AN ORDINANCE OF THE CITY OF REDLANDS ESTABLISHING THE SEWER
CAPITAL IMPROVEMENT FUND AND AMENDING ARTICLE 836 OF THE REDLANDS
ORDINANCE CODE
THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain as
follows:
SECTION ONE:
Article 836 of the Redlands Ordinance Code is hereby amended
to read as follows:
ARTICLE 836
SEWER CAPITAL IMPROVEMENT FUND
Sec. 83600 SEWER CAPITAL IMPROVEMENT FUND
The Sewer Capital Improvement Fund is established to provide for
capital facilities and improvements to provide new capacity
required to serve new development and connections. Included are
wastewater treatment plant facilities, sewer trunk lines, sewage
disposal facilities, outfall sewers, interceptor sewers, and other
capital facilities and appurtenances over and above the eight (8)
inch collection mains and appurtenances used to serve property
frontage, except as otherwise provided in Article 834 . All
interest on the cash balance of the Fund shall accrue to the Sewer
Capital Improvement Fund.
Sec . 83601 DEFINITIONS
For the purpose of carrying out the intent of this Section, the
following definitions shall apply.
a. PERSON means a natural person, his heirs, executors ,
administrators , or assigns and also includes a firm,
partnership, or corporation, and its or their successors
or assigns, or the agent of any of the aforesaid.
b. DWELLING means a structure designed and used exclusively
for residential occupancy.
C. SINGLE FAMILY DWELLING UNIT means a structure or portion
thereof designed exclusively for the occupancy of one
family.
d. MULTIPLE FAMILY DWELLING UNIT means a structure designed
and used for the occupancy be two (2) or more families.
e. MOBILEHOME means a vehicle, other than a motor vehicle,
designed or used for human habitation , for carrying
persons and property on its own structure, and for being
drawn by a motor vehicle.
f. MOBILEHOME PARK means any area or tract of land where one
or more mobilehome lots are rented or leased or held out
for rent or lease to accomodate mobilehomes used for
human habitation.

g. STRUCTURE means any building or improvement artificially
built up or composed of parts joined together in some
definite manner, including but not limited to dwellings,
commercial structures, industrial structures, schools,
churches, or hotels .
h. ACCESSORY STRUCTURE means a detached subordinate
structure located on the same parcel of ground with a
main structure , the use of which is customarily
incidental to that permitted in the main structure or to
the land upon which the main structure is located
including but not limited to laundry rooms, garages ,
hobby shops, guest houses; or swimming pools connected to
the building sewer.
i. BUILDING SEWER means that part of the horizontal piping
of a drainage system which extends from the end of the
building sewer drain and which receives the discharge of
the building sewer drain and conveys it to a public
sewer, private sewer, individual sewage--disposal system
or other point of disposal .
j . ADMINISTRATIVE AUTHORITY means the Director of Building
and Safety of the City of Redlands .
Sec. 83602 SEWER CAPITAL IMPROVEMENT CHARGE
1. The sewer capital improvement charge for the following
categories shall be paid prior to issuance of building permits
for buildings containing plumbing fixtures or prior to
approval of application for new sewer services to tap into the
City ' s sewerage system. Amounts of charges shall be
established by resolution of the City Council.
a . Single Family Dwelling Units
This charge for this category shall be a charge per
dwelling or unit.
b. Multiple Family Dwelling Units , Apartments , and
Mobilehome Park Lots or Space
The charge for this category shall be per dwelling unit
or mobilehome space.

C. Accessory Structures Within a Mobilehome Park Containing
Plumbing Fixtures
The charge for this category shall be a charge per
fixture unit with no minimum.
d. Non-residential Development (commercial, industrial, or
church buildings)
The charge for this category shall be minimum charge per
fixture unit with a minimum charge of $350.
e. All Sewer Capital Improvement Charges shall be credited
to the Sewer Capital Improvement Fund.
2. a. The owner of the property shall pay to the City the
difference in the Sewer Capital Improvement Charges
calculated on the basis of currently established
charges.
1) If a building or the use of a building on a parcel
of property which building had been connected to the
sewerage system is changed in a way that would make
the Sewer Capital Improvement Charge greater, or,
2) If a building is replaced on a parcel of property,
which building had been connected to the sewerage
system, and the replacement building would have a
greater Sewer Capital Improvement Charge than the
building replaced.
Said difference in charges shall be due prior to final
approval of a conditional use permit, if applicable, or,
if not , prior to building permit issuance . If not
collectable in this manner , said difference shall be
invoiced with the next billing for sewer service and
collectable in the same manner as the billing for sewer
service.
b. If a building or the use of a building, on a parcel of
property is changed in a way that would make the Sewer
Capital Improvement Charge less, no refund shall be made
but the property shall retain the amount of credit
established for its previous use.

.SECTIQI M: SEVERABILITY
If any portion of this Ordinance is found to be
unconstitutional or invalid, the City Council hereby declares
that it would have enacted the remainder of this Ordinance
regardless of the absence of any such invalid part.
,UCTIO THREE: REPEALER
All ordinances , Redlands Ordinance Code sections , all
resolutions, all City Council motions, and all actions of City
boards and commissions in conflict herewith are hereby
repealed.
SECTION FOUR: EFFECTIVE DATE
This Ordinance shall be in force and take effect on June 30,
1986 .
SECTION FIVE: CERTIFICATION
The City Clerk shall certify to the adoption of this Ordinance
and cause it to be published once in the Redlands Daily Facts,
a newspaper of general circulation and published in this City.
