HomeMy WebLinkAboutOrdinances_1916_CCv0001.pdf ORDINANCE NO. 1916 AN ORDINANCE AMENDING SECTIONS 2102 . 3, 51600, 51601 , 51602 , 51605, 51605 . 1 , 51606 AND 51615, REPEALING SECTION 2321 AND ARTICLE 652 , AND ADDING SECTION 65103 TO THE REDLANDS ORDINANCE CODE (RECODIFICATION PROJECT) THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS: SECTION 1 . Section 2102 . 3 of the Redlands Ordinance Code is hereby amended to read as follows; Sec. 2102. 3 . CONTRACTOR AND SUBCON- TRACTOR DEFINED. The terms ' contractor ' and ' subcontractor ' as used in Chapters 21 and 22 shall be defined to include all contractors and subcontractors subject to the provisions of the Contractor ' s License Law, beginning with Section 7000 of the Business and Professions Code, as amended from time to time. SECTION 2 . Section 51600 of the Redlands Ordinance Code is hereby amended to read as follows; Sec. 51600 . DEFINITIONS. (a) Nonprofit organization. An organization exempted from the payment of bank and corporation tax by Sections 23701x, 23701b, 23701d, 2370le, 23701f, 23701g, and 237011 of the Revenue and Taxation Code . (b) Minors . Minors are all persons defined as such by Civil Code Section 25 . 1 . (c) Bingo. As used in this article, bingo means a game of chance in which prizes are awarded on the basis of designated numbers or symbols on a card which conform to numbers or symbols selected at random, and shall include cards having numbers or symbols which are concealed and preprinted in a manner providing for disbursement of prizes . (d) Prizes. Prizes mean cash, kind, or both for each separate game which is held. SECTION 3 . Section 51601 of the Redlands Ordinance Code is hereby amended to read as follows: Sec. 51601 . LICENSE REQUIRED. No person other than a nonprofit organization may conduct bingo games . A nonprofit organization may conduct bingo games only after having first obtained a license from the City Treasurer pursuant to this article, and provided that the receipts of such games may be used only for charitable purposes. SECTION 4. Section 51602 of the Redlands Ordinance Code is hereby amended to read as follows : Sec. 51602 . LICENSE FEE. A license fee of $50 . 00 annually shall be payable upon the filing of an application for license or for renewal of a license. If an application for a license is denied, the applicant shall receive a refund of $25 . 00. SECTION 5 . Section 51605 of the Redlands Ordinance Code is hereby amended to read as follows : Sec. 51605 . OPERATION OF BINGO GAME. A bingo game shall be conducted only on property owned or leased by the nonprofit organization, or property whose use is donated to the organization, and which property is used for such organization for an office or for performance of the purposes for which the organization is organized. The bingo game shall be operated and staffed only by members of the nonprofit organization which -2- organized the game. Such members shall not receive a profit, wage, or salary from any bingo game. Only the organiza- tion licensed to conduct the bingo game shall do so. No bingo game may be conducted between the hours of 2 : 00 a.m. and 6: 00 a .m. , or may last more than five hours in any twenty-four hour period. The number of bingo session may not exceed ten such session in any calender month. SECTION 6. Section 51605 . 1 of the Redlands Ordinance Code is hereby amended to read as follows : Sec. 51605. 1. ALCOHOL BEVERAGE. The consumption or possession of alcoholic beverages shall be prohibited in any room being utilized to conduct the bingo game. SECTION 7 . Section 51606 of the Redlands Ordinance Code is hereby amended to read as follows: Sec. 51606 . FINANCIAL INTEREST. No individual , corporation, partnership, nor other person or legal entity except the organization licensed to conduct a bingo shall hold a financial interest in the conduct of the bingo game. However , this shall not preclude the employment of security personnel who are not members of the licensed organization at such game by the organization conducting the game. SECTION 8. Section 51615 of the Redlands Ordinance Code is amended by deleting subparagraph (d) thereof and relettering the subsequent subparagraphs accordingly. SECTION 9 . Section 2321 of the Redlands Ordinance Code is hereby repealed. SECTION 10 . Article 652 of the Redlands Ordinance Code is hereby repealed . -3- SECTION 11 . Section 65103 is hereby added to the Redlands Ordinance Code, as follows : Sec. 65103 . INSURANCE. Before a permit shall issued by the City Clerk , the applicant shall provide proof of ability to respond in damages as required by Chapter 4 of Division 7 of the California Vehicle Code. SECTION 12 . This ordinance shall be in force and take effect as provided by law. SECTION 13 . The Mayor shall sign this ordinance, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published once in Redlands Daily Facts, a newspaper of general circulation printed and published in this city.
