AN ORDINANCE OF THE CITY OF REDLANDS ADDING SECTION 9.16.040 TO
THE REDLANDS MUNICIPAL CODE RELATING TO URINATING AND
DEFECATING IN PUBLIC
WHEREAS, the citizens of Redlands have become increasingly concerned with people
urinating and defecating in public; and
WHEREAS, local governments have the authority to establish minimum requirements for
property maintenance to protect the health, safety and welfare of the comn3eunity; and
WHEREAS, the City Council of the City of Redlands hereby finds that urinating and
defecating in public has an adverse affect on the health, safety and welfare of the citizens of this City;
FOLLOWS: THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS
Section 1. Section 9.16.040, entitled "Urinating and defecating in public prohibited," is hereby
added to the Redlands Municipal Code to read as follows:
"9.16.040 Urinating and defecating in public prohibited.
A. It is unlawful for any person to urinate or defecate in public, other than when using a
toilet, urinal or commode located in a restroom, bathroom or other structure enclosed from
public view.
B. Proof of a verified medical condition that causes an individual to lack control of the
bodily functions that control urination or defecation is a defense to a violation of this section."
Section 2. The provisions of this ordinance are severable, and if any sentence, section or other
part of this ordinance should be found to be invalid, such invalidity shall not affect the remaining
provisions, and the remaining provisions shall continue in full force and effect.
Section 3. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption
of this ordinance and cause it, or a summary of it, to be published once in the Redlands Daily Facts, a
newspaper of general circulation within the City, and thereafter, this ordinance shall take effect in
accordance with law.
