AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF REDLANDS AMENDING THE REDLANDS ORDINANCE
CODE AND ORDINANCE NO. 1562 TO PROVIDE FOR
VOLUNTARY MERGER OF CONTIGUOUS PARCELS
THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain as follows :
SECTION ONE: That Chapter 92 of the Redlands Ordinance Code and
Ordinance No. 1.562 of the City of Redlands shall be and is hereby
amended by adding Section 2.9. 5 thereto as follows :
SECTION 29. 5
Four or fewer contiguous parcels under common ownership may
be voluntarily merged without reverting to acreage pursuant
to Section 66499. 20 3/4 of the California Government Code,
provided that the merger is approved by the Community
Development Administrator and a notice of merger is recorded
with the County Recorder. Applications to merge contiguous
parcels shall be made to the Community Development Adminis-
trator on forms provided by the Community Development and
Planning Department, accompanied by a nonrefundable fee to
be determined by the City Council and the following:
1. An exhibit, drawn to scale, delineating the existing
boundaries of the parcels to be merged and the location
of existing structures and easements.
2. Copies of grant deeds for the existing parcels.
3 . An exhibit, drawn to scale, delineating the boundaries
of the parcel after the merger.
4 . A legal description of the new parcel as merged.
5. Preliminary title report.
6 . Written consent of all owners of record interest.
The Community Development Administrator shall transmit a
completed application to the City Engineer for review and
recommendation and shall grant approval of the request for
merger if:
1. The City Attorney has determined that the parcels to be
merged are, at the time of merger, under common owner-
ship and written consent has been obtained from all
record owners.
2. The parcel as merged will be consistent with the zoning
of the property, or will be closer to satisfying zoning
requirements than would the individual parcels without
merger.
3 . The parcel as merged will be appropriate in size and
dimension for the location of any existing structures
on the property.
4. The parcel as merged will not be deprived of access as
a result of the merger.
5. Access to the adjoining unmerged parcels will not be
restricted by the merger.
6. No new lot lines are created through the merger.
The Community Development Administrator shall submit to the
County Recorder for recordation the notice of merger and
attached legal description and exhibits within 20 days after
it has been approved by the Community Development Administrator.
SECTION TWO: This ordinance is enacted pursuant to California
Government Code Section 66499. 20 3/4 and shall be in force and take
effect as provided by law.
SECTION THREE: The City Clerk shall certify to the adoption
of this ordinance and cause it to be published once in the Redlands
Daily Facts, a newspaper of general circulation printed and published
in the City of Redlands.
