PRESENT Susan.Peppler, Mayor Gilberto Gil, Mayor Pro Tem Pat Gilbreath, Councilmember Gary George, Councilmember Jon.Harrison, Councilmember ABSENT None STAFF John Davidson, City Manager; Daniel J. McHugh, City Attorney; Lorrie Poyzer, City Clerk; Mel Enslow, Fire Chief, and Ronald C. Mutter, Public Works Director NEW BUSINESS Local Emergency - City's Sports Park Site - Senior Civil Engineer Bill Hemsley reported the citrus grove at the Redlands Sports Park site was allowed to dry up based on the premise that construction would begin the summer of 2003. Since that time, various issues have prevented the project from starting and the trees being removed. This has resulted in a fire hazard. On May 24, 2005, the Redlands Fire Chief declared that it was his opinion a state of emergency exists due to the threatening nature of the hazard. A memorandum from the Assistant Fire Marshal was provided and a written memorandum from the City's Director of Emergency Services (the City Manager) was also provided asking the City Council to proclaim the existence of a local emergency. City Manager Davidson presented Resolution No. 6403, a resolution of the City Council of the City of Redlands declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health and property. Public Works Director Mutter noted the bid submitted by Larry Jacinto Construction, Inc. for removal of the dead citrus trees and underbrush at the sports park site has been withdrawn; staff expects to present a new contract to the City Council for its consideration next week. Pursuant to the request of the City Manager/Director of Emergency Services, Councilmember George moved to proclaim the existence of a local emergency in accordance with Chapter 2.52 of the Redlands Municipal Code. Motion seconded by Councilmember Gilbreath and carried unanimously. Councilmember George moved to find and determine that City staff has presented this City Council with verbal and written testimony which constitutes substantial evidence that the local emergency caused by the dead citrus grove at the City's sports park site will not permit a delay in undertaking the work to alleviate the local emergency that would result from a competitive solicitation of bids for the removal of the dead grove and underbrush. Motion seconded by Councilmember Gilbreath and carried Special Meeting May 31,2005 Page 1 unanimously. Councilmember George moved to adopt Resolution No. 6403 declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health and property. Motion seconded by Councilmember Gilbreath and carried unanimously. Councilmember George moved to determine that the City's award of a contract for the removal of citrus trees and underbrush at the sports park site does not require further environmental processing, pursuant to Section 15162 of the California Environmental Quality Act Guidelines, based on the following findings: the proposed project does not result in new significant environmental effects or a substantial increase in the severity of previously identified effects; no substantial changes have occurred with respect to the circumstances under which the project will be undertaken; and there is no new information of substantial importance with respect to this project's environmental consequences that was not known at the time the Environmental Impact Report was adopted. Motion seconded by Councilmember Peppler and carried unanimously. PUBLIC COMMENTS Summer Solstice - Noting June 21st is the summer solstice, Councilmember George announced he will not be wearing a jacket at the next City Council meeting. ADJOURNMENT There being no further business, the City Council meeting adjourned at 9:07 A.M. An adjourned regular meeting will be held on June 7, 2005, at 9:00 A.M. in the City Council Chambers.
