AN ORDINANCE AUTHORIZING A PUBLIC
EMPLOYEE TO ISSUE INFRACTION CITATIONS
FOR VIOLATIONS OF ORDINANCE NO. 1000 OF
THE CITY OF REDLANDS
THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain:
SECTION 1 . Section 54 . 25 is hereby added to
Ordinance No. 1000 of the City of Redlands, the Zoning
Ordinance, and is to provide as follows :
SECTION 54 . 25 : ENFORCEMENT.
It shall be the duty of the Redlands
Police Department and the City Services
Representative of the Community Development
Department to enforce the provisions of this
Ordinance.
SECTION 2 . Section 54 . 50 is hereby added to
Ordinance No. 1000 of the City of Redlands Ordinance, the
Zoning Ordinance, and is to provide as follows :
SECTION 54. 50 : ISSUANCE OF CITATIONS BY
DESIGNATED OFFICERS AND EMPLOYEES.
The City Services Representative of the
Community Development Department who has the
discretionary duty to enforce the provisions
of Ordinance 1000 , is hereby authorized by the
City Council, pursuant to Sections 832 , 835 . 5
and 19d of the California Penal Code and
subject to the provisions thereof, to arrest a
person without warrant whenever the City
Services Representative has reasonable cause
to believe that the person to be arrested has
either violated a provision of Ordinance
No. 1000 in the City Services Representative ' s
presence or fails to correct a violation of
Ordinance No. 1000 and therefore has committed
an infraction which the City Services Repre-
sentative has the discretionary duty to
enforce .
The City Services Representative is
further authorized by the City Council to
issue a NOTICE TO APPEAR and to release such
person on his or her written promise to appear
in court, pursuant to Sections 853 . 5 and 853 . 6
of the California Penal Code. Under no
circumstances may the City Services Represen-
tative take the person to be arrested into
custody. In the event that the person to be
arrested demands to be taken before the
magistrate or refuses to provide his or her
written promise to appear in court, the City
Services Representative must either summon a
Redlands Police officer , explain the
situation, and request that the Redlands
Police officer arrest the person, and take the
person into custody, or seek the assistance of
the City Attorney, and request that an
infraction complaint be prepared and filed
against that person.
In addition to the mandatory course of
training prescribed by the Commission of Peace
Officers standards pursuant to Section 832 of
the California Penal Code, the Chief of
Redlands Police Department shall establish and
cause to be administered a special enforcement
training program designed to instruct the City
Services Representative regarding provisions
of this Ordinance to be enforced, the
evidentiary prerequisites to proper prosecu-
tion for violations thereof, the appropriate
procedures for making arrests or otherwise
prudently exercising such arrest and citation
authority, and limitations attendant
thereto. The City Services Representative
shall be appropriately instructed to file
executed citations within the Department of
Community Development and such citations shall
be filed with the Court .
SECTION 3 . This Ordinance shall be in force and
take effect as provided by law.
SECTION 4 . The City Clerk shall certify to the
adoption of this Ordinance and cause it or a summary of it
to be published once in the Redlands Daily Facts, a

newspaper of general circulation printed and published in
this City.
