HomeMy WebLinkAboutOrdinances_1305_CCv0001.pdf J ORDINANCE NO. 1305 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING SECTIONS ONE AND TWO OF ORDINANCE NO. 1270 FIXING AND ESTABLISHING CHARGES FOR CONSTRUCTION OF THE CITY SEWERAGE FACILITIES . THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS : THAT Sections One and Two of Redlands Ordinance No. 1270 are here- by amended as follows : SECTION ONE. For the purpose of carrying out the intent of this Ordinance the following definitions shall apply. (a) Person shall mean a natural person, his heirs, executors, administrators, or assigns and also includes a firm, partnership, or corporation, and its or their successors or assigns, or the agent of any of the aforesaid. (b) Dwelling shall mean a structure designed and used exclu- sively for residential. occupancy. (c) Single family dwelling shall mean a structure or portion thereof designed exclusively for the occupancy of one (1) family. (d) Multiple dwelling shall mean a structure designed and used for occupancy by two (2) or more families. (e) Mobilehome is a vehicle, other than a motor vehicle, de- signed or used for human habitation, for carrying persons and property on its own structure, and for being drawn by a motor vehicle. (f) Mobilehome park is any area or tract of land where one or more mobilehome lots are rented or leased or held out for rent or lease to accomodate mobilehomes used for human habitation . (g) Structure shall mean any building or improvement artifi- cially built up or composed of parts joined together in some definite manner, including but not limited to dwellings, commercial structures, industrial structures, schools, churches, or hotels . (h) Accessory structure shall mean a detached subordinate structure located on the same parcel of ground with a main structure, the use of which is customarily incidental to that permitted in the main structure or to the land upon which the main structure is located including but not limited to laundry rooms, garages, hobby shops, guest houses; or swimming pools connected to the building sewer. (i) Building sewer shall mean that part of the horizontal piping of a drainage system which extends from the end of the building drain and which receives the discharge of the building drain and con- veys it to a public sewer, private sewer, individual sewage-disposal system or other point of disposal. (j) Administrative authority shall mean the Building and Safety Superintendent of the City of Redlands. SECTION TWO. Every person as owner of a mobilehome park shall pay into the Sewer Rental Fund for each lot or mobilehome pad the sum of One Hundred Dollars ($100 .00) , and any accessory structure within the park containing plumbing fixtures the sum of Five Dollars ($5 .00) per plumbing fixture unit, or any person who applies for a building permit for any dwelling or structure which contains plumbing fixtures or applies for a plumbing permit for installation of a building sewer or plumbing fixture shall pay into the Sewer Rental Fund a charge of Five Dollars ($5.00) per plumbing fixture unit as said units are de- fined in Chapter 4, Tables 4-1 and 4-2, of the Uniform Plumbing Code adopted by the City of Redlands with the following minimum charges . (a) For each single family dwelling, a minimum of One Hundred Dollars ($100.00) . (b) For each multiple dwelling, a minimum of Sixty-seven Dollars ($67.00) for each dwelling unit therein. (c) For each structure other than multiple dwellings or acces- sory structures, a minimum of One Hundred Dollars ($100.00) ° SECTION THREE. This ordinance shall be in force and take effect as provided by laws SECTION FOUR. The City Clerk shall certify to the adopting of this ordinance and cause the same to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in this City. SECTION 83601 .2 . Minimum Sewer Rental Fund fees for the following are as established by re,:olution of the City Council: 41 v3`s` (a) Single family dwelling (b) Multiple .family dwelling (c) For each structure other than multiple dwellings or accessory structures f. SECTION 83602 . Where a structure is constructed on a parcel of ground which formerly contained a structure which 00 had been connected to the City of Redlands sewerage system, a credit toward the above charge shall be allowed as es- tablished by resolution of the City Council . g. SECTION 84003 (g) (3) . Fee. A fee as established by resolution of the City Council shall be submitted with each application for certificate of occupancy. h. SECTION 84012 (b) . Paving Permit Fees : A fee for each 6paving permit shall be paid as required by resolution of the City Council . i. SECTION 84505 .6. Permit Fees : No sign permit shall be �.,kvissued until the applicant has paid permit fees as required by resolution of the City Council . j . SECTION 84802 . A fee as established by resolution of the City Council shall be paid upon filing the applica- tion. The fee is in addition to other fees required for moving, construction, altering or repairing the building being moved. 4. ORDINANCE NO. 909 Section 7, paragraph a: A permit fee per job as established by the City Council In a resolution. Section 7, paragraph d: A charge as established by the City Council in a reso- lution for connecting a house sewer to a public sewer at a point where no special "Y", "T" or spur branch has been previously installed, in addition to other costs . Section 8 In the event a person does or performs or causes the doing or performing of any of the acts mentioned in para- L graphs numbered 1 to 6 inclusive of subdivision (a) of Section 2 of this ordinance without securing a permit therefor, except in case of emergency as herein provided, Ordinance No. 1470 person, or persons, corporation or agency originally paying for said water main to which the connection has been made. See Section 59117 (d) for rules governing application for refunds . Any property for single family dwelling that has more than one frontage side shall pay the frontage charge for one half of each frontage side. b . SECTION 59117 (d) . Refunding of the Costs Within City Limits . There shall be no refunding of any costs for the laying of any mains within the development or for connections to lots within the development or for con- nections to any lots contiguous to the mains that had a connection prior to the installation of the new main . For all new connections to lots contiguous to all such mains laid by the owner or subdivider and not within the tract or subdivision, the City of Redlands Water Division shall refund to the original applicant an amount in accord- ance with current resolution approved by the City Council, which refund agreement shall not be transferable except to legal heirs and assigns and in any event no refunds shall be made, and the agreement shall terminate, ten years from completion of such new main. The person entitled to such a refund shall make appli- cation for refund to the Water Division. If the appli- cant does not apply for the refund by July 1st of each year for all connections made during the preceding calendar year, such money shall be transferred to the operating budget of the Water Division and the applicant shall forfeit all claim to such money. Three such con- secutive annual forfeitures shall terminate the refund contract, and all moneys accruable under the contract shall become the property of the City of Redlands Water Division. C. SECTION 83601 . Every person as owner of a mobilehome park shall pay fees, as established by resolution of the City Council, into the Sewer Rental Fund, as follows: (a) For each lot or mobilehome pad (b) For any accessory structure within the park containing plumbing fixtures d. SECTION 83601 .1 . Any person who applies for a building permit for any dwelling or structure which contains plumbing fixtures, or applies for a plumbing permit for installation of a building sewer or plumbing fixture shall pay into the Sewer Rental Fund a fee as established t. by resolution of the City Council . Said fixtures (units) are defined in Chapter 4, Tables 4-1 and 4-2, of the Uniform Plumbing Code as adopted by the City of Redlands . Ordinance No. 1470 Page four
