HomeMy WebLinkAboutOrdinances_1935_CCv0001.pdf ORDINANCE NO. 1935 AN ORDINANCE AMENDING ARTICLE 239 OF THE REDLANDS ORDINANCE CODE RELATING TO BUSINESS LICENSES FOR FORTUNETELLING THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS: SECTION 1 . Article 239 of the Redlands Ordinance Code is hereby amended to provide as follows: Article 239 Fortunetelling, Palmistry, Etc. Sec. 2391 . LICENSE REQUIRED FOR FORTUNETELLING. It shall be unlawful for any person, in exchange for any fee or consideration, to practice the art or business of fortunetelling, predicting or foretelling the future, or to furnish any information not otherwise obtainable by the ordinary process of knowledge, by means of analyzing any animate or inani- mate objects including but not limited to celestial bodies, crystal balls, tea leaves , or playing or other cards , or through the exercise of any purported psychic, mediumistic, prophetic, occult , clairvoyant, or supernatural powers with- out having first applied for and received the City license as hereinafter provided. Sec. 2392 . LICENSE APPLICATION. Each license to practice or engage in the above-described conduct shall be applied for by permit which contains the following information: 1 . The business name and address, mailing address , and home and business telephone numbers of the applicant . 2 . The record of conviction for violations of the law, excluding minor traffic violations . 3 . The fingerprints of the applicant on a form provided by the police department . 4 . The address, city and state, and the approximate dates where and when the applicant prac- ticed a similar business, either alone or in conjunction with others. 5 . The type of ownership of the business and the owners or principal officers of the business . -2- 6 . The estimated gross receipts of the business through the end of the calendar year . Sec . 2393 . INVESTIGATION. Upon filing, the application shall be referred to the Police Department for investi- gation to verify the facts contained in the application and any supporting data . The Police Department shall report its findings to the City Treasurer and shall recommend approval or denial of the license. A report recommending denial shall set forth the grounds for the recommendation, and a copy shall be provided to the applicant . Sec. 2394 . APPROVAL OF LICENSE . The City Treasurer shall approve the business license upon the City Treasurer ' s determination that : 1 . All of the information contained in the application and supporting data are true . 2 . The applicant has not , within the previous two years , been convicted of any violation of this Article or any law relating to fraud or moral turpitude . -3- Sec. 2395 . ISSUANCE OF LICENSE, AND BONDING. An approved business license shall be issued to the applicant upon payment of the first annual license fee and posting of a bond in the principal amount of Fifty Thousand Dollars ( $50 , 000 ) , executed by the applicant as principal and by a good and sufficient corporate surety authorized to do busi- ness in California, in a form approved by the City Attorney. The bond shall insure good faith and fair dealing by the Appli- cant and shall provide a guarantee of indemnity for any and all loss , damage or deprivation suffered by any patron of the applicant in the conduct of his business . Sec. 2396 . ANNUAL FEE. The appli- cant shall pay an annual business license fee for practicing fortune telling and. related activities as described herein in the amount of One Hundred Dollars ( $100 . 00 ) per year . Sec. 2397 . PERMITTED ZONES. Fortunetelling and related activities as described herein may be conducted only within the C-3, C-4 , C-M, M-P, M-1, I-P, and M-2 zones City of Redlands . -4- SECTION 2 . Ordinance No. 1419 of the City of Redlands is hereby repealed. SECTION 3 . This Ordinance shall be and take effect as provided by law. SECTION 4 . The Mayor shall sign this Ordinance, and the City Clerk shall certify to the adoption of this Ordinance and cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in this city.
