HomeMy WebLinkAboutOrdinances_1650_CCv0001.pdf yr ORDINANCE NO. 1650 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING THE REDLANDS ORDINANCE COVE AND CREATING A HILLSIDE GRADING ORDINANCE A S`T'ABLISHINt CRITERIA FOR EXCAVATION, CRATING, EARTHWORK CONSTRUCTION, FILLS, AND EMBANKMENTS IN CERTAIN HILLSIDE AREAS THE CITE COUNCIL OF THE CITY CE REDLANDS does hereby ordain asfollows : SECTION ONE: That the Redlands Ordinance Cade be amended by the addition of Chapter 86, Laid Development Standards, reading as fellows. i BUILDING LAND DEVELOPMENT STANDARDS CHAPTER 86 CHAPTER. 86 LANE DEVELOPMENT STANDARDS ARTICLE 860 HILLSIDE GRADING h' 86000 SHORT TITLE. This ordinance shall be known as the Hillside trading ordinance. § 86001. PURPOSE. The City of Redlandsfinds and declares that it is necessary to promote the public health, safety, and general welfare by accomplishing the purposes set forth in this ordinance. Where this ordinance s in conflict with other City ordinances, the stricter shall: apply. Specifically, this ordinance a) provides for the preservation of the natural scenic character of the land, consistent with reasonable economic enjoyment of such property. b) provides, insofar as practical and in per- mitting reasonable development of land, protection against flooding, erosion, earth movement, and s-i_milar hazards,. c) prevents the creation of large man-made slopes which destroy the scenic and ecological 'values of hillside areas. 86602 APPLICABILITY. These standards shall .apply to all land within the City of Redlands which has a natural slope of ten percent (1.0;x) or more on twenty-five percent (25%) or more of the site are and shall be in addi- tion to the grading standards contained in Chapter 70 of the Uniform Building Code. 86003.- PERMIT APPLICATION. To obtain a per- mit, the applicant shall file an application upon forms furnished by the City. Every application shall contain the following information: a) The name, address, and phone number of the person to have effective control of the work, b) The amount of maternal proposed to be exca- vated and the amount: of fill in cubic yards; c) The estimated, dates for >starting and com- pleting the work: to be done, Ordinance No. 1650 12/578 I; "e-at ?, z,', k µ',. BUILDINGLAND DEVELOPMENT STANDARDS Sec. 86003 Cont d soils engineering investigation based on the plans for the work proposed under the permit. Such reports shall include data regarding the nature, distribution, and ,strength of existing soils, conclusions and recommendations for grading procedures an design criteria for corrective measures. This requirement may be 'waived by the Direc- tor of Building and Safety when it appears from the condition of the property that such a report is not necessary. 86004. REQUIREMENTSOR SCALE PLANE AND DRAWINGS. The application shall be accompanied by scale plans or drawings, prepared and signed as appropriate by registered civil engineer, architect, or landscape architect showing the following (unless such. ;a requirement is waived by the Director of Building and Safety, if all proposed grading is minor in scope) : a Property lines of the property on which the work is to be performed, b Location of any buildings or strictures on the property where the work is to be per- formed and the location of any buildings or structures on land of abutting property which is within twenty-five feet of the pre.-- perty on which the work is to be performed. c) Elevationsdimensions, locations, extent, and the slopes of all work proposed to be done, shown by contour map, cross sections or other means which shall include the contiguous adjacent sites in addition to the proposed grading site. Contours shall be shown at appropriate intervals. (one foot, contour intervals as required. Two or five foot contour intervals may be accepted if deemed appropriate by the Building and Safety Department. d) Detailed plans of all walls, cribs, drains dais, erosion control planting, or other protective devices to be constructed in connection with or part of the proposed work, together with a zap showing the drainage area and estimated cubic feet per second runoff of the area served; by any drain. Ordinance No. 1650 12/5/78 i BUILDING LAND DEVELOPMENT STANDARDS Sec. 86404 Cont. e) Landscape, irrigation, and planting plans for slopes exceeding five feet in height., f n a composite plot pian is submitted for the site, indicate existing contours and proposed grade: elevations. Buildings to show locations with dimensions indicated from property lines and from tops or toes of slopes. Driveways shall have elevations indicated at intervals of ten feet hori- zontally or less to verify compliances with allowable driveway gradients. g) Inspecialcircumstances, the Director of Building and Safety may 'require further applicable plans or drawings . 86005. APPLICATION REFERRED TO ENVIRONMENTAL REVIEW COMMITTEE. When the grading to be done on a site which has a natural slope of ten ,percent (10%) or more on twenty--five percent 5%) or more of the site area, the application shall be referred to the Environmental Review Committee (ERC) for review. The Director of Community Planning shall report to the ERC on any aspect of the pro- posed grading, excavation or fill which relates to or affects the General Plan or zoning regulations of the City. The ERC upon completion of :its investigation shall approve, disapprove, or approve with mitigating measures; to b incorporated into the grading plan, The Director of Building and Safety may refer any application to the; ERC which in his opinion may warrant their considera- tion. 86006. C.RI TERIA FOR EVALUATION OF GRADING APPLICATION. e Director of Building and Safety and/or the Environmental Review Committee shall: use but not be limited to the following criteria for a grading permit: a) The grading of a property shall not be excessive beyond that necessary for the use and drainage: of the site. b) The proposed grading is not to have an adverse environmental effect on surrounding property. Ordinance No. 1650 12/5/7 BUILDING LAND DEVELOPMENT STANDARDS Sec. 600 ��^x l..ori 6 . } The grading of a project shall consider the surrounding property and shall blend in with the surrounding topography in areas that have been developed. 