HomeMy WebLinkAboutOrdinances_1756_CCv0001.pdf ORDINANCE NO. 1756 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1000 OF THE CITY OF REDLANDS BY ADOPTING AMENDMENT NO. 155 THERETO THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain as follows : SECTION ONE: That Ordinance No. 1000 of the City of Redlands, Section 48. 00, Moving of Building Procedure, be hereby amended as follows: SECTION 48 . 00: MOVING OF BUILDINGS PROCEDURE The moving of any building or structure onto a lot shall require the filing of an application for Commission approval and payment of a fee as set by the City Council. (a) Application The following information shall be filed with the application for a permit to move a building or structure: 1. Location and address of the site proposed for placement of the building or structure. 2 . Site plan prepared to scale with complete dimensions showing all buildings and structures proposed and existing for the parcel including the location of all structures and improvements on adjacent lots. 3. Plans and specifications for other proposed improvements for the site including accessory buildings, walls, fences, and landscaping treatment. 4 . Architectural elevations or photographs of all sides of the buildings or structures to be moved or constructed on the site. 5. Definition of the route of travel for the building(s) to be moved. (b) Eligibility of Structure to be Moved Upon the filing of an application, the Director of Building and Safety shall make an inspection of the building or structure to be moved to determine its capability of compli- ance with Uniform Building Code standards, State of California, Department of Housing and Community Development Factory Built Home Standards , or certification under the National Mobile Home Construction and Safety Standards Act of 1974 (42 U.S.C . Section 5401, et seq. ) on a foundation system, pursuant to Section 18551 of the California Health and Safety Code. (c) Commission Findings Before the Commission may approve the application for moving of a building or structure, there shall be a finding that said moving shall have no detrimental effect on the living environment and that the structure to be moved is compatible with existing development in the area into which the structure is to be moved. (d) Conditions The Commission may set forth conditions deemed necessary to support the necessary findings . Such conditions may include: I . Special yards, spaces , and setbacks . 2. Fences and walls. 3. Regulation of vehicular ingress and egress points. 4 . Required landscaping and maintenance thereof. 5. Regulation of signs . 6. Regulation of noise, vibration, odors, and lights. 7. Regulation of exterior walls and roofing materials. 8. Required parking. 9. Minimum width and floor area of buildings or structures. 10. Architectural modifications, including roof pitch and overhang. 11. And such other conditions as will make possible the development of the City in an orderly and efficient manner and in conformity with the intent and purposes set forth in this ordinance. (e) Public Hearing Date and Notice 1. A public hearing shall be held by the Planning Commission on the nearest scheduled meeting date not less than twenty-one (21) days after the filing of the application. 2. Notices shall be mailed not less than five (5) days prior to the date of the meeting to owners of property within a radius of three hundred (300) feet of the external boundaries of the property described in the application, using for this purpose the name and address of such owners as are shown on the latest official tax roll of the County of San Bernardino . Such notice shall contain all pertinent data related to the case. (f) Decisions by Commission The decision of the Commission shall be final unless an appeal therefrom is taken to the Council as provided for in Paragraph (g) . Ordinance No. 1756 - Page two (g) Appeal of Commission Decision 1. Appeals may be taken to the Council, by the applicant or any other person aggrieved by the Commission's decision. 2. Appeals shall be filed on forms supplied by the Planning Department with the Council within ten (10) days from the date of the Commission decision or at the next regular Council meeting following the Planning Commission meeting. 3. On the appeal, the Council shall review the decision of the Commission, hear new evidence and testimony, if offered, and in deciding the appeal may either affirm, reverse, or modify the decision of the Commission. 4. The Council may, on its own Motion, cause any Commission decision to be appealed. (h) Issuance of Building Permit Before a building permit may be granted, there shall be a posting of a cash bond with the City Treasurer in an amount as determined by the Building Director and the Public Works Director to cover costs of the activities involving the City, and the expenditures involved in complying with the conditions related to improvements of the property which may have been established in the granting of the permit. The bond shall also cover the costs involved in cleaning up a vacated site and restoring it to a safe and sightly condition. SECTION TWO: This ordinance shall be in force and take effect as provided by law. SECTION THREE: The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation pr-i - ted and published in this city.
