THE CITY COUNCIL OF THE CITY CSE REDLANDS DOES ORDAIN AS FOLLOWS:
SECTION lw Title. This ordinance shall be known as the
"H i-st ric and Scenic Preservation Ordinance of the City of Redlands.
SECTION 2. T'ur ose and Intent City of Redlands hereby
finds, determines, and declarer :
(a) That the City of Redlands, possesses many distinctive struc-
,t,ur s, Beautiful trees and gardens, e pubic parkt, and other scenic
and aesthetic qualities that enhance its value as an attractive and

community.
That the well preserved properties established before and
tier ;this city's incorporation in 1883 contribute to this cam u-
ty's tine character, atmosphere,- and reputation
'c) That certain at these properties, urhich by' age, ar hitec-
t,ura l style, aestheat.rc appeal, or association with local history, are
of great historical significance and value.
(d) Further, that it is important that these , irreplaceable
l-,amples of historical properties which contribute so Youch to our
heritage must be preserved to be enjoyed and valued by
the generations which follow us`.
(e) And that the adoption of reasonable and fair regulations
.n_o necessary as a means for recognition, documentation, and preserva-
tion of our historical properties and to provide recognition of the
comamu,nity value of these properties.
SECTION Historic c and Scenic Preservation Cor fission_ E'stab

seated and established to act as ars advisory board to the City
Council of the C-4 ty of Redlands for the purpose of makingrecommen-
dations or determinations concerning the designation, preservation,
protection, enhancement, and perpetuation o these historical prop-
, t e .and districts which contribute to the culture and aesthetic
values of the City of Redlands.,
SECTION 4. Me ,bers . The following regulations shall apply to
the r,aembersbip an-d--organization of the 11istoric and Scenic Preserva-
tion Commission:issiona

(a) Number of Members. The Historic and Scenic 1?reservation
Commission shall con3ist of nine (9) members.
(b) Members : Submitted List. Four (4) voting members of the
Hi8toric and Scenic PreservationComumission shall "-)e appointed by
the City Coiincil cif= the City of Redlands and shall be chosen from
a list containing ten (10) names. This list is to be submitted by
t-1-te Board of the Redlands Area Historical Society.
(c) Members - Redlands Citizons at ta—q ,. Foir (4) voti-nq
of the Historic and Scenic Pro- servation shall be
tin ed by the City Council from city residents at large.
(d) member - One (1) 70ting member
of the Historic and Scenic Preservation Commission shall be the

list shall serve four (4) -year tenns and tbereafter they

SECTION 5. Procedure. The following regulations shall govern
t. procedural ni ters of the Historical and Scenic Preservation

(a) Officers . The Historic and Scenic Preservation Commission
shall irimediately upon its appointment organize and elect a Chair-
-inrson for the term of one (1) year and such other off icers a's the

(b) Internal RulesTl H

its own organization as are necessary to carry out the purpose and
intent of this section; and shall designate the time ana place for

(c) Rfqular Minutes . The Historic �--nd Scenic
Preservation Commission shallkeep records of all of its actions
a0x] proceedings and shall have regular meeting dates.

Commission shall submit: annually, a proposed budget to the Cita

sary for the performance of its duties ;

Commission shall be a working commission and wherever feasible shall
pr vide from its own members the necessary staff tcarry out and
perform those duties delineated In this ordinance.
SECTION 6. Duties. The duties of the Historic and Scenic
Preservation Commission are as follows:

a Definition: H srica- j- ce 1. Property. A historical
or scenic property is any property, structure,ucture, r• improvement (in-
cluding any significant trees or ether plant life) which satisfies
any of the following requirements :
(1) The property is the first, last, only or raost signif-
icant
igni.f«i, ant historical or scenic property of its type in the City
Redlands, or
( ) The property is associated with an i<ndi i ual or group
having si.gni_ficanty influence on the history or development of the
City of Redlands ; or
( ) The ,property is an example or co tai as an example of
period, style, architectural movement or construction of histori-
cal, aesthetic, or architectural interest; or
(4) The property is a part of ov contributes aesthetically
to the historical or scenic heritage or historical or sc nz.c~ proper-

(e) !;�i_ ouncL V te. Upon its determination that a property
is registerable .historic or scenic property, the Historic and Scenic
Preservatioa Commission shall immediately so notify the Redlamds
city council , who, at its next scheduled meeting, shall vote on the
inclusion of the property in the Redlands register of Historic and
Scenic Properties.
(f) .gcw strati.t n . Upon a property' s acceptance by the Redlands
City Council_ the Historic and Scenic Preservation Commission shall:
enter the property on the Redlands Register of Historical and Scenic
Properties and the owner shall have recorded in the office of the
County Recorder that this property has been registered as an histo -
cal and scenic property subject to all the rules and regulations of
Ordinance No. 1600 of the City of Redlands .
('g) Notice of Sale sir Transfer. after a- property is registered

