D r The Board of Administration, PublicEmployees' Retirement System, rcina e-11 referred to as Board, and he CITY COUNCIL of the CITY CV FEWA DS, h rcinaf t i re- ferred to as Public Agency, having entered into a. contract under date of Jure 1, 1945, effective July 1, :945,, and as amended effective January 1, 1953 and August I 1956, March 1, 1957, January 1, 1560, August 1:, 1961, January 1, 1969 and August 16, 1969, and as provided by Chapters 1.7and 316, Statutes of 1971, which provide ;for participation of Public Agency in said System, Board and; Public Agency hereby agree as follows A. Paragraphs 1 through 9 are hereby stricken from said contract s executed effective July 1, 194 and are hereby replaced by, the following paragraphs numbered 1 through inclusive: .. All words and terms used herein Fhich are defined in the Public Employees' Retirement Law shall have the meaning as defined therein unless otherwise specificallyrov'ide+"1� "Normal retirement age" shall mean age 60 for -miscellaneous Group :gib members, age 60 for miscellaneous Group B members and age 55 for local safety members. 2. Public Agency shall participate in the Public Employees' Retirement System from and after July 1. 1.945, making its employees as herein- after provided, ncrbers of said System subject to all: provisions of the Public m lo-,ye s' Retirement Law e:>cep t such as apply only on election of a contracting aCe nc;yr and are not provided for hereln. and to all amendments to said, Law hereafter enacted except such as by express provisions thereof apply only on the election of contract- ing agencies, 3. Employees of Public Agency in the following classes and groups shall become members of said Retirement System except such in each such class and group as are excluded by law or this agreement: a. Local f:z.reven herein referred to as local safety eab rs) b, Local policemen (herein referred to as local, wafer members); c Employees other than local safety �:: er s whose positions are not subject to Federal Social Security coverage herein referred to as miscellaneous Croup ,: members) d. Employees other than local safety members hose positions are subject to Federal Social Security coverage herein referrer Ir t��+$��Ek}. The followinZ provisions shill apply to miscellaneous Group A members and local safety members. a. The fraction of final compensation to be provided, for each year of credited prior and current service as a miscellaneous Group A member upon retirement at normal retirement age shall be 1/50_ and shall be applies as provided in Section 21251.13 of said Retirement Law. b. The fraction of fiscal compensation to be provided for each year of credited prior and current service as a local safety member shall be determined in accordance with Section. 21252.1 of said Retirement Law'. c. Contribution rates of miscellaneous Groep A members and local~ safety members shallbe subject to Sections 20603 and 20602, respectively. d. The following provisions of the public Employees' Retirement LaVI whichapplyonly upon election of a contracting; agency shall apply: 1) Section 20952.5` (providing for ale 50 as the minimum volun- tary ol:u r-Lary retirement age for local safety mem ers with benefit payments commencing prior to age 55 subject to actuarial discount). • The following provisions shall_ apply to miscellaneous Group L members only. a.. The effectivity= of membership in Group R shall be January 1, 1956 r later entry into employment as a miscellaneous member. b. The retirement benefits payable upon retirement for ordinary disability shall not be affected by the modification provided in paragraph 5 c) of this contract as amended except that for the purposes of the limit on any such allowance imposed for service shill be computed according to the modified formula set out in paragraph 5 (c) of the contract as ,amended.. all other provisions of this contract shall be fully applicable to the computation of allowances upon retirement for disability.. e. Contribution rates of miscellaneous Group B members shall be sub Ject to Section ';'603 providing for a reduction in rates of contribution as such rates relate to the first 0400 of monthly compensation and 100§ of such, rates as they apply to the re- mainder of monthly compensation. f. :the followiSg additional provisions of the PublicEmployees'` Retirement Law which apply only upon election of a contracting agency shall apply to Group B members: 'l) That portion of Section 21251-13 which provides for reduction in the percentage of final compensation for members covered under Social Security. .
