AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER
8.54 OF THE REDLANDS MUNICIPAL CODE RELATING TO SMOKING
AND THE SALE AND DISTRIBUTION OF TOBACCO PRODUCTS
THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS:
Section 1. Chapter 8.54 of the Redlands Municipal Code relating to smoking and the sale
and distribution of tobacco products is hereby amended by the addition of Section 8.54.160 to
read as follows:
"$54.160 Signagc -- Photo ID..
A. Any person, business, tobacco retailer or other establishment subject to the
provisions of this Chapter shall post plainly visible signs at the point of purchase
of tobacco products which state: "THE SALE OF TOBACCO PRODUCTS TO
PERSONS UNDER EIGHTEEN YEARS OF AGE IS PROHIBITED BY LAW.
PHOTO ID REQUIRED." The letters of such signs shall be at least one-quarter
inch (114") high.
B. No person, business, tobacco retailer, or owner, manager or operator of any
establishment subject to the provisions of this Chapter shall sell, offer to sell or
permit to be sold any tobacco product to an individual without requesting and
examining identification establishing the purchaser's age as eighteen years or
greater unless the serer has some reasonable basis for determining the purchaser's
age.to
Section 2. Chapter 8.54 of the Redlands Municipal Code relating to smoking and the
sale and distribution of tobacco products is hereby amended by the addition of Section 8.54.162
to read as follows:
"8.54.162 Vendor-assisted ales.
A. Except for a retail tobacco store, as that term is defined in this section, it shall be
unlawful for any person or business to sell, permit to be sold, or offer for sale any
tobacco product by means of self-service displays or by any other means other than
vendor-assisted sales.
B. The term "Retail Tobacco Store" shall mean a retail store utilized primarily for the
sale of tobacco products and accessories and in which the sale of other products is
merely incidental. For purposes of this subsection, the term "incidental" shall

mean that at least eighty percent(80%) of the square footage of the available retail
floor and shelf space is devoted to the sale of tobacco-related products and
accessories."
Section 3. If any section or portion of this ordinance is for any reason held to be
invalid or unconstitutional by a decision of a court of competent jurisdiction, that section or
portion shall be deemed severable and shall not affect the validity of the remaining portions of this
ordinance. The City Council hereby declares that it would have passed this ordinance, or any
sections or portions hereof, irrespective of the fact that any one or more sections or portions may
be declared invalid or unconstitutional.
Section 4. The Mayor shall sign this ordinance and the City Clerk shall certify to the
adoption of this ordinance and shall cause it, or a summary of it, to be published once in the
Redlands Daily Facts, a newspaper of general circulation within the City and thereafter this
ordinance shall take effect as provided by law.
