HomeMy WebLinkAboutOrdinances_1917_CCv0001.pdf ORDINANCE NO. 1917 AN ORDINANCE AMENDING SECTIONS 67011 , 67012, 67014 , AND 68600. 3 OF THE REDLANDS ORDINANCE CODE TO CONFORM TO THE CALIFORNIA VEHICLE CODE (RECODIFICATION PROJECT) THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS: SECTION 1 . Section 67011 of the Redlands ordinance Code is hereby amended to read as follows : 1167011 . 'OFFICIAL TRAFFIC CONTROL SIGNALS' shall mean any device, whether manually, electrically, or mechanically operated by which traffic is alternately directed to stop and proceed, and which may be equipped with a flashing feature which when operated discontinues normal signal operation and causes the flashing of any predetermined combination of signal lights, and which is erected by authority of a public body or official having jurisdiction. " SECTION 2. Section 67012 of the Redlands Ordinance Code is hereby amended to read as follows : "67012. 'OFFICIAL TRAFFIC CONTROL DEVICES' shall mean all signs, signals, markings and devices not inconsistent with this ordinance, placed or erected by authority of a public body or official having jurisdiction for the purpose of regulating, warning or guiding traffic, but shall not include islands, curbs, traffic barriers, or other roadway design features . " SECTION 3 . Section 67014 of the Redlands Ordinance Code is hereby amended to read as follows: "67014 . ' PEDESTRIAN' shall mean any person who is afoot or who is using a means of conveyance propelled by human power other than a bicycle. " SECTION 4 . Section 68600 .3 of the Redlands Ordi- nance Code is hereby amended to read as follows : "68600.3 . 'AUTHORIZED EMERGENCY VEHICLES ' . An authorized emergency vehicle is : (a) Any publicly owned and operated ambulance, lifeguard or lifesaving equipment or any privately owned or operated ambulance used to respond to emergency calls and operated under license issued by the Commis- sioner of the California Highway Patrol . (b) Any publicly owned vehicle operated by the following persons, agencies, or organizations: ( 1) Any forestry or fire department of any public agency or fire depart- ment organized as provided in the Health and Safety Code. ( 2) Any federal, state, or local agency, or department, or district employing peace officers as that term is defined in Chapter 4. 5 (commencing with Section 830) of Part 2 of Title 3 of the Penal Code, for use by those officers in the performance of their duties . (c) Any vehicle owned by the state or any bridge and highway district , and equipped and used either for fight- ing fires, or towing or servicing other vehicles, caring for injured persons, or repairing damaged lighting or electrical equipment . (d) Any state-owned vehicle used in responding to emergency fire, rescue -2- or communication calls and operated either by the Office of Emergency Services or by any public agency or industrial fire department to which the Office of Emergency Services has assigned the vehicle. (e) Any vehicle owned or operated by any department or agency of the United States Government when such vehicle is used in responding to emergency fire, ambulance or lifesaving calls, or is actively engaged in law enforcement work. ( f) Any vehicle for which an authorized emergency vehicle permit has been issued by the Commissioner of the California Highway Patrol . " • SECTION 5. This ordinance shall be in force and take effect as provided by law. SECTION 6 . The Mayor shall sign this ordinance, and the City Clerk shall certify to the adoption of this ordinance and cause it or a summary of it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in this city. Section 67402(a) of the Redlands Ordinance Code is hereby- amended to read as fellows': `67402., TURNING MARKERS AND MULTIPLE LANES. (a) Pursuant to Section 22101 of the Vehicle Code the City Council hereby authorizes the Traffic Engineer upon the basis of a traffic engineering inves- tigation n es-tigation to place markers, buttons or signs within or adjacent to intersections and thereby require and direct that a different course from that specified in Section 22100 of the Vehicle Code be traveled by vehicles turning at an intersection or may allocate and indicate more than one lane of traffic from which drivers of vehicles may make right or left hand turns. " SECTION 2. Section 6751(a) of the Redlands Ordinance Code is hereby amended to read as follows : '167501 .