HomeMy WebLinkAboutOrdinances_2154_CCv0001.pdf ORDINANCE NO. 2154 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS ADOPTING THE NATIONAL ELECTRICAL CODE, 1990 EDITION AND RELATED CHANGES THERETO WHEREAS, Government Code Sections 50020 et sea. empowers the City to adopt by reference various uniform codes, including the National Electrical Code; and WHEREAS, in accordance with Sections 17958 . 5 and 17958 . 7 of the Health and Safety Code, the City Council desires to adopt the National Electrical Code, 1990 Edition; and WHEREAS, Health and Safety Code Sections 17958 . 5 and 17958 . 7 authorize the City to amend the National Electrical Code, based on climatic, geological and topographical conditions existing in the City; and WHEREAS, the City Council is informed and finds that the National Electrical Code, 1990 Edition, must be amended to address the following conditions existing in the City: 1 . The City is subject to relatively low amounts of precipitation, very low humidity levels and extremely high temperatures . These climatic conditions are conducive to the spread of fire. For example, during July, August and i September, temperatures often exceed 100° Fahrenheit . During the same months humidity is usually less than 40%, and measurements less than 10k are not uncommon. These recordings were documented by the San Bernardino County Flood Control District and the National Climatic Data Center. 2 . The City is subject to extremely strong winds, commonly referred to as "Santa Ana Winds, " which can reach speeds of 80 miles per hour. Extensive damage often occurs during such winds including downed trees, utility poles, utility circuits and utility service lines . These adverse conditions cause: (1) fires, (2) impairment of emergency apparatus access, (3) delays in response times of emergency apparatus, and (4) the depletion of apparatus readily avail- able for fire suppression activities . For example, one wind storm lasted for approximately six hours and downed over 200 trees citywide in 1985 . In 1989 , the City experienced a 24 hour period of severe winds during which scores of utility lines were downed in the City impairing emergency access . On one occasion fire units from Redlands were sent to assist in the extinguishment of a fast moving, wind assisted fire in the San Bernardino/Highland Foothills which destroyed or damaged many homes . These units were then unavailable for fire suppression in the City. 3 . Within the City there are four earthquake faults (Redlands Heights Fault, Banning Fault, Crafton Fault and the Redlands Fault) ; three other faults are located in immediately adjacent areas (Loma Linda Fault, San Jacinto Fault and the San Andreas Fault) . In the event of a severe earthquake, these faults present the potential for catastrophic damage, including fire, damage to roadways and other impairments of -2- NDP48805 emergency apparatus . (This information is according to maps used by Cal Tech, Pasadena and provided by the U.S . Geological Survey) . WHEREAS, the City Council is informed and finds that develop- ment has occurred in the City and continues to occur that has resulted in severe traffic congestion during peak business hours, weekends and holidays thus, decreasing emergency response time particularly on the following streets and highways : Citrus Avenue, Cajon Street, Orange Street, Lugonia Avenue, Colton Avenue, Tennessee Street, San Timeteo Canyon Road, and I-10 Freeway. NOW, THEREFORE, the City Council of the City of Redlands does ordain as follows: Section 1 . Section 15 . 12 . 010 of the Redlands Municipal Code is hereby amended to read as follows: 1115 . 12 . 010 Document adopted by reference - Copies on file. That certain document on file in the office of the City Clerk of the City, which is marked and designated as "National Electrical Code, 1990 Edition, " and each and all of the regula- tions, provisions, additions and terms of the National Electrical Code as amended in this chapter are referred to, adopted, and made a part of this chapter. There is a copy of the document and code referred to above now on file in the office of the City Clerk. " Section 2 . Section 15 . 12 . 015 is hereby added to the Redlands Municipal Code to read as follows : - 3- NDP48805 1115. 12 . 015 NEC Section 90-9 - Future Expansion and Conve- nience. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into the Redlands Municipal Code, is amended by adding Section 90-9 , which shall read as follows : SECTION 90-9 . Distribution centers located in readily accessible locations shall provide three additional approved con- duits, three quarter inch minimum in size; two additional conduits for interior and one for exterior use. " Section 3 . Section 15 . 12 . 020 is hereby amended to read as follows : °15 . 12 .020 NEC Section 90-10 added - Administration, Board of Appeals and permit fees . The first chapter of the National Electrical Code, entitled Article 90 , Introduction, as incorporated into the Redlands Municipal Code, is amended by adding Section 90-10 , which shall read as follows : -4- SECTION 90-10 . ADMINISTRATION. The Uniform Administrative Code, 1988 Edition, as published by the International Conference of Building Officials, is hereby declared to be included and made a part of this Code. EXCEPTION (1) : BOARD OF APPEALS . Section 204 of said Uniform Administrative Code shall be changed to read: "The Board of Appeals and the procedures concerning its operation, as stated in Chapter 15 . 04 of the Redlands Municipal Code, shall also apply to all appeals resulting from the administration of this Code. " EXCEPTION (2) : ELECTRICAL PERMIT FEES. Table 3-B of the Uniform Administrative Code shall be deleted and Electrical Permit Fees shall be as per resolution of the Mayor and City Council . Minimum Electrical Permit will be $30 . 00 . " Section 4 . Section 15 . 12 . 030 is hereby amended to read as follows: 1115 . 12 . 030 NEC Section 90-11 added - Electric fences. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into the Redlands Municipal Code, is amended by adding Section 90-11, which shall read as follows : -5- NDP48805 SECTION 90-11. After the effective date of Redlands Ordinance Number 1867 (April 18 , 1985) , it will be unlawful to install any type of electric fence within the City of Redlands. Electric fences prohibited include those energized by battery, generator or electrical utility. " Section 5 . Section 15 . 12 . 035 is hereby added to the Redlands Municipal Code to read as follows: 1115 . 12 . 035 NEC Section 90-12 added -- Used Material . The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into the Redlands Municipal Code, is amended by adding Section 90-12, which shall read as follows: SECTION 90-12 . Previously used electrical material shall not be reused without written approval obtained in advance from the Building Official . Section 6 . Section 15 . 12 .045 is hereby added to the Redlands Municipal Code to read as follows: 1115 . 12 . 045 NEC Section 90-13 added - Trailers . The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into the -6- NDP48805 Redlands Municipal Code, is amended by adding Section 90-13 , which shall read as follows: SECTION 90- 13 . Trailers, Mobilehomes, Commercial Coaches and House Cars being utilized for construction projects as defined in Section 8 .20 which connect to temporary power shall comply to the city' s adopted National Electrical Code. Trailers, Mobilehomes, Commercial Coaches and House Cars connected to an electrical source shall apply for an electrical permit for inspections. Electrical and installation permit fees shall be as per resolution of the Mayor and City Council . " Section 7 . The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of the Ordinance and shall cause it, or a summary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this ordinance shall take effect in accordance with law.
