HomeMy WebLinkAboutOrdinances_1628_CCv0001.pdf ORDINANCE NO . 1628 AN ORDINANCE OF THE CITY OF REDLANDS RESCINDING ARTICLE 515 OF THE REDLANDS ORDINANCE CODE AND ORDINANCE NO. 1005 THE CITY COUNCIL OF THE CITY OF REDLANDS HEREBY ORDAINS AS FOL- LOWS : SECTION ONE: That the Redlands Ordinance Code be amended by sub- stituting an entirely rewritten Article 515, Pin Ball Machines, reading as follows : ARTICLE 515 PIN BALL MACHINES 51500 . PIN BALL MACHINES FOR PURPOSES OF GAMING PROHIBITED. It shall be unlawful for any person, firm, or corporation to keep, main- tain, possess, or have under control in any place whatever, either as owner, lessee, agent, employee, mortgagee or otherwise, any table game or device commonly known as a "pin ball machine, " "pin game, " or "marble game" or similar device by whatever name known, the operation, use or play of which is controlled by placing therein any coin, plate, disk, plug, token, key, or other device, or by the payment of any fee, upon the result of action of which money or some other valuable thing or both is staked or hazarded, and upon the result of operation of which any merchandise, money, representative or articles of value, checks, or tokens, redeemable in, or exchangeable for money or some other valuable thing or both is won or lost, or taken from or obtained from such machine . 51501 . NUISANCE. Any machine, contrivance, appliance, device, game, instrument, or article kept, maintained, possessed or controlled in violation of Section 51500 is hereby declared to be a nuisance and shall be subject to abatement as provided in Section 51502 . § 51502 . DESTRUCTION OF PIN BALL MACHINES FOR PURPOSES OF GAMING. Any machine, contrivance, appliance, device, game, instrument, or article declared in Section 51501 to be a nuisance, as a result of a violation of Section 51500, of which violation any person, firm, or corporation has been convicted or has pleaded guilty, shall be destroyed with its contents by the Chief of Police of this city after such plea or after judgment of conviction becomes final, and if the said nuisance contains any currency or coin, such monies shall be deposited in the general fund of this city. 5 51503 . APPLICATION BY CHIEF OF POLICE TO ANY COURT FOR SECURING OF MACHINE FOR DESTRUCTION. The Chief of Police of this city shall apply to any court after a plea or judgment of conviction becomes final for a violation of Section 51500 of this chapter, and within ninety (90) days after such judgment shall apply to said court for re- lease of such nuisance to him for destruction. 51504. PENALTY UNDER STATE LAW. Any person, firm, or cor- poration violating any provision of Section 51500 of this chapter shall be deemed guilty of a misdemeanor under Section 330a of the Penal Code of the State of California and upon conviction thereof shall be punish- able by a fine of not more than five hundred dollars ($500 .00) or by imprisonment in the county jail for a period of not more than six months or by both such fine and imprisonment. 5 51505 . CITY MAY ENJOIN VIOLATION. The City of Redlands may bring an action in court of competent jurisdiction to enjoin a violation of Section 51500 of this chapter or Section 330a of the Penal Code of the State of California. 51506. PIN BALL MACHINES EXEMPT FROM THE PROVISIONS OF THIS CHAPTER. Exempt from the provisions of this chapter are pin ball and other amusement or entertainment machines which are predominately games of skill and afford to the players only additional chances or free plays and never money or some other thing of value or both. SECTION TWO : This ordinance shall be in force and take effect as provided by law. SECTION THREE: The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in the City of Redlands .