860074 GENERAL CRITERIA. a) No cut or fill slopes shall.- be created which exceed thirty feet, vertical height, and any curt or fill slope which exceeds ten feet i BUILDING LAND DEVELOPMENT STANDARDS Sec. 86007 Cont. e) Developments may be recontc used if the Environmental Review Committee finds and determines that strict conformance with these regulations would result its an adverse visual or environmental impact 86008 . RETAINING WALLS a) One uslope retaining wall not to exceed six feet in height may be used. b) One downslope retaining 'wall not to exceed three and a half feet in height may be used,. c) On dots sloping with the street, and other` configurations not discussed above, one retaining wall not to exceed three feet may be used on each side of the lot. d) Adjacent to driveways, retaining walls not exceeding six feet may be used. e) Retaining walls ;exceeding two and a half' feet will require a protective fence or guard .rails of at least 42 inches. The combination of retaining wall and protective fence will be subject to the Planning Ordinance height limitations for the various yard locations. ns. f Alternate retaining wall systems may be used if the Building and Safety Director and/or the Environmental Review Committee finds that practical considerations- of the site justifies other retaining wall dimensions and locations; provided further, that the Environmental Review Committee determines that such alternate retaining wall system will not present an adverse visual of environmental impact. z 86009. DRIVEWAYS a Driveways which exceed a centerline measure- ment of thirty feet in length shall be pro- vided ahead of each garage, a parking space for safe outside parking. Cont.00 C lest the width of the garage opening with: a minimum of ten feet; shall have longitu- dinal and transverse slope gradients not exceeding plus or minus five percent (5 ) t and shall be designed to prevent surface waters from draining .into gavage:. b) Driveways which do not exceed thirty (30 feet in length measured along the centerline shall have a maximum gradient of eight per- cent (8%) for that portion of the driveway located within twenty (20) feet of the garage entrance. C) .Maximum longitudinal driveway gradients shall be twenty percent (20%) ; m nimun crown or cross slope shall be one percent (1%) ; and maximum crown or cross slope shall be five percent (5°,f . d Vertical transitions shill prevent contact of any portion of car with surface of drive- way by use of the following criteria. Vertical transition shall be rade with not less than four feet parabolical curve; when the driveway exceeds fourteen percent. (141Y.) , the vertical transition: shall be an eight ( foot parabolical curve., 6010. PERMIT ISSUANCE OR DENIAL, CONDITIONS UPON ISSUANCE. a) S UA CB.a) Grounds for taenial - Whenever in the judge- ment of the Director of Building and Safety or the 'Environmental Review Committee the proposed work would not <meet the foregoing requirements. b) Condition Upon issuance - In granting any permit under this Chapter, the Director o Building and. Safety or the Environmental. Review Committee may attach such conditions thereto as may be reasonably necessary to prevent danger to public or private pro- perty or to prevent the operation from being conducted in a manner likely to create a nui x; X BUILDING LAND DEVELOPMENT STANDARDS Sec. 8 } Conton L.w. Limitations on the hours of operation in which the work may be performed Designation of routes upon which materials may be transported and: means of access to the site; The placer and manner of disposal of excavated materials; Requirements as to the mitigation of dust: and dirt, the prevention f noise and other results offensi e or is urious to the neighborhood, the general public or any portion thereof, including due consi- deration, care., and respect for the pro- perty rights, convenience and reasonable desires and the needs of said neighborhood or any portion thereof; -- Designation of maximum or mini.um slopes to be used; - Regulations as to the use of public streets and places in the course of the work; performance bond to cover landscaping or father conditions of the permit; - Mitigating measures required by the Environmental; Review Committee. 86011. APPEAL PROCEDURE. The applicant or any interested party shall have ten days to appeal the decision of the Director of Building and Safety to the Environmental Review Committee. The decision of the Environmental .Review Committee may be appealed to the City Council. 86012 . DEPOS ITS OF EARTH, ROCK, E" C. , ARE PROHIBITED (IN CERTAIN LOCATIONS) . a) Premises of another person No person shall dump, move, or place any earth, sand, gravel, rock, stone, or other excavated material or debris so as to cause the same to be deposited` upon or to roll over the; premises of another without the express; written consent of the yawner of such premises so affected, or upon or over any public place or war,.. Ordinance No. 1650 12/5/78 1 k BUILDING LAND DEVELOPMENT STANDARDS Sec. 86012 Cont- b) Spilling. No person shall, when hauling any earth, sand,, gravel, rock, stone, or other excavated material or debris over any public street, alley, or public place, allow such material to blow or spill over and upon such street, alley, or place, or adjacent private property. c Removal of Debris. If, due to a violation of subsections (a) or (b) or this section, any earth, sand>,, gr vel. rock., stone, or ether excavated material is caused to be deposited upon or to roll, flow or wash upon any public place or way, the person responsible therefore shall cause the same to be removed from such> ;public place or war within twenty-four hours or immediately after notification by the City if a hazardous condition is caused. In the event it ,is not so removed, the Director of Public Works shall cause such removal- and the cost of such removal shall be paid to the City by the person who .failed, to so remove the material. 013. COMPLIANCE WITH THE REDLAN S BUILDING CODE. Upon approval of the application by the Director of Building and Safety or the Environmental Review Committee, the applicant must still conform to all conditions imposed by the; Redlands building crudes;.
