HomeMy WebLinkAboutOrdinances_2199_CCv0001.pdf ORDINANCE NO. 2199 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTERS 3 . 16 AND 12 .44 OF THE REDLANDS MUNICIPAL CODE RELATING TO FEES FOR USE OF THE REDLANDS COMMUNITY CENTER WHEREAS, the Redlands Municipal Code generally provides that the City may establish and charge fees to recover the costs it incurs for providing recreational facilities and services to its citizens; and WHEREAS, because the City' s Municipal Code does not specifically address fees for use of the Redlands Community Center, the City' s Recreation Department has requested donations from users of the Community Center to defray the City's operational expenses; and WHEREAS, based upon the recommendation of its Community Services Department, the City Council of the City of Redlands has determined that it is in the best interests of the citizens of Redlands to implement a uniform fee schedule for persons using the Redlands Community Center; NOW, THEREFORE, be it ordained by the City Council of the City of Redlands as follows: Section 1. Section 12 . 44 . 294 is hereby added to the Redlands Municipal Code to read as follows: 1112 . 44 . 294 Redlands Community Center -- Permit Fees. Any person or group making application for use of the Redlands Community Center shall pay the fees for such use as established by resolution of the City Council. " GPS129974 Section 2 . Section 12 . 44 . 320 of the Redlands Municipal Code is hereby amended to read as follows: 1112 . 44 . 320 Reservation -- Formal Permit -- Conditions. The Director may impose such reasonable conditions, not inconsistent with the provisions of this Chapter, upon the issuance of the formal permit as he deems necessary for the protection of the public health, safety, and welfare, including, without limitation, conditions related to time, place, frequency, duration, fees, consumption of alcoholic beverages, maximum attendance, parking restrictions, and placement of apparatus and equipment. Such conditions and fees shall be set forth in writing and delivered to persons applying for reservations at the time an application is requested. " Section 3 . Section 3 . 16. 040 of the Redlands Municipal Code is hereby amended to read as follows: 113 . 16. 040 Schedule of Fees and Service Charges. The City Manager, Finance Director, and each City department head, under the direction of the City Manager, shall review the fees and service charges listed following, on the schedule of frequency listed in Table 3 . 16 . 040, and set and adjust the fee or charge schedule so as to recover the listed percentage of costs reason- ably borne necessary to provide the listed regulation, products, or services. All fees and charges set pursuant to this Chapter and Section shall take effect thirty days after the City Manager signs an executive order stipulating that all provisions of this Chapter have been complied with, and no written appeal has been filed. This Chapter shall not apply to fees and charges related to use of the Redlands Community Center. Such fees and charges shall be as provided for in Chapter 12 . 44 of this Code. " Section 4 .
