HomeMy WebLinkAboutOrdinances_2425_CCv0001.pdf ORDINANCE NO. 2425 AN ORDINANCE OF THE CITY COUNCIL, OF THE CITY OF REDLANDS ADDING CHAPTER 8.44 TO THE REDLANDS MUNICIPAL CODE TO REGULATE THE SALE OF AEROSOL PAINT CONTAINERS AND FELT-TIP MARKER PENS WHEREAS, the City of Redlands finds that the unauthorized use of aerosol paints and marker pens with a pen tip width in excess of three-eighths of one inch have been used in the past to commit vandalism within the City of Redlands; and WHEREAS, it is the purpose and intent of this ordinance to supplement those penal code sections dealing with the improper and illegal use of aerosol paints and marker pens with a pen tip width in excess of three-eighths of one inch; and WHEREAS, the City Council finds that it is in the best interest of the citizens of Redlands to regulate the accessibility to the public at retail establishments selling aerosol containers or marker pens with tips exceeding three-eighths of an inch in width; THE CITY COUNCIL OF THE CITY OF REDLANDS DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Chapter 8.44 is hereby added to the Redlands Municipal Code to read as follows: "Chapter 8.44 SALE OF AEROSOL PAINT CONTAINERS AND FELT-TIP MARKER PENS Sections: 8.44.010 Inaccessibility to Public 8.44.020 Violation Section 8.44.010 Inaccessibility to Public Any person who owns, conducts, operates or manages a retail commercial establishment selling aerosol paint containers, or marker pens with tips exceeding 318 of an inch in width, containing anything other than a solution which can be removed with water after it dries, shall store or cause such aerosol paint containers or marker pens to be stored in an area viewable by, but not accessible to the public in the regular course of business without employee assistance,pending legal sale or disposition of the pens or aerosol paint containers. I:Veml0rdinancelord2425.wpd 1 8.44.020 Violation Any person,firm,or corporation who shall violate any of the provisions of this Chapter shall be guilty of a misdemeanor." Section 2. If any section, subsection, sentence,clause or phrase of this ordinance is held for any reason to be unconstitutional, invalid or ineffective by any court of competent jurisdiction,the remaining sections, subsections, paragraphs, sentences, clauses and phrases shall not be affected thereby. The City Council hereby declares that it would have adopted this ordinance regardless of the fact that one or more of the sections,subsections, paragraphs,sentences, clauses or phrases may be determined to be unconstitutional, invalid or ineffective. Section 3. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City, thereafter this ordinance shall take effect as provided by law.
