in the Council Chambers, Civic Center, 35 Cajon Street, at 3:00 P.M. on February
24, 1998.

Declaration of Local EmergencX - In accordance with Government
Code Section 54956.6, Mayor Cunningham called this special emergency
meeting for the following purpose: Declaration of existence of a local
emergency and adoption of legislation as necessary to safeguard life, health and
property.
Public Works Director Mutter reported the City suffered a significant heavy rain
last night causing the collapse of portion of the Mill Creek Zanja along West
State Street at Kendall Street and systematic failures of public infrastructure at
various locations throughout the City. He briefly described the efforts of City
staff during the night hours. Fire Chief Enslow was also available to review the
calls for services during this storm.
Resolution No. 5496 - Declaring Existence of Local Emergency -
Councilmember Gilbreath moved to adopt Resolution No. 5496, a resolution of
the City Council of the City of Redlands declaring the existence of a local
emergency. Motion seconded by Councilmember Freedman and carried
unanimously.
CEQA Exemption - Based upon the verbal and written testimony of the Public
Works Director, Councilmember George moved that substantial evidence exists
that the proposed project is exempt from the requirements of the California
Environmental Quality Act (CEQA) in that the project constitutes emergency
repair work to public serviced facilities necessary to maintain service and
further directed staff to file and post a Notice of Exemption in accordance with

the City's CEQA guidelines. Motion seconded by Councilmember Banda and
carried unanimously.
Solicitation of Bids - In accordance with the requirements of Public Contract
Code Section 22050 and based upon the testimony presented to the City Council
by the City's Public Works Director, Councilmember Banda moved that this
City Council find that substantial evidence exists that the emergency caused by
the collapse of a portion of the Mill Creek Zanja along West State Street at
Kendall Street, and other systematic failures of public infrastructure at various
locations which affect the delivery of vital public services will not permit a
delay in undertaking repair work from the competitive solicitation of bids; that
this City Council further finds that the expenditures of public funds to repair
said damages is necessary to respond to the emergency; and that this funding of
this project shall be recorded in the official minutes of the City Council.
Motion seconded by Councilmember Freedman and carried unanimously.
Resolution No. 5497 - Immediate Expenditure of Public Money -
Councilmember Freedman moved to adopt Resolution No. 5497, a resolution of
the City Council of the City of Redlands declaring the public interest and
necessity demand the immediate expenditure of public money to safeguard life,
health and property. Motion seconded by Councilmember Banda and carried
unanimously.
Funds - Contract - Local EmergencX - Councilmember Cunningham moved to
appropriate up to $500,000.00 from the General Fund and award the contract for
emergency repairs to a portion of the Mill Creek Zanja along West State Street
at Kendall Street and other systematic failures of public infrastructure at various
location which affect the delivery of vital public services. Motion seconded by
Councilmember George and carried unanimously.
ADJOURNMENT
There being no further business, the City Council meeting adjourned at
11:40 A.M. The next regular meeting will be held on March 3, 1998.
