HomeMy WebLinkAboutOrdinances_2041_CCv0001.pdf ORDINANCE NO. 2041 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 3. 24 OF THE REDLANDS MUNICIPAL CODE RELATING TO TRANSIENT OCCUPANCY TAXES WHEREAS, the City Council of the City of Redlands ( "this City Council" ) has adopted Resolution No . 4390 which submitted to the qualified voters of the City of Redlands a proposal to increase the City' s Transient Occupancy Tax from five percent ( 5% ) to nine percent ( go ) on hotels within the City for the purpose of raising revenue for visitor and cultural promotion; and WHEREAS, at a special municipal election held on November 8 , 1988, the proposal to increase the City ' s Transient Occupancy Tax was approved by the affirmative vote of at least two-thirds of the votes cast upon the proposal ; and WHEREAS, it is the desire of this City Council to increase the City' s Transient Occupancy Tax in accordance with the approval of the voters of the City; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: SECTION 1 . Section 3 . 24 . 100 of the Redlands Municipal Code is hereby amended to read as follows : "3 . 24 . 100 Imposition. For the privilege of occupancy in any hotel , each transient is subject to and shall pay a tax in the amount of nine percent of the rent charged by the operator . Such tax constitutes a dept owed by the transient to the City which is extinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments , a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient ' s ceasing to occupy space in the hotel . If for any reason the tax due is not paid to the operator of the hotel , the City may require that such tax shall be paid directly to the City' s Treasurer. " SECTION 2 . The Mayor shall sign this Ordinance and the City Clerk shall attest thereto and it, or a summary of it , shall be published once in the Redlands Daily Facts , a newspaper of general circulation within the City and thereafter this Ordinance shall take effect according to law.
