HomeMy WebLinkAboutOrdinances_1984_CCv0001.pdf ORDINANCE NO. 1984 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS AMENDING THE ARTICLE 926 OF THE REDLANDS ORDINANCE CODE RELATING TO THE ADVISORY COMMITTEE AS RECOMMENDED BY THE REDLANDS PLANNING COMMISSION R.P.C. NO. 702 SECTION ONE: That Section 92601 (f) of the Redlands Ordinance Code is hereby amended as follows: (f) The Advisory Committee, consisting of three persons composed of one member each from the City Council , Planning Commission, and Public Works Department, may waive any and all of these requirements provided that said committee has made a unanimous finding that such an action will not adversely affect the health, safety, and welfare of the public, and further provided appellant shall agree in writing to participate in any street improvement program for the block in which the property is located, whether privately or publicly initiated. This agreement shall be recorded with the County Recorder by the City Clerk. Appellant may appeal any decision of the Advisory Committee to the City Council . Said appeal shall be filed in writing with the City Clerk not more than ten (10 ) days after the written notice of the Committee' s decision is mailed to the applicant and accompanied with a filing fee in an amount established by the City of Redlands. SECTION TWO: That Section 92601 (g) is hereby added to Article 926 of the Redlands Ordinance Code to read as follows: (g) In the A-1, A-2, and residential zones, or on properties with recorded, active agricultural preserve contracts on which no notice of non-renewal has been filed, where the lot size of the real property for which improvements are required to be constructed is one acre or more, the City' s Improvement Agreement Advisory Committee may waive any and all of the requirements of this Article provided that the Committee has made a unanimous finding that such waiver will not adversely affect the health , safety and welfare of the public, and further provided that the owner of the property affected by such waiver shall agree in writing to the following: (1) In the event City funds are expended to construct improvements required by this Article within fifteen (15) years of the date of the waiver, and, the owner or any subsequent owner of the property obtains City approval to subdivide the property within said fifteen (15) years, the owner or subsequent owner shall reimburse the City for all costs incurred by it for the construction of such improvements. Any such agreement entered into under this section shall be recorded with the County Clerk for the County of San Bernardino. The owner of any property affected by a decision of the Advisory Committee may appeal any decision of the Advisory Committee to the City Council . Said appeal shall be filed in writing with the City Clerk not more than ten (14) days after the written notice of the Committee' s decision is mailed to the applicant and accompanied with a filing fee in an amount established by the City of Redlands. SECTION TWO: This ordinance shall be in force and take effect as provided by law. SECTION THREE: The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in this City.
