AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS
AMENDING ORDINANCE NO. 1857 AND FURTHER AMENDING CHAPTER 5.48 OF
THE REDLANDS MUNICIPAL CODE PERTAINING TO RENT STABILIZATION FOR
MOBILEHOME PARKS
WHEREAS, Ordinance No. 1857 of the City of Redlands, as subsequent-
ly amended and as now codified in Chapter 5.48 of the Redlands Municipal
Code, declared that a serious shortage of mobilehome park rental space
within the City created a virtual monopoly in the mobilehome rental
market; imposed a procedure for stabilizing mobilehome park rent
increases which exempted parks constructed after October 1 , 1981; and
provided that the rent stabilization procedure would automatically
terminate on December 31, 1989, unless further extended by ordinance
adopted by the City Council; and
WHEREAS, since October 1 , 1981, two new mobilehome parks have been
constructed within the City, but these parks failed to alleviate the virtual
monopoly in the parks which existed on October 1 , 1981, because (a) one of
the two new parks will accommodate only new mobilehome units purchased
from within that park; (b) the other new park is almost completely
occupied already and would not accommodate many of the units currently
situated in the parks that existed on October 1, 1981; and (c) the cost of
moving a mobilehome unit from an older park to one of the new parks is
prohibitive for many of the tenants in the older parks; and

WHEREAS, the owners of the mobilehome parks which existed on
October 1, 1981, have nonetheless convinced this City Council that there is
good cause to immediately permit an exemption for rental spaces upon a
change in tenancy or a sublease because a new tenant or subtenant can
negotiate space rent at arm' s length, unlike an existing tenant who may
not be in a position to reject a rent increase demanded by the park owner;
and
WHEREAS, the automatic termination of Ordinance No. 1857 on
December 31, 1989, renders it necessary to adopt this Ordinance,
extending the life of the City's mobilehome park rent stabilization
procedure, as an urgency measure in order to avoid the disruption in
public peace, health and safety that would result from a temporary
suspension of that procedure;
BE IT ORDAINED by the City Council of the City of Redlands as
follows:
SECTION ONE: Section 5.48.120 of the Redlands Municipal Code is
hereby amended to provide as follows:
5.48.120 Vacancies and Subleases.
When a tenant of a mobilehome space in any affected
park vacates or subleases that space, the park owner shall be
free to negotiate a new rent to be charged for that space
without reference to the restrictions set forth in this chapter;

provided, however, that the adjusted space rent shall then be
deemed the new base rent for that space which thereafter may
be adjusted only pursuant to the procedure set forth in this
chapter.
SECTION TWO: Section 5.48. 130 of the Redlands IN-4unicipal Code is
hereby repealed.
SECTION THREE: Section 5.48. 140 of the Redlands Municipal Code is
hereby renumbered as Section 5.48.130.
SECTION FOUR: Section 37414 of Ordinance No. 1857 is hereby
repealed and Section 5.48.140 is hereby added to the Redlands Municipal
Code to provide as follows:
5.48.140 Repeal or Amendment.
The provisions of this chapter shall remain in effect
only until December 31, 1994, unless extended by ordinance duly
adopted by the City Council of the City of Redlands.
SECTION FIVE: This ordinance shall be adopted as an urgency
measure based upon the facts declared in the recitals hereto, and shall
take effect immediately upon adoption.
SECTION SIX: The City Clerk shall certify to the adoption of this
ordinance and cause it, or a summary of it, to be published in the

Redlands Daily Facts, a newspaper of general circulation printed
and published in the City.