< a Pursuant to Section 21100 of the Vehicle Code, whenever the City Council determines upon the basis of a traffic engineering investigation that it is necessary to designate particular highways or alleys or portions thereof as one-way highways or alleys and require that all vehicles thereon move in one specified direction, the City Council shall by resolution direct the 'Traffic engineer to erect appropriate signs indicating the direction of travel at each highway or alley :intersecting such one--way highway or alley upon such particular; highway or alley or portion thereof . " SECTION 34= Section 67601 of the Redlands ordinance Code is hereby amended to read as fellows: »"67601. ESTABLISHMENT« OF THROUGH HIGH- WAYS AND STOP :INTERSECTIONS. Pursuant to Sections 21101, 21352, 21354 and 21355 of the Vehicle Code, the City Council may determine upon the basis of a traffic engineering investigation, by resolution that it is necessary to designate any highway as a through highway and to require that all vehicles stop before entering or crossing the same or to designate any intersection as a stop intersection and to require all vehicles to stop at one or more entrances to such intersection when signs are erected as provided In the Vehicle Code. " SECTION 4. Section 67603(a) the Redlands Ordinance Code is hereby amended to read as follows. 1167608. YIELD RIGHT-OF-WAY SIGNS A INTERSECTIONS (a) Pursuant to Section 21356 of the Vehicle Cocke, whenever the City Council determines upon the basis of a traffic engineering investigation that it is necessary to require vehicles entering an intersection at one or more of its approaches to slow and yield the right- of-way as provided in Section 21843 of the Vehicle Code, the City Council shall by resolution direct the Traffic Engineer to erect ,arid. maintain '`Yield Right-of- Way' signs on such approaches. " SECTION 5 Section 68801(a) of the Redlands ordinance Code is hereby amended to read asfollows : 2 #f68001 . AUTHORITY TO INCREASE 25-MILE LIMIT. (a) Pursuant to Section 22357 (a) of the Vehicle Code, whenever the City Council determines upon the basis of a traffic engineering investigation that a greater speed would facilitate the orderly movement of vehicular traffic and would be safe upon any street otherwise subject to a prima facie limit of 25-miles per hour under the Vehicle Code, the City Council shall determine and declare a higher prima facie speed limit . When such determination has been made, the City Council shall by resolution, direct the Traffic Engineer to erect and maintain signs upon such street as provided in the Vehicle Code, indicating the appropriate prima facie limit. Such markings may be supplemented by appropriate pavement markings. " SECTION 6 . Section 68002(a) of the Redlands Ordinance Code is hereby amended to read as follows : 1168002 . AUTHORITY TO DECREASE 55-MILE LIMIT. (a) Pursuant to Section 22358 of the Vehicle Code, whenever the City Council determines upon the basis of a traffic engineering investigation that the prima facie limit of 55-miles per hour is more than is reasonable or safe upon any street or highway where such prima facie limit of 55-miles per hour is applicable under the Vehicle Code the City Council shall determine and declare a lower prima facie limit which is appropriate to facilitate the orderly movement of traffic and is reasonable and safe. When such determination has been made the City Council shall, by resolution, direct the Traffic Engineer to erect and maintain signs upon such street or highway as provided in the Vehicle Code indicating the appropriate speed limit . Such signs -3- may be supplemented by appropriate pavement markings ."" SECTION 7 Section 68201(c) of the Redlands Ordinance Code is hereby amended to read as follows: 1168201E LIMITS ON UNIMPROVED HIGHWAYS., (o) Whenever such weight limit signs have been placed as provided in this section, it shall be a misdemeanor :for any person to drive or operate a vehicle upon such unimproved highway when the maximum, gross Freight limit stated by such signs is exceeded, except that any commercial vehicle shall not be prohibited from using any city highway by direct route to or from a state highway for the purpose of delivering or loading for transportation goods, wares_, o merchandise, as provided in Section. 35714(c) of the Vehicle Code. " SECTION 8 Section 68202(b) of the Redlands Ordinance Code is hereby amended to read as follows: X668202 TEMPORARY LIMITS ON IMPROVED HIGHWAYS. (b;) Whenever such temporary weight limit signs have been placed as provided in this Section, it shall be a misdemeanor for any person to drive or operate a vehicle upon such improved highway when the maximum gross weight of such vehicle plus the weight of the load thereon' exceeds the weight limit stated by such signs except that any commercial vehicle shall not be prohibited from using any City highway by direct route to or from a state highway for the purpose of -4- delivering or loading >for transportation of goods , wares, or merchandise as provided in Section 35714(c) of the Vehicle Code . " SECTION 9. This ordinance shall be in force and take effect as provided by law. SECTION 10 . The Mayor shall sign this ordinance, and the City Clerk shall certify to the adoption of this ordinance and cause it or a summary of it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in this City.
