HomeMy WebLinkAboutOrdinances_2553_CCv0001.pdf ORDINANCE NO. 2553 AN ORDINANCE OF THE CITY OF REDLANDS ADDING; CHAPTER 8.46 TO THE REDLANDS MUNICIPAL CODE TO REGULATE THE DISPLAY OF DRUG PARAPHERNALIA The City Council of the City of Redlands does ordain as follows: Section 1. Chapter 8.46 entitled Display of Drug Paraphernalia is hereby added to the Redlands Municipal Code to read as follows: "CHAPTER 8.46 Display of Drug Paraphernalia 8.46.010 Inaccessibility to Minors 8.46.020 Violation 8.46.010 Inaccessibilit, to Minors. Except as authorized by law, no person shall maintain or operate any place of business in the City in which drug paraphernalia, as defined in Health and Safety Code section 11364.5 or as amended, is kept, displayed, sold, furnished, transferred, given away or offered in any manner unless such drug paraphernalia is completely and wholly kept, displayed and offered within a separate room or enclosure into which persons under eighteen years of age, not accompanied by a parent or legal guardian, are excluded. Each entrance to such room or enclosure shall be posted with a sign, in reasonably visible and legible words, notifying the public that drug paraphernalia is Dept, displayed and offered in such room or enclosure and that minors, unless accompanied by a parent or legal guardian, are excluded. 8.35.020 Violation, As provided by California Health and Safety Code section 11364.5 or as later amended, and notwithstanding any other provision of law, violation of this Chapter shall not constitute a criminal offense, but operation of a business in violation of the provision of this section shall be grounds for revocation or non-renewal of any license, permit, or other entitlements previously issued by the City for the privilege of engaging in such business and shall be grounds for denial of any future license, permit, or other entitlement authorized in the conducting of such business or any other business, if the business includes the sale of drug paraphernalia." The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter this ordinance shall take effect as provided by law.
