HomeMy WebLinkAboutOrdinances_1418_CCv0001.pdf ORDINANCE NO. 1418 AN ORDINANCE OF THE CITY OF REDLANDS ESTABLISHING THE RULES AND REGULATIONS FOR THE GRANTING OF FRANCHISES TO OPERATE AUTHORIZED EMERGENCY AMBULANCE VEHICLES OVER, ALONG AND UPON THE STREETS OF THE CITY OF REDLANDS . The City Council of the City of Redlands does ordain as follows: SECTION 1 . The following rules and regulations are hereby established for the granting of City of Redlands franchises to operate authorized emergency ambulance vehicles over, upon and along the streets of the City of Redlands. SECTION 2 . (a) The granting of franchises under the terms of this ordinance will be by Resolution. The Resolution will specify the name of the individual or corporation granted the franchise, and will also state that the rules and regulations prescribed in this ordinance will govern the operation of the franchise. (b) The granting of the franchise is conditional upon the Grantee ' s filing with the City Clerk a written acceptance thereof and agreement to comply with the terms and con- ditions herein set forth. SECTION 3. The term of franchises granted shall not exceed five (5) years , and shall be subject to the right of the City to terminate or alter or amend said franchise at any time as herein- after provided. SECTION 4 . If the Grantee shall at any time fail to comply with or fulfill the terms or conditions of this franchise, the City Council may by resolution revoke this franchise. Failure of the Grantee to furnish adequate service by reason of strikes , lockouts , war, riot, civil commotion, inability to acquire equipment, parts , fuel , lubricant, drivers or other causes beyond the control of the Grantee, shall not be a violation of the terms of this franchise. If any term or condition of this franchise shall be or become invalid or unenforceable, the City Council may by resolution ter- minate this franchise, provided the City Council shall find and declare that the invalid or unenforceable term or condition con- stituted a consideration material to the grant of this franchise. K., r - T SECTION 5. All vehicles used under this franchise shall be operated and maintained in accordance with the laws of the State of California, and the ordinances of the City. SECTION 5 . The Grantee of this franchise, by acceptance of the same, agrees with the City to charge such rates for ambulance service as may from time to time be prescribed by the City, by resolution. SECTION 7 . The City of Redlands shall regulate the operation of the Grantee in the following respects : (a) To make reasonable orders respecting character, extent, quality and standard of service. (b) To make orders governing ambulance operating procedures . (c) To fix rates of operation, and to make orders respecting the same. Such rates shall be posted in a conspicuous place in ambulance headquarters and in a conspicuous place in the interior of each ambulance . (d) To make such other rules and regulations as may be reasonably necessary to facilitate the service to be rendered to the public under this franchise, including establishment of emergency call districts. SECTION 8 . The Grantee must have a valid permit and the drivers , operators , and attendants of the authorized emergency ambulance shall , at all times , be qualified pursuant to the re- quirements of the Vehicle Code of the State of California. SECTION 9 . Neither this franchise , nor any interest therein shall be sold, assigned or disposed of, either by merger or con- solidation, or otherwise without the consent of the City expressed by resolution. SECTION 10 . The City hereby expressly reserves the right to modify, amend, alter, change or eliminate any of the provisions of the franchise during the life of the same , for the following purposes , to wit: (a) To eliminate or delete from the same such conditions as prove obsolete or impractical. (b) To impose such additional conditions upon the Grantee as may be just and reasonable, such conditions to be those as may be deemed necessary for the purpose of insuring adequate service to the public. Ordinance No. 1418 Page two SECTION 11. In the interest of public health, safety and welfare , the Grantee shall not operate any ambulance unless and until the following conditons have been met: (a) No station wagon or panel trucks , except appropriately constructed carry-all type vehicles approved by the Chief of Police may be used. (b) Ambulances may be inspected at irregular intervals at the discretion of the Chief of Police to insure completeness of equipment. (c) Grantee shall secure and maintain at all times a policy or policies of insurance in the following categories and minimum amounts : Automobile Bodily injury . . . . . . . . . $100 , 000/$300 ,000 Property damage . . . . . . . $ 50 ,000 Other Ambulance Malpractice Insurance . . . . . . . . . . . . . $100 , 000/$300 , 000 A 30-day written notice to the City is required of cancellation or reduction in amount of insurance carried. The Grantee shall file with the City Clerk copies of insurance policies or certificates thereof. (d) Each ambulance unit shall carry a minimum of one resuscitator, one "E" size cylinder of oxygen and other first aid and medical supplies necessary to render emer- gency care to patients . (e) A driver and attendant shall respond to all calls . Such drivers and attendants shall possess or comply with the following: (1) Advanced American Red Cross First Aid Certificate , or Advanced First Aid Certificate issued by United States Bureau of Mines . Ordinance No. 1418 Page three ARM (2) Annual statement or certificate of health issued by a licensed physician or surgeon whereby it is indicated that the person examined is free from contagious or communicable diseases. Examinations will be programmed as follows : (a) Prior to employment, all drivers and attendants must have a physical examination, chest film and TB skin test. (b) During employment: (1) If original TB skin test was positive , a yearly chest film is required. (2) If original TB skin test is negative, a yearly TB skin test is required. (3) Have on file with the Redlands Police Department his photograph and fingerprints for identification purposes. (4) Ambulance Driver or Attendants " permit issued by the Redlands Police Department. (5) Records required in (1) and (2) above will be on file with the Grantee and the Redlands Police Department. (6) The Grantee shall maintain a distinctive color scheme with the name of the company on each side and rear door of each ambulance unit, together with a legible identification number not less than 4" high. SECTION 12 . Performance Bond Grantee will provide the City with a performance bond in the amount of $7500 to reimburse City for any expenses resulting from cancellation of the franchise as a result of failure of the fran- chisee to perform required service. A certificate evidencing the existence of such a bond will be filed with the City Clerk. A 30-day written notice to the City is required of cancellation of, or reduction in the amount of the performance bond. Ordinance No. 1418 Page four SECTION 13 . Franchisee will provide a suitable ambulance headquarters, within the city limits, at his expense. The lo- cation of this headquarters is subject to city approval. SECTION 14 . Franchisee will establish a base FM radio station at ambulance headquarters and equip all mobile units with FM radios for two-way communication with the base station. City will provide a duplicate base station at the Police Department and a tie line between the Police Department and ambulance headquarters. SECTION 15 . The City Council of the City of Redlands declares that public convenience, necessity and welfare require a minimum of one ambulance, to be maintained by the franchise holder, such ambulance to be based and operative within the city limits of the City of Redlands , together with necessary crew available for unit. In the event the franchise holders fail to provide such minimum ambulance requirements or fail to abide by any term of the franchise, the City shall upon such determination notify the Grantee in writing and the Grantee shall have ten days to increase service to minimum standards. If the Grantee fails , the City may cancel the franchise. SECTION 16. It shall be unlawful for any Grantee to give directly or indirectly, or cause to be given, any rebates , com- missions , reserve rebates , or any reduced rates or cash discounts to any person or persons , or to any groups, except as provided herein. SECTION 17. (a) Whenever in this ordinance any right or power is conferred upon, or duty imposed upon the City, such right and power shall inure to and be exercised by, and such duty shall be imposed upon the City Council. (b) The franchise shall not constitute an exclusive grant of any right to conduct ambulance services within the City. SECTION 18 . This ordinance is declared to be an emergency measure for the preservation of the public health and safety in accordance with the provisions of the Government Code of the State of California. SECTION 19 . The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts. This ordinance shall take effect immediately upon its adoption.
