HomeMy WebLinkAboutOrdinances_1270_CCv0001.pdf ORDINANCE NO. 1270 AN ORDINANCE OF THE CITY OF REDLANDS FIXING AND ESTABLISHING CHARGES FOR CONSTRUCTION OF THE CITY SEWERAGE FACILITIES AND RESCINDING ORDINANCE NO. 1180 AND RESOLUTION NO. 2162 THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS: SECTION ONE. For the purpose of carrying out the intent of this Ordinance the following definitions shall apply. (a) Person shall mean a natural person, his heirs, executors, administrators, or assigns and also includes a firm, partnership, or corporation, and its or their successors or assigns , or the agent of any of the aforesaid. (b) Dwelling shall mean a structure designed and used exclusively for residential occupancy. (c) Single family dwelling shall mean a structure or portion thereof designed exclusively for the occupancy of one (1 ) family, (d) Multiple dwellin shall mean a structure designed and used for occupancy by two 2 or more families, (e) Structure shall mean any building or improvement artificially built up or composed of parts joined together in some definite manner, including but not limited to dwellings, commercial structures, indus- trial structures, schools , churches , or hotels, (f) Accessory structure shall mean a detached subordinate structure located on the same parcel of ground with a main structure, the use of which is customarily incidental to that permitted in the main structure or to the land upon which the main structure is located including but not limited to laundry rooms, garages, hobby shops, guest houses ; or swimming pools connected to the building sewer, (g) Buildl.na sewer shall mean that part of the horizontal piping of a drainage system which extends from the end of the building drain and which receives the discharge of the building drain and conveys it to a public sewer, private sewer, individual sewage-disposal system or other point of disposal. (h) Administrative authority' shall mean the Building and Safety Superintendent of the City of Redlands . SECTION TWO. Every person who applies for a building permit for any dwelling or structure which contains plumbing fixtures or applies for a plumbing permit for installation of a building sewer or plumbing fixture shall pay ,into the Sewer Rental Fund a charge of Five Dollars ($5.00) per plumbing fixture +in-'Lt as said units are defined in Chapter 4, Tables 4-1 and 4-2, of the Uniform Plumbing Cade adopted by the City of Redlands with the following minimum charges . (a) For each single family dwelling, a minimum of One Hundred Dollars ($100. 00) . (b) For each multiple dwelling, a minimum of Sixty-Seven Dollars ($67.00 for each dwelling unit therein. (c ) For each structure other than multiple dwellings or acces- sory strisctures,, a minumum of One Hundred Dollars ($100, 00) . SECTION THREE, Where a structure is constructed on a parcel of ground which formerly contained a structure which had been connected to the City of Redlands sewerage systems a credit toward the above charge shall be allowed as determined by the Administrative Authority, but shall in no case exceed One Hundred Dollars ($100, 00) . c-•.. 3-�f-t' 'z` /y 7G SECTION FOUR, Unless charges established by this Ordinance are paid, no permit shall be issued for construction within the City of Redlands. SECTION FIVE. All funds and monies received from the collection . of charges as herein established shall be in the custody of the City Treasurer, who shall deposit such funds in a separate revenue account to be known as "SEWER CONSTRUCTION CHARGES" within the SEWER RENTAL FUND. Funds and earnings from this account shall be used only for the acquisition, management , operations maintenance , and reconstruction of sanitary or sewerage facilities ; provided, however, that such revenue shall not be used for the acquisition or construction of new local street sewers or laterals as distinguished from main trunk, intercep- tor and outfall sewers. SECTION SIX. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional, the City Council of the City of Redlands hereby declares that it would have passed this Ordinance irrespective of the fact that any one or more sections. subsections, sentences , clauses or phrases thereof be declared unconstitutional , SECTION SEVEN. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction of any such violation shall be punishable by a fine of not more than Three Hundred Dollars ($300.00) or by imprisonment for not more than 90 days or by bath such fine and .imprisonment , SECTION EIGHT. This Ordinance shall take effect thirty (30) days after .its passage in the manner and form required by law. SECTION NINE. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published once in the Redlands Daily Facts , a newspaper of general circulation within the City of Redlands. (a) Single family dwelling (b) Multiple family dwelling (c) For each structure other than multiple dwellings or accessory structures f. SECTION 83602. Where a structure is constructed on a parcel of ground which formerly contained a structure which yI& had been connected to the City of Redlands sewerage system, L _ a credit toward the above charge shall be allowed as es- tablished by resolution of the City Council. g. SECTION 84003 (g) (3) . Fee. A fee as established by resolution of the City Council shall be submitted with each application for certificate of occupancy. h. SECTION 84012 (b) . Paving Permit Fees : A fee for each paving permit shall be paid as required by resolution of i the City Council . i. SECTION 84505 .6. Permit Fees: No sign permit shall be issued until the applicant has paid permit fees as required by resolution of the City Council. j . SECTION 84802. A fee as established by resolution of f the City Council shall be paid upon filing the applica- tion. The fee is in addition to other fees required for moving, construction, altering or repairing the building being moved. 4. Section 8 In the event a person does or performs or causes the ` doing or performing of any of the acts mentioned in para- graphs numbered 1 to 6 inclusive of subdivision (a) of Section 2 of this ordinance without securing a permit therefor, except in case of emergency as herein provided, Ordinance No . 1470 D- -P4-_
