HomeMy WebLinkAboutOrdinances_1436_CCv0001.pdf ORDINANCE NO. 1436 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA DECLARING THE NEED FOR A REDEVELOPMENT AGENCY IN THE CITY OF REDLANDS AND DECLARING THE CITY COUNCIL TO BE THE AGENCY WHEREAS , Section 33100 of the Community Redevelopment Law {Health & Safety Code Sections 33000 et seq. } created in the City of Redlands a public body corporate and politic for the purpose of exercising the powers granted by the Community Redevelopment Law, but provided, pursuant to Section 33101 thereof, that said public body corporate and politic shall not transact any business or exer- cise any powers unless, by ordinance, the City Council of the City of Redlands declares there is a need for such agency to function; and WHEREAS , there exist within the City of Redlands , California, blighted areas as defined in Chapter 1, Article 3, of Part 1, Divi- sion 24, of the California Health and Safety Code, which Part I of said Division 24 of said Code is known as the Community Redevelop- ment Law; and WHEREAS , Section 33101 of the Community Redevelopment Law pro- vides that the provisions for redevelopment provided by said Law shall not become operative in any community until the legislative body of the community declares by ordinance that there is need for a Redevelopment Agency to function: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS : SECTION 1. It is hereby found and declared, pursuant to Sec- tion 33101 of the Community Redevelopment Law, that there is a need for the Redevelopment Agency created by Section 33100 of said Law to function in the City of Redlands, and said Agency is hereby au- thorized to transact business and exercise its powers under the Com- munity Redevelopment Law. SECTION 2. Pursuant to the provisions of Section 33200 of the Community Redevelopment Law, the City Council hereby declares it- self to be the Redevelopment Agency of the City of Redlands, and that all the rights, powers, duties , privileges and immunities vested by the Community Redevelopment Law in said agency shall be, and are, vested in this City Council as said Agency. SECTION 3 . The City Council hereby appoints the Mayor as Chairman of said Agency; the Vice-Mayor as Vice-Chairman of said Agency, to perform the duties of the Chairman during his absence or disability; and that the terms to be served by the members of said Agency shall correspond to the terms so served as members of the City Council . SECTION 4. This ordinance shall be in force and effect as provided by law. SECTION 5. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once in the Redlands Daily Facts, a daily newspaper designated for that purpose. ,f. ayor of the City Redlands A'T'TEST: f Cs_ erk f APPROVED FOR FORM: sf Edward F.
