AN ORDINANCE OF THE CITY OF REDLANDS ADDING CHAPTER 13.65 TO THE
REDLANDS MUNICIPAL CODE TO ESTABLISH RECYCLING REQUIREMENTS FOR
LARGE VENUES AND EVENTS
The City Council of the City of Redlands does ordain as follows:
Section 1. Chapter 13.65, entitled "Recycling Requirements for Large Venues and
Events is hereby added to the Redlands Municipal Code to read as follows:
"CHAPTER 13.65
RECYCLING REQUIREMENTS FOR LARGE VENUES AND EVENTS
13.65.010 Purpose
13.65.020 Applicability
13.65.030 Large Venue Recycling Requirements
13.65.040 Large Event Recycling Requirements
13.65.010 Purpose of Chapter. The purpose of this Chapter is to establish
requirements for recycling by large venues and events to facilitate the City's compliance
with State recycling mandates, specifically those laws commonly referred to as "AB 2176"
and "AB 839.,,
13.65.020 Applicability. This Chapter shall apply to large venues and events in
conformance with the definitions below:
A. "Individual" means a person who works at, or attends, a large venue or large
event, or a customer who is seated or served at the large venue or large event.
B. "Large event" means an event that charges an admission price, or is operated
by a local agency, and serves an average of more than 2,000 individuals per day
of operation of the event, including, but not limited to, a public, nonprofit, or
privately owned park, parking lot, golf course, street system, or other open space
when being used for an event, including, but not limited to, a sporting event or a
flea market.
C. "Large venue" means a permanent venue facility that annually seats or serves
an average of more than 2,000 individuals within the grounds of the facility per
day of operation of the venue facility. For purposes of this Chapter, a venue
facility includes, but is not limited to, a public, nonprofit, or privately owned or
operated stadium, amphitheater, arena, hall, amusement park, conference or
civic center, zoo, aquarium, airport, racetrack, horse track, performing arts
center, fairground, museum, theater or other public attraction facility. A site
under common ownership or control that includes more than one large venue
that is contiguous with other large venues in the site is considered a single large
venue.
D. "Local agency, means a city or county.
13.65.030 'Large Venue Recyclinq Requirements. The operator of a large venue,
as defined in this Chapter, shall submit for review and approval a completed Recycling
Plan to the Municipal Utilities Director. The Recycling Plan shall be based upon the
application form of the Municipal Utilities. The Recycling Plan shall include the following:
A. Recycling Pian Requirements.
1. Location of containers and compliance with other requirements. The
location of all interior and exterior containers used for the collection of
refuse, green waste and recyclables shall be identified. If a trash compactor
is proposed for use, the design and manufacturer's detail drawings shall be
submitted with the site plan submittal. The plans shall comply with the Solid
Waste Recycling Access Act of 1991, Chapter 13.66 of this Code, and the
solid waste development requirements for the activity and the requirements
of this Code.
2. Interior recycling containers. The Recycling Plan shall include a provision
for interior recycling containers in all work areas to provide convenient
access for recyclables at the point of generation.
3. Employee and public participant education. The Recycling Plan shall
provide an explanation of actions taken to educate the public and
employees regarding the proper separation of recyclables including, but not
limited to, signage, employee meetings, and supervisory monitoring.
4, Adequate capacity. Adequate capacity shall be provided for refuse and
recycling collection. Such requirements shall be based on the volume and
tonnage generated by the venue, as estimated by the City.
5. Equal access to recycling. Recycling and refuse containers, both interior and
exterior, shall be co-located to provide employees and members of the public
with access to recycling that is equivalent to refuse disposal alternatives.
6. Materials to be recycled. The Recycling Plan shall identify materials targeted
for recycling. At a minimum, all materials included in the City's residential
curbside recycling program shall be included. Additional materials may be
required (e.g., wood waste, pallets and inerts.)
7. Meeting with the City. Operators of large venues are required to meet with
the Municipal Utilities Director or their designee on an annual basis to review
recycling requirements and to determine the solid waste and recycling
requirements appropriate for large venues. The City may revise recycling
plans for large venues to reflect changing conditions and markets for
recyclables.
8. Fee collected by the _C The City shall charge a fee established by
resolution of the City Council, for processing and reviewing the initial
Recycling Plan.
B. Reporting Requirements:
1. Annual reporting. On or before July 1 and annually thereafter, each operator
of a large venue shall submit to the City, upon request, written
documentation of waste reduction, reuse, recycling and diversion programs,
if any, implemented at the large venue. If the operator of a large venue did
not implement any part of the approved Recycling Plan, the operator shall
include a brief explanation for the delay as part of its report to the City.
2. Report required within one month of notification. The operator of the large
venue shall submit the requested information to the City no later than one
month from the date the operator receives the request.
13.65.040 Large Event Recycling Requirements. The operator of a large event
shall submit for review and approval a completed Recycling Plan to the Municipal Utilities
Director or their designee as a condition of issuing the event permit. The Recycling Plan
shall be based upon the application form of the Municipal Utilities. The Recycling Plan
shall include the following:
A. Recycling Plan Requirements.
1. Meeting with the City. Operators of large venues are required to meet with
the Municipal Utilities Director or their designee on an annual basis to review
recycling requirements and to determine the solid waste and recycling
requirements appropriate for the large venues.
2. _Recycling area identified. The Recycling Plan shall identify the area for
collecting refuse and recyclables.
3. Number and placement of refuse and recycling containers. The Recycling
Plan shall provide details related to the number and placement of recycling
and refuse containers serving the event.
4. Flow of recyclables and refuse. The Recycling Plan shall identify how refuse
and recyclables shall be collected and transferred to the centralized area
pursuant to section 13.65.040A of this Chapter. The Recycling Pian shall
identify the number of persons and persons (e.g., volunteers, organization
employees and vendors) responsible for collecting and transferring refuse
and recyclables during the event.
5. Materials targeted for recycling. The Recycling Plan shall identify materials
targeted for recycling. At a minimum, all materials included in the City's
residential curbside recycling program shall be included. Additional materials
may be required (e.g., wood waste, pallets, and inerts).
6. Education component. The Recycling Plan shall provide information
regarding signage, printed materials, employee/volunteer meetings or any
other means utilized to educate the public and workers on the proper
separation of recyclables at the event.
7. Approved Recycling Plan as condition for issuing Event Permit. No Event
Permit shall be issued for any large event subject to this Chapter unless the
Recycling Plan has been approved by the Municipal Utilities Director.
B. Reporting Requirements.
1. Upon request, the operator of a large event shall provide the City with a
report on the volume or weight of materials recycled at the event. If the
operator of a large event did not implement any part of the approved
Recycling Plan, the operator shall include a brief explanation for not
implementing that portion of the Recycling Plan in its report to the City.
2. The operator of the large event shall submit the requested information to
the City no later than one month from the date the operator receives the
request.,'
Section 2. The Mayor shall sign this ordinance and the City Clerk shall certify to the
adoption of this ordinance and shall cause it, or a summary of it, to be published once in
the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter
this ordinance shall take effect as provided by law.
