HomeMy WebLinkAboutOrdinances_2537_CCv0001.pdf ORDINANCE NO. 2537 AN ORDINANCE OF THE CITY OF REDLAND AMENDING CHAPTER 5.28 OF THE REDLANDS MUNICIPAL CODE RELATING TO MASSAGE PARLORS THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS: Section 1. Section 5.28.050 of the Redlands Municipal Code is hereby deleted in its entirety and rewritten to read as follows: "Section 5.28.050 Permit not required. The provisions of this Chapter shall not apply to the following classes of individuals or businesses engaged in the performance of their duties as outlined herein: A. Hospitals,nursing homes, sanitariums or any other health care facilities duly licensed by the State of California; B. Accredited high schools,junior colleges and colleges or universities whose coaches or trainers are acting within the scope of their employment; C. Trainers of amateur, semiprofessional or professional athletes or athletic teams while engaging in their training responsibilities for and with athletes; and trainers working in conjunction with the specific athletic event such as an outdoor road or bike race; D. Cosmetologists, barbers and persons licensed to practice any healing art pursuant to Division 2(commencing with section 500)of the Business and Professions Code or the Chiropractic Act when engaging in the practice of massage within the scope of his or her license who solely massage the neck, face and/or scalp of their customers." Section 2. Section 5.218.051 is hereby added to the Redlands Municipal Code to read as follows: "Section 5.28.051. Application of Chapter to independent contractors in the business of massage. Notwithstanding any other provision of law, this Chapter shall apply to an independent contractor of any person described in Section 5.28.050(D),if the independent contractor is engaged in, or is purported to be engaged in, the business of massage." Section 3. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in the Ivif,2'±37 Massae Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this ordinance shall take effect as provided by law.
