HomeMy WebLinkAboutOrdinances_2052_CCv0001.pdf ORDINANCE NO. 2052 AN ORDINANCE OF THE CITY OF REDLANDS ADOPTING GUIDELINES TO IMPLEMENT AND INTERPRET CITY GROWTH MODERATION INITIATIVES WHEREAS, in 1978 the voters of the City of Redlands approved an initiative ordinance to moderate the rate of growth within the City ( Proposition "R" ) ; and WHEREAS, in 1987 the voters of the City of Redlands approved another initiative ordinance to moderate further the rate of growth within the City to preserve the City ' s unique environment and character (Measure "N" ) ; and WHEREAS, Section 16 of Measure "N" allows this City Council to adopt guidelines to implement and interpret both initiatives following public notice and public hearing thereon, provided that any such guidelines must be consistent with both growth moderation initiatives and must be approved by at least four members of this Council ; and WHEREAS, this Council has reviewed the provisions of Section 6 of Measure "N" relating to the limitation on extension of water or sewer service to dwelling units outside the City limits , which provisions require the City not to make water or sewer service allocations or connections to more than 150 such dwelling units in any calendar year ; and WHEREAS, facts amounting to a public health emergency in connection with the sewage disposal system at the Friendly Hills Mobilehome Park in Mentone have been brought to the attention of this Council and this Council believes that unless the sewage disposal problems at the Friendly Hills Mobilehome Park and similarly situated facilities are corrected, the public health and safety of the citizens of Redlands will be endangered; and WHEREAS, it appears therefore to this Council that a procedure needs to be established by which the City can take account of public health emergencies outside the City and allow limited sewer connections to alleviate such emergencies ; THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS : SECTION 1 . The 150 outside connection limit in Section 6 of Measure "N" shall not apply to sewer connections ordered by City Council resolution, after public notice and hearing, in order to alleviate a public health emergency. SECTION 2 . This ordinance shall be in force and take effect as provided by law. SECTION 3 . The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts , a newspaper of general circulation printed and published in this City.
