the Planning Commission on the allo-
caltions, Mayor DeMirjyn asked for coiiiinents from those present in the
audience.
Mr. James D. Stroffe, attorney for C-Y Development and Harvest Investors
restated his presentation to the Planning Commission. He expressed disatis
taction with the allocation of the total 450 units in one action rather than
consideration of two 225-unit, sediments; he protested the decision regarding '
No. 7a under Section II, Sanitary Sewage Collection, and recommended that
C-'1 Development be allowed to mitigate by replacing the 25-year-old sewer
over one mile from the development in order that there be "no City contribu-
tion." Mr. Stroffe's points are documented in the Planning Commission
`4 minutes dated September 23, 1980.
Mr. Stoffe discussed what he considered mitigation permitted under other
sections of the ordinance; tie also took issue with the point allocation
under Police Protection, No. 3, Section I7 ; anc, under Section IT, No. 4,
Drainage, he stated that a system of retention basins and plantings could
alleviate the downstream drainage flow. fie added that this matter should be
a requirement under site-development and not a factor in point evaluation.
Mrs. Ingrid Mack of I. Mack Development., expressed dissatisfaction with
"lumping together" of two 225-unit allocations into one. 450-unit decision;
that points were awarded under the architectural category for a lot-sale
mobile home park; police point allocation, drainage points, and gradinci re-
quirements. She stressed that her 28-unit application should be awarded
points for reduced density and open space.
Council received explanations of the methods used in project (,valuations in
Public works, Planning, and the Police Department from the department heads.
Mr.. Schindler added that every applicant was notified of this meeting. Mr.
Donnelly explained the sewer rating system in detail and explained sewer
flow volume evaluations. Chief Brickley gave the police response time now
in effect in the City and what resulting change would be brought abort by
development.
Mr. Bob Nastase stated that he believed all applicants would find fault with
the ratings, and that he felt the staff had uniformly applied the ordinance
and had done a good job.
Mr. Jim Coffin addressed Council to state that the only reason that govern-
ment exists is to meet and mitigate problems, and if Council does not solve
the problems, they are not doing the job.
1980 Mayor DeMirjyn then closed the public hearing. Council discussed the matters

tions to not make any change at this time in the Police Allocation Points. Motion
adopted unanimously.
In response to Mr. Stroffe's comments from the floor, Mayor DeM.irjyn moved
as follows: "All applications for building allocations have !peon reviewed
by the City Council., that they in fact agree with what has been recommended
by staff as well as the Planning Commission, and S move that we move along
and make the allocations as presented." This motion was seconded by Council-',
man Riordan, and adopted unanimously.
Councilman Roth then brought up the Planning Commission's action on Environ-
mental and Esthetic points which was discussed briefly. Councilman Riordan
urged that since the change discussed did not alter the position of the
applicants on the Allocation Agenda, this change be addressed at a later time!,
and the allocations be made according to the staff recommendation to the
Planning Commission. Mrs. Riordan so moved; motion seconded by Councilman
Roth and unanimously adopted.
Community Development Director Schindler then read the recommendations and
Council voted unanimously as follows:
