AN ORDINANCE OF THE CITY OF REDLANDS
ADDING CHAPTER 5. 92 TO THE REDLANDS
MUNICIPAL CODE TO ESTABLISH A LITTER
ABATEMENT FEE
WHEREAS, the City Council of the City of Redlands (this
"City Council") has determined that businesses providing food and
drink to patrons for consumption off the premises of the business
contribute to the generation of litter which must be disposed of by
the City; and
WHEREAS, this City Council has determined that such
businesses should pay a fee to defray a portion of the City' s
reasonable cost of disposing of litter generated by their patrons;
and
WHEREAS, the revenues generated by this fee do not exceed
the City's cost in administering its litter collection program; and
WHEREAS, notice of public hearing on the adoption of this
proposed fee has been provided in accordance with Government Code
Section 66018;
NOW, THEREFORE, be it ordained by the City Council of the
City of Redlands as follows:
Section 1. Chapter 5. 92 shall be added to the Redlands
Municipal Code to read as follows:

Section 5. 92 . 010 - Litter Abatement Fee
Section 5. 92 . 020 - Payment of Litter Abatement Fee
Section 5. 92 . 030 - Exceptions
Section 5.92 . 040 - Use of Litter Abatement Fee
Section 5.92 . 010 Litter Abatement Fee.
A. Except as provided in Section 5.92 . 030, the
Litter Abatement Fee established by this Chapter shall be
paid by all businesses (the "Subject Businesses") which
sell food and/or drink for consumption off the premises
of the business.
B. The Litter Abatement Fee shall be in the amount
of $25 for each Subject Business.
C. As used in this Chapter, food and drink shall
include both food and drink prepared on the premises and
prepackaged food and drink.
Section 5. 92 . 020 Payment of Litter Abatement Fee.
A. The Litter Abatement Fee shall be paid at the
same time and as a condition of the receipt of a City
business license issued pursuant to Chapter 5. 04 of this
Code.
B. The person or entity to whom a City business license
is issued shall be responsible for the payment of the Litter
Abatement Fee.
Section 5.92 . 030 Exceptions.
A. All businesses exempted from the business
license fee under Chapter 5. 04 of this Code shall be
exempt from the Litter Abatement Fee.
B. Any business not selling food or drink to its
patrons shall be exempt from the Litter Abatement Fee.
Section 5.92 . 040 Use of Litter Abatement Fee.
The Litter Abatement Fee shall be used by the City to
defray the cost of collecting and removing litter from public
places within the City. "

Section 2 : Section 5. 04 . 217 is hereby added to the
Redlands Municipal Code to read as follows:
of Section 5. 04 . 215 Issuance and Renewal - Payment of
Litter Abatement Fee. As a condition to the issuance or
renewal of a business license, the applicant shall pay a
Litter Abatement Fee pursuant to Chapter 5.92 of the
Code. "
Section 3 . The Mayor shall sign this ordinance and the
City Clerk shall certify to the adoption of this ordinance and
shall cause it, or a summary of it, to be published once the
Redlands Daily Facts, a newspaper of general circulation within the
City, and thereafter, this ordinance shall take effect in
accordance with law.
