HomeMy WebLinkAboutOrdinances_1943_CCv0001.pdf ORDINANCE NO. 1943 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING ARTICLE 837 OF THE REDLANDS ORDINANCE CODE TO ALLOW FOR SETTING SEWER SERVICE CHARGES BY RESOLUTION AND DELETING ARTICLE 838 OF THE REDLANDS ORDINANCE CODE THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain as follows: SECTION ONE: Article 837 of the Redlands Ordinance Code is amended to read as follows: ARTICLE 837 SEWER SERVICE CHARGES Sec . 83700 DEFINITIONS 1 . SEWERAGE SYSTEM means those pipe lines and appurtenances maintained and operated by the City for the collection and conveyance of sewage to the plant owned and operated by the City of Redlands, wastewater treatment , and treatment and discharge of said wastewater to required standards . 2 . CITY means the City of Redlands . 3 . PREMISES means a lot , parcel of land , building or establishment. 4 . APARTMENT HOUSE means any building containing three or more dwelling units with separate plumbing facilities , but shall not include any building commonly known as a hotel, motel, or auto court . 5 . SEWER CONNECTION or CONNECTION means physically tapping into sewer mains or their laterals for the purpose of serving a private sewer line or building sewer from a property or premises . 5 . SEWER SERVICE CHARGE means service charges for the use of the sewerage sysem based on sewer rates . 7 . SEWER RATES means the sewer rates , rate structures , and rate classes to be established by resolution of the City Council to be used as a basis for charging users for service from the sewerage system. Sec . 83701 SEWER SERVICE CHARGES Every person whose premises in the City are served by a connection with the sewerage system of the City , whereby the sewage or industrial wastes , or either or both, are disposed of by the City, either through the facilities of the wastewater treatment and sewage disposal works owned by the City of Redlands, or otherwise, shall pay a sewer service charge which shall be set by City Council resolution based on the following rates: Ordinance No. 1943 Page 3 1 . Domestic Rates a. For all dwelling units including single family residences , apartments, hotel accomodations and mobile homes , having cooking facilities there shall be a charge per month. b . For each dwelling unit without cooking facilities there shall be a charge per month. 2 . Each school shall pay a sewer service fee according to the following schedule: a charge per month during the school term for each 100 A .D .A . or part thereof , computed on the previous year ' s attendance. 3 . Each business establishment , manufacturing plant , commercial house , industrial building , or plant shall pay a monthly charge for each sewer connection based on the amount of water consumption of said premises as follows: A charge for each 1000 cubic feet or fraction thereof. The above charge shall be based on one hundred percent of the estimated cost for sewage treatment and disposal per M.G. 4 . Club buildings and meeting places shall be charged on the same basis as commercial houses , business establishment and industrial buildings or plants . 5 . The sewer service rate for commercial houses and small industries maintaining yard space and landscaping shall be based on the average water usage for the month of December and the following month of January , this basis to be established annually. 6 . For each church, a charge per month. This section includes churches only, and not parsonages , which shall be charged at the regular domestic rate. Sec. 83702 SEWER SERVICE FUND There is hereby established a Sewer Service Fund to provide for administration , operation , and maintenance of the Redlands Domestic Sewerage System and its capacity to serve its existing users . All interest on the cash balance of the Fund shall accrue to the Sewer Service Fund. The following rules shall apply: Ordinance No. 1943 Page 4 1 . All service charges and all miscellaneous charges not otherwise designated shall be credited to the Sewer Service Fund. 2 . Established within the Sewer Service Fund is a Reserve for Capital . The Reserve for Capital shall be in addition to annual capital replacement budget , to establish a fund for capital expenditures necessary due to unforeseen or unusual capital costs in any year, necessary to maintain the existing system and its capacity. Sec . 83703 AMOUNTS OF CHARGES The City Council may, from time to time, in its discretion and by resolution, fix , alter, change, amend or revise the amounts of charges and rates for facilities and services of the sewerage system. Sec . 83704 BILLING AND PAYMENT 1 . It shall be the duty of the City Water Department to bill and collect all sewer service and miscellaneous charges . 2 . The charges fixed for any premises shall be billed and collected with the charges for water and disposal services furnished by the City . Billing shall be at the same time that such charges for water are due and payable and delinquent 15 days after date of mailing . The total amount due for the charges for water and disposal shall be paid as a unit . 3 . The City Council of the City shall have the right to require any person liable to pay any charge herein fixed, to make a reasonable deposit with said water department to insure the collection of any charge herein fixed. 4 . In the event that any person shall fail to pay any charge herein provided when the same becomes due, the City may, in addition to any other remedies it has , cut off any said services and facilities referred to in this Article , including the service of water, and shall not resume the same until all delinquent charges together with any charges necessitated by the resumption of such services and facilities have been fully paid . Failure to receive a bill for the sewer service does not relieve the consumer of liability. When sewer service has been discontinued for failure of payment of a sewer service bill , the consumer shall pay a service charge for the reinstatement of sewer service. Ordinance No. 1943 Page 5 5 . Any amount due for sewer service charges under this Article shall be deemed a debt to the City of Redlands , and any person, firm, or corporation failing , neglecting, or refusing to pay said indebtedness shall be liable in an action by the City in any court of competent jurisdiction for the amount thereof. Sec. 83705 SERVICE OUTSIDE DE CITY LIMITS Every person whose premises outside the City limits are served by a connection with the sewerage system of this City, whereby the sewage or industrial wastes of either or both are disposed of by the City, either through the facilities of the sewage treatment and sewage disposal works owned by the City of Redlands or otherwise, shall pay a sewer service charge of double the rates established for those persons within the City pursuant to this Article. Ordinance No. 1943 Page 6 SECTION TWO: REPEALER All ordinances, Redlands Ordinance Code sections , all resolutions, all City Council motions , and all actions of city boards and commissions in conflict herewith are hereby repealed. Resolution 3272 is hereby repealed. Ordinance 948 , Sec . 3 , is hereby repealed. Article 838 of the Redlands Ordinance Code is hereby repealed. SECTION THREE: EFFECTIVE DATE This Ordinance shall be in force and take effect as provided by law. SECTION FOUR: CERTIFICATION The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts , a newspaper of general circulation and published in this City.