SECTION S. Demolition, Altnrati2in, orRemo ,l of Historic or
cc n:i c xop r' shall comply with the following regulations and
procedures :
(a) Definition ubstantial Alteration. Substantial alteration
:is any alteration of any property or parts of that; property listed: in
the Register of Historic and Scenic Properties which changes that
prroper,ty. so that :it lessens or detracts from its historic or scenic
value or character but shall: not include maintenance and preservation

(b) Permit Rgy1j . It shall he unlawful for any person(s) to
destroy, alter, or remove any property recorded in the Register of
Historic and Scenic Properties without first notifying the Department
of Building and Safety of the City of Redlands of the property' s
status of registered historic or scenic property and then obtaining
a permit for such work from said department.

(d) issuance of Permit. No permit for the demolition, altera-
tion, or removal of any property in the Register of Historic and
Scenic Properties shall be issued without first referring the matter
to the Historic and Sconl* c Preservation Coi-xmission, except where the
issuing agency deter-minc,s that demolition, removal, or alteration of
any building, structure, or site is irmnediately necessary in the
interest of oublic health, safety, or general welfare. The issuing
board or agency shall notify the Historic and Scenic Preservation
Commission in writing within five (5) days of any request it receives
for any such permit.
(e) Notification of 2hjfELita is. The Historic and Scenic Preser-
vation Cominission shall have thirty (3 0) days fro-.11 the date of such
notification within which to object to the proposed demolition, major
alteration, or removal of a registered historic or scenic property.
Vie Commission, upon review, shall file its objections with the City
Council. Upon the filing of such objections, no permit shall be
issued for the demolition, major alteration, or removal of said
registered historic or scenic property for a period of riot less than
thirty (3 0) days or more than sixty (60) days. Ilse City council
shall notify the appropriate departments ofthefiling of objections
by the Historic and Scenic Preservation Cornmission. Failure to file
objections within the thirty (3 0) day period shall be deemed a waiver
of all objections, and the permit shall be issued in due course.
(f) Recommendations. Upon the filing of objections, the His-
toric and Scenic Preservation Comm4ssion shall take such steps within

the close of the first thirty (30) days, but within a sixty (60) -day
period, the Historic and Scenic Preservation Conmii,ssion shall report
and make its recommendation to the City Counc,;"_I. The City Council,
upon review of the Historic and Scenic Preservation Commission ' s
recommendation, may deny the requested permit, modify the permit, or
withdraw and cancel the objections to the proposed demolition, major
alterations, or removal of the historic property, and the necessary
permit shall then be issued.
(g) Public Hf--arina. Before the Historic and Scenic Preserva-
tion Commission shall make its recommendation to the City Council,
a public hearing shall be held on the proposed demolition, -major
alteration, or removal in question. The City Clerk shall have a
notice of the time and place of such hearing, and the purpose thereof,
published twice, at least ten days before such hearing, in a news-
paper of general circulation published and circulated in the City of
Redlands. in addition, one-week notice by mail shall be given to th(:
party or parties who applied for the permit,
(h) Conduct of nearing. At the time of the hearing by the
Historic and Scenic Preservation Corzirnission any person or persons,
interested may appezar in person or by petition and thereupon said

Historic and Scenic Preservation Commission shall recommend the
approval, modification, or rejection of the proposed demolition,
alteration, or removal of the registered historic or scenic property.
SECTION 9. Showi ner of llardshj2. The Historic and Scenic Pres-
ervation Commission or the City Council,, in a'- hcarinq provided for
n Section g) of this ordinance, may remove a property from the
Register of historic and Scenic: Properties or appr:>ve a permit for
the demolition , alteration, or removal of a registered historic or
scenic property if the applicant present.; facts clearly demonstrating
to the satisfaction of the Commission or the City Council that fail-
ure
ure to receive a deletion or a permit in, accordance with Section S
of this ordinance would cause immediate and: substantial hardship to
the owner (s) of the registered historic or scenic property which
was not reasonably foreseeable at the time; the property was placed
upon the Register of Historic and .Scenic Properties.
SECTION 16. Violations. Any violation of the provisions of
this ordinance shall constitute a xftisdemean:or and, upon conviction
thereof, shall be punishable by a fine of not more than $300.00 or
imprisonment in the City Jail or the County Jail of the County of
San Bernardino for a ,period cif, not more than thirty (30) days or by
both such fine and imprisonment,.:
SECTION ll. This ordinance shall be in force and take effect
as provided by law.
SECTION 12. The City Clerk shall certify to the adoption of
this ordinance and cause the same. to be published once in the. Redlands
Daily Facts, a newspaper of general circulation printedand published
in this city.
