HomeMy WebLinkAboutOrdinances_2193_CCv0001.pdf ORDINANCE NO. 2193 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 12.44 OF THE REDLANDS MUNICIPAL CODE RELATING TO PUBLIC PARKS WHEREAS, Article XI, Section 7 of the California Constitution empowers cities to make and enforce within their limits all local police, sanitary and other ordinances not in conflict with general laws; and WHEREAS, pursuant to such authority the City has adopted park regulations prohibiting persons from staying or remaining in public parks between the hours of eleven p.m. and seven a.m. of the following day and prohibiting the consumption of alcoholic beverages in public parks without permission of the City; and WHEREAS, the City Council of the City of Redlands ("this City Council") has determined that a change in park operating hours would help seduce criminal activity in City parks; and WHEREAS, this City Council has also determined that the prohibition of the consumption of alcohol beverages in open areas of City parks is in the best interests of the health, safety, and welfare of the citizens of Redlands; and WHEREAS, this City Council has further determined that all persons should be subject to the city's fee schedules for the reservation of park facilities; BE IT ORDAINED by the City Council of the City of Redlands as follows; Section-1. Section 12.44.250 of the Redlands Municipal Code is hereby amended to read as follows: "12.44.250 Park Hours. No person shall stay or remain in any public park between the hours of nine p.m. and five a.m. of the following day without permission of the Director. The provisions of Sections 12.44.100 and 12.44.110 shall govern the granting or denial of such permission." tion 2. Section 12.44.270 of the Redlands Municipal Code is hereby amended to read as follows: 12.44.270 Consumption of alcoholic beverages. No person shall drink or consume any alcoholic beverages or liquors in any open area of any public park. A person may drink or consume alcoholic beverages or liquors in public parks only in enclosed public areas as defined by resolution of the City Council pursuant to a written permit from the Director." Section 3. Section 9.16.020 of the Redlands Municipal Code is hereby amended to read as follows: "9.16.020 Drinking on public street. It is unlawful for any person within the City to drink or consume any intoxicating liquor upon any public street, highway, road, alley or lane, whether public or private within the City." Section 4. Section 12.44.290 of the Redlands Municipal Code is hereby amended to read as follows: "12.44.290 Reservation -- Without formal permit. A. Groups of less than fifty (50) persons desiring the use of park areas or structures may request the Director to reserve designated park areas for such use. All persons reserving picnic areas shall be subject to the fee schedules applicable to these reserved areas. B. If the Director is satisfied from the information presented to him that the desired area may be reserved for the intended use without unreasonably interfering with the use of the park by other persons and without disturbing the peace of the surrounding neighborhood, he may grant a reservation upon such conditions as he deems necessary. The Director will issue reservation forms as necessary to verify the granting of such reservations. C. If for any reason the Director is not satisfied as to the reasonableness of the proposed activity in relation to the use of the park by other persons, or an as to the effect of such use upon the peace of the neighborhood, or if he finds that he is unable to agree with the person requesting the reservation as to conditions to be imposed, he shall ask the person to fill out a request for formal permit in accordance with the procedures in Sections 12.44.300 through 12.44.360." 2 Section 5. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and cause it, or a summary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in the City; and thereafter, this ordinance shall take effect in accordance with law.
