This special. meeting, of the City Council was called for the purpose of
considering the: following:
(1) School Definition of Impaction
(2) Classroom Utilization Report dated November .:3, 1980
(3) School Fees for City and For County
(4) Exemptions
Mayor DeMirjyn called the meeting to order and made a brief statement of
the guidelines to be followed, adding that the purpose was to permit the
Counci.lmembers to exchange ideas and evaluate material received :from the
School Administration and discuss a draft ordinance.
The recent action by the County Board of Supervisors in accepting the
School. Board's statement of impaction for only Fal:lsvale and Cram T;lemen-
tary Schools was discussed, as was a comparison of fees charged by the igm
County and by the Redlands Unified. School District }Board, including a pro--
posed new fee schedule based on tyre of dwelling.
The Council explored variations of the definition of impaction at length
and re-considered the alternative solutions available. They discussed
the specific use of: rooms, the number of hours used, and the limitations
on the number of teachers available. They were acrai.n informed of State
mandates, State laws about maximum "timber of students nEsrn;.tt.ec; in class-
rooms in various grades, and State requirements for "special" classes,
Title L, and other programs. They discussed and agreed upon maximum and
minimum student numbers for various grade levels.
Council concurred that it was essential, to bring future fees into align-
ment with those being charged by the County; to have the fee schedule
approved by the Council, and to attempt to make application of fees as
"equitable as possible." Definitions in the draft ordinance were listed
and discussed. There was concurrence on mitigation measures and on exemp-
tions as contained in the draft under consideration. Council also con-
curred that the matter of fee collection would be re-opened at any time.
The Council considered the controls set by the County upon the use of the
fee monies and discussed limiting the use to building or renting temporary
structures in order to bring the fees more .into line with the County.
* Councilman Gorman then moved to include in the ordinance being prepared
a restriction on the use of fees, that they be used for purchase or rental
of temporary of transportable classrooms, and that the City Council must
approve the fee schedule and/or use of fee monies. Motion seconded by
Councilman Riordan and adopted; Councilman Martinez abstained.
(it was explained to those in attendance that ultimately the ordinance
under preparation this evening will. be presented at a Council. meeting and
will hav e a second reading and public hearing at another later meeting
and will take effect thirty days later.)
The Council then took up the matter of exemptions. Councilman Gorman
reminded the members that Section IV of Ordinance No. 1680 pertains to
outside-the-city water and sewer service. The decisions of the County
and the claims of the School District were considered at length. Council-
men Gorman and Roth then agreed with the other Councilmembers that this
draft ordinance will apply only within the city limits.
Speaking from the audience, Lois Lauer recommended a moratorium on the
fees, or letter of intent to pay the fee at such time as this ordinance
goes into effect. Mr. Rufus Moore urged that standards be included in
the new ordinance to assure proper number of students to occupy the school
rooms with a specific minimum to the number of hours each room is utilizes
a standard of spaciousness, he called it. Marge zmrick, Redlands Teacher=
Association president spoke. Mr. Les Willey asked that Council :include a
"verification of validity of room use in the ordinance, i.e. how well the
plant is being used." Joyce Frazer presented information regarding
changes expected in requirements in early 1981 with a possible combining
of special classes. Ingrid Mack questioned°the feasibility of funding
now classrooms when the district cannot fund teachers." A Mr. and Mrs.
Hathaway spoke; also Don Wallace and Stephanie Lisenbercr.
* following the public input, Councilman Gorman moved, with Councilman Roth
seconding, that the fee not be collected, and that the City Manager
approach the school administration asking them to accept a promissory
note to pay a fee based on the ordinance to be adopted. This motion was
approved with Councilman Martinez abstaining.
When asked, City Attorney Taylor stated: "You may proceed in that way;
you may find yourselves having to collect from people who feel they have
no need to pay,"
