Home My WebLink AboutOrdinances_2512_CCv0001.pdf ORDINANCE NO. 2512 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 15.12 OF THE REDLANDS MUNICIPAL CODE BY MAKING AMENDMENTS TO, AND ADOPTING, BY REFERENCE, THE 2001 CALIFORNIA ELECTRICAL CODE, PART 3 OF TITLE 24 OF THE CALIFORNIA CODE OF REGULATIONS WHEREAS, California Health and Safety Code Section 18941.5 empower the City to adopt by reference various uniform codes, including the National Electric Code, 1999 edition, published by the National Fire Protection Association, Inc.: and WHEREAS, Health and Safety Code Section 18941.5 authorizes the City to make amendments to said uniform codes on the basis of local climatic, geological, or topographical conditions existing in the City; and WHEREAS, the City Council of the City of Redlands ("this City Council") is informed and finds that the area in which the City is located receives relatively low amount of precipitation, very low humidity levels and extremely high temperatures all of which are conducive to the spread of fire; and WHEREAS, this City Council is informed and finds that the area in which the City is located is subjected to extremely strong winds, commonly referred to as Santa Ana winds, which reach speeds of 80 miles per hour in the City and results in extensive damage and is also conducive to the spread of fire; and WHEREAS, this City Council is informed and finds that within the City four earthquake faults (Redlands Heights, Banning, Crafton, and the Redlands Faults) and three other faults are immediately adjacent (Loma Linda, San Jacinto, and the San Andreas Faults) creating the potential for catastrophic damage and fire hazards; and WHEREAS, this City Council has determined that because the City is subject to the above referenced climatic, geological, and topographical conditions that amendments to the Nation Electrical Code are necessary to protect life and property, and that such amendments are to deal with the following issues: (1) future expansion and convenience, (2) appeals and permit fees, (3) electric fences, (4) used materials, and (5) trailers; The City Council of the City of Redlands does ordain as follows: Section 1. The text of Chapter 15.12 of the Redlands Municipal Code is hereby deleted in its entirety and rewritten to read as follows: l:lcat;cm\0rdinancc\25l2 Electrical,%%rpd "Chapter 15.12 NATIONAL ELECTRICAL CODE Sections: 15.12.010 Document adopted by reference--Copies on file. 15.12.015 NEC Section 90-10--Future expansion and convenience. 15.12.020 NEC Section 90-11 added--Administration, Board of Appeals and permit fees. 15.12.030 NEC Section 90-12 added--Electric fences. 15.12.035 NEC Section 90-13 added--Used material. 15.12.045 NEC Section 90-14 added--Trailers. 15.12.060 Violation—Penalty 15.12.010 Document adopted by reference--Copies on file. That certain document of file in the office of the City Clerk, which is marked and designated as"National Electrical Code, 1999 Edition,"and each and all of the regulations, provisions, additions and terms of the National Electrical Code as amended in this chapter, are referred to, adopted and made a part of this chapter. There is a copy of the document and code referred to above now on file in the office of the City Clerk. 15.12.015 NEC Section 90-10--Future expansion and convenience. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this code, is amended by adding Section 90-10, which shall read as follows: SECTION 90-10. Flush-mounted distribution service installation for new one-family dwellings shall be provided with three additional three-quarter inch raceways,two raceways forfuture interior and one raceway for exterior use. The interior raceways shall terminate in an approved manner in an attic, underfloor space or other location approved by the Chief Building Official. Where an underfloor space does not exist, two raceways shall terminate in the attic if one exists, or under the eave when no attic exists. The exterior raceway shall terminate outside the distributions service. 15.12.020 NEC Section 90-11 added--Administration,Board of Appeals and permit fees. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this code, is amended by adding Section 90-11 , which shall read as follows: SECTION 90-11. Administration. L\ca`.Ecm\0rdinanceQ512 Electrical.vpd 2 I (1): Board of Appeals. The Board of Appeals and the procedures concerning its operation, as described in Chapter 15.04 of the Redlands Municipal Code, shall also apply to all appeals resulting from the administration of the National Electric Code. (2): Electrical Permit Fees. Table 3-B of the Uniform Administrative Code shall be deleted and Electrical Permit Fees shall be as per resolution of the City Council. Minimum electrical permit shall be $30.00. 15.12.030 NEC Section 90-12 added--Electrical fences. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this code, is amended by adding Section 90-12, which shall read as follows: Section 90-12. it will be unlawful to install any type of electric fence within the City of Redlands. Electric fences prohibited include those energized by battery, generator or electrical utility. 15.12.035 NEC Section 90-13 added--Used material. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this code, is amended by adding Section 90-13, which shall read as follows: Section 90-13. Previously used electrical material shall not be reused without written approval obtained in advance from the Chief Building Official. 15.12.045 NEC Section 90-14 added--Trailers. This first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this code, is amended by adding Section 90-14, which shall read as follows: Section 90-14. Trailers, mobile homes, commercial coaches and house cars being utilized for construction projects as defined in Section 8.20 which connect to temporary power shall comply to the City's adopted National Electrical Code. Trailers, mobile homes, commercial coaches and house cars connected to an electrical source shall apply for an electrical permit, a $30.00 placement permit and deposit a refundable $2,000.00 bond or bond equivalent prior to the placement and inspections. 15.12.050 Violation—Penalty. It is unlawful for any person, firm, corporation, partnership, or entity to do or permit the following: erect, construct, enlarge, after, repair, move, improve, remove, convert, demolish, equip, use or maintain any electrical system in violation of the National Electrical Code, as amended by the chapter. Every person who violates any of the provisions of this code, is guilty of a misdemeanor. Such person shall be deemed guilty of a separate 1:=calem'(Ordinance12512 Electrical.wpd 3 offense for each and every day or portion thereof during which any violation of any of the provisions of is chapter is committed, continued or permitted. Upon conviction such person may be punishable by a fine not exceeding one thousand dollars, or by imprisonment in the county jail for a period not exceeding six months, or by both such fine and imprisonment. Section 2. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City and thereafter this ordinance shall take effect as provided by law. _2�_�7v _� Karl N.
