HomeMy WebLinkAboutOrdinances_1999_CCv0001.pdf ORDINANCE NO. 1999 AN ORDINANCE OF THE CITY OF REDLANDS EXEMPTING CERTAIN PROPERTY FROM DEVELOPMENT RESTRICTIONS IN THE SOUTHEAST REDLANDS AREA WHEREAS, the City Council of the City of Redlands ( "this City Council" ) has undertaken the preparation of a specific plan for the Southeast Redlands area, as delineated in Exhibit "A" attached hereto and incorporated herein by this reference, to allow for land uses which take into account the circulation, drainage, sewage disposal , fire flow and water supply problems in the Southeast area, all of which pose a threat to the public health, safety and general welfare of the citizens of Redlands; and WHEREAS, pursuant to California Government Code Section 65858 , this City Council has adopted as an urgency measure an interim ordinance establishing development restrictions and prohibiting land uses which may be in conflict with the proposed specific plan; and WHEREAS, this City Council and the city ' s Planning staff have determined that certain exceptions may be made to these development restrictions without damaging the City ' s ongoing planning effort, the environment, or the public health, safety or general welfare; THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain: SECTION ONE: The subdivision project proposed to be constructed pursuant to Conditional Use Permit No. 454 in the Southeast Redlands Area is hereby exempted from the prohibitions of Ordinance No. 1959 , as amended. This City Council finds and determines that the City' s review and approval process for the project at the environmental assessment, conditional use permit and tentative tract stages allows for adequate consideration and mitigation of the traffic and circulation, drainage, sewage disposal , fire flow and water supply concerns identified in Ordinance No. 1959 . The City Council further finds that the project contains several elements which are complementary to the policy recommendations contained in the draft Live Oak Canyon (Southeast Area) General Plan amendment and which therefore support exemption of this project. These elements include: A. Limited grading of their project site (only 30 to 35% of the 60 acre site of the project is proposed to be graded) , B . Maintenance of a signature ridge, C. The provisions of adequate fire access employing an extension of Fairmont Drive as a fire road, and D. Provision for the extension of a street circulatory system, water and other facilities to the projects site. SECTION TWO: This urgency ordinance shall go into effect immediately and remain in effect in accordance with the provisions of California Government Code Section 65856 . SECTION THREE: The City Clerk shall certify to the adoption of this ordinance and shall cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in the City .
