HomeMy WebLinkAboutOrdinances_1580_CCv0001.pdf ORDINANCE NO. 1580 AN ORDINANCE OF THE CITY COUNCIL OF THE C I TY OF REDLANDS, CALIFORNIA, AMENDING CHAPTER 13 OF THE REDLANDS ORDINANCE CODE, ENTITLED "CITY MANAGER" THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA, DOES ORDAIN THAT THE REDLANDS ORDINANCE CODE IS HEREBY AMENDED TO PRO- VIDE AS FOLLOWS : Section 1. § 13009, of Article 130, entitled "ADVICE" is deleted from the Redlands Ordinance Code. Section 2 . § 13101, of Article 131, entitled "AMOUNT OF COMPENSATION" shall be changed to read as follows : § 13101. AMOUNT OF COMPENSATION. The City Manager shall receive such compensation as the City Council shall from time to time determine and fix by a majority vote, considering solely the matter of the Manager ' s compensation. § 13105, of Article 131, entitled "SEVERANCE PAY" shall be changed to read as follows : § 13105. SEVERANCE PAY. On termination of employment of the City Manager by reason of involuntary removal from service or within three years of initial employment other than for willful misconduct, the City Manager shall receive cash severance pay in a lump sum equal to one month's pay. Section 3 . Article 132, titled "REMOVAL" shall be changed to read as follows : ARTICLE 132. REMOVAL § 13201. VOTE REQUIRED. The removal of the City Manager shall be effected only by a majority vote of the whole City Council as then constituted, convened in a regular council meeting; subject, how- ever, to the provisions of the next succeeding sections . § 13202. DISCRETIONARY HEARING. The Council at :its discretion may grant a public hearing or a private hearing in personnel session to the Manager for the purpose of hearing his reasons as to why he should not be removed. The Manager must submit a written request to the City Clerk for the hearing within ten days subse- quent to the vote on his removal. The hearing shall be held at the second regular Council meeting after receipt by the City Clerk. 13203 . FINALITY. In removing the City Manager, the City Council shall use its uncontrolled discretion and its action shall be final. § 13204. REMOVAL AFTER MUNICIPAL ELECTION. Notwithstanding the provisions of this chapter hereinbefore enumerated, the City Manager shall not be removed from office during or within a period of thirty days next succeeding any general municipal election held in the city at which said election a member of the City Council is elected. The purpose of this provision is to allow any newly elected member to the City Council to observe the actions and ability of the City Manager. Section 4. § 13317, of Article 133, entitled, "POWERS : DUTIES, " is deleted from the Redlands Ordinance Code. Section 5 . EFFECTIVE DATE: This ordinance shall become effective thirty (30) days after final passage thereof. Section 6. PUBLICATION: This ordinance shall be published within fifteen (15) days after its passage, as required by law, in the following news- paper of general circulation : Redlands D y Facts .
