AN ORDINANCE ADDING SECTION 6. 24 .120 AND
REPEALING SECTION 8.04. 100 OF THE REDLANDS
MUNICIPAL CODE PERTAINING TO NOISY ANIMALS
THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN A
FOLLOWS:
SECTION 1: Section 8 .04 .100 of the Redlands Municipal
Code is hereby repealed.
SECTION 2: Section 6. 24.120 is hereby added to the
Redlands Municipal Code to read:
"NOISY ANIMALS - PROHIBITED
A. No person shall own or keep any dog or other animal
within the City which, by frequent barking,
howling, yelping or whining, disturbs the peace of
the neighborhood or which causes excessive -
discomfort to any reasonable person of normal
sensitivity residing in the area. A violation of
this Section shall be an infraction.
B. The standards to be considered in determining
whether a violation of the provisions of this
Section exists include, but are not limited to,
the following:
1. The level of the noise.
2. The level and intensity of background noise.
3 . The proximity of the noise to residential
sleeping areas.
4. The density of the habitation of the area.
5 . The time of day or night when the noise
occurs.
6. The duration of the noise.
C. As used in this Section, a neighborhood shall be
defined to mean an area in which at least three
single family dwellings or one multiple family
dwelling are located within 200 feet of the
boundary line of the premises upon which the animal
described in subsection A is located.
D. If, at the time of the violation , no person is in
possession of the premises upon which the animal
described in subsection A is located, any animal
control officer or police officer may enter the
private property and remove the animal from the
premises. An animal so removed shall be impounded
and may be returned to its owner upon payment of
impound and boarding fees. "
SECTION 3. This ordinance shall be in force and take
effect as provided by law.
SECTION 4 . The Mayor shall sign this ordinance and the
City Clerk shall certify to the adoption of this ordinance
and cause it to be published in the Redlands Daily Facts, a
newspaper of general circulation printed and published in
this City.
